ORDINANCE NO. 86 - 91
(Regulating Consumption of Alcoholic Beverages)
The Contra Costa County Board of Supervisors ordains as
follows (omitting the parenthetical footnotes from the
official text of the enacted or amended provisions of the
County Ordinance Code) :
SECTION I : SUMMARY. This ordinance adds Chapter 54-16 to
the County Ordinance Code to prohibit the possession,
consumption, or exhibition of an open container of alcoholic
beverage on any street, sidewalk, way, alley, public parking
lot, private parking lot open to the public, park,
playground, or other public facility.
SECTION II: Enactment. Chapter 54-16 is added to the County
Ordinance Code to read:
Chapter 54-16
OPEN ALCOHOL CONTAINERS IN PUBLIC AREAS
54-16.002. Prohibited Acts. (a) No person shall
consume, drink, exhibit, or possess an open container
of any alcoholic beverage in any quantity on any public
street, avenue, boulevard, sidewalk, way, alley,
thoroughfare, public parking lot or private parking lot
open to the public, park, playground, or other public
facility within the unincorporated area of the County
of Contra Costa;
(b) No person shall consume, drink, exhibit, or
possess an open container of any alcoholic beverage
within 15 feet of any public way or thoroughfare while
on a private driveway, stairway, doorway, or other
private property open to public view without the
express or implied permission of the owner, his agent,
or the person in lawful possession thereof except as
provided in Section 54-16. 006. (Ord. 86-91 )
54-16.004. Definitions. As used in this chapter,
"open container" means a bottle, can, or other
receptacle which is open, has been opened, or which has
a seal broken, or of which the contents have been
partially removed.

54-16. 006 . Exceptions. Section 54-14.002 shall
not apply to those areas and during such time as the
Sheriff or other County agency designated by the
Board has issued a permit for temporary use and
occupancy of public streets, parks, or other public
facilities and appurtenant areas for the consumption of
alcoholic beverages. (Ord 86-91 )
54-16.008. Infraction. Any person who is
convicted of a violation of any provision of this
chapter is guilty of an infraction and shall be
punished as provided in Section 14-8. 002. (Ord. 86- 9-1 )
SECTION III : No Repeal. The enactment of Chapter 54-16 is
not intended to, or shall it be construed as, a repeal of
Chapter 54-14.

SECTION IV: EFFECTIVE DATE. This ordinance becomes
effective 30 days after passage, and within 15 days of
passages ahall ba. published once with the names of the
supervisors voting for and against it in the
Contra Costa Times a newspaper published in
this County.
