T, 3 THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA Adopted this Order on January 28 , 1986 by the following vote: AYES: Supervisors Schroder, McPeak, Torlakson and Fanden NOES: None ABSENT: Supervisor Fanden ABSTAIN: None ---------------------------------------------------------------- ---------------------------------------------------------------- RESOLUTION NO. 86/36 SUBJECT: (Ord.0 SS913-6. 024, In the Matter of Adopting ) 913-6 . 026) Report, Determining Lack of ) Majority Protest, Establishing) Area of Benefit, and Estab- lishing Estimated Costs, Cost ) Allocation, Fee Apportionment. ) Crow Canyon Road Extension ) Area of Benefit ) The Board of Supervisors of Contra Costa County FINDS that: Government Code Section 66484 and Division 913 , Title 9 , of the Contra Costa County Code provide for assessing and collecting fees for bridge and/or major thoroughfare construction within a designated Area of Benefit as a condition of approval of a final subdivision map or as a condition of issuing a building permit; and The Public Works Director and the Director of Community Development have completed a revised Development Program Report for the Crow Canyon Road Extension Area of Benefit which was filed with the Clerk of the Board on January 14, 1986. Notice of the hearing was duly given in accordance with Section 913-6. 014 of the Contra Costa County Ordinance Code; and A Negative Declaration pertaining to this project was published. No protests were received during the review period. The Board hereby CONCURS in the findings that the project will not have a significant effect on the environment and hereby DIRECTS the Director of Community Development to file a Notice of Determination with the County Clerk; and This Board hereby DETERMINES that a majority protest does not exist, inasmuch as a written protest has not been filed by the owners of more than one-half of the area of the property to be benefited by the improvement; and This Board hereby ADOPTS the revised Development Program Report of January 27 , 1986 pertaining to the Crow Canyon Road Extension Area of Benefit, its boundaries, estimated cost of improvements, costs allocation, method of fee apportionment and provision that the interest accrued on the fees collected in this Area of Benefit shall continue to accumulate in the same account and shall be used to cover the cost of administration, design and construction of the Extension of Crow Canyon Road. The Board hereby INTENDS to adopt the following fee schedule by ordinance, as recommended in the Development Program Report: Residential multi-family, $1 , 302/unit; Residential single-family, $1 , 630/unit; Commercial, $1 . 60/square foot of gross floor area; and office $1. 80/square foot of gross floor area. The Board hereby RESOLVES that the Director of Community Development is DIRECTED to closely monitor future amendments to the currently adopted General Plan within this Area of Benefit and their impact on traffic and the Area of Benefit. NOW, THEREFORE, IT IS HEREBY RESOLVED that an Area of Benefit is hereby ESTABLISHED in the unincorporated area of the County of Contra Costa pursuant to Section 913-6. 024 of the Contra Costa County Ordinance Code, the boundaries of which are described in the Development Program Report pertaining to the Crow Canyon Road Extension Area of Benefit. IT IS FURTHER RESOLVED that the Clerk of this Board is DIRECTED to file a certified copy of this Resolution with the County Recorder as specified in Section 913-6. 026 of the Contra Costa County Ordinance Code. IT IS FURTHER ORDERED that Ordinance Number 86-11 giving effect to the aforesiad Area of Benefit is introduced and reading waived and February 4, 1986 , is set for adoption of same.
