HomeMy WebLinkAboutORDINANCES - 12041984 - 84-65 (2) ORDINANCE NO. 84-65 AN ORDINANCE REPEALING ORDINANCE NO. 79-12 AND AMENDING ORDINANCE NO. 84-54 OF THE CONTRA COSTA COUNTY FLOOD CONTROL AND WATER CONSERVATION DISTRICT FOR DRAINAGE AREA 30A THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY AS THE GOVERNING BOARD OF THE CONTRA COSTA COUNTY FLOOD CONTROL AND WATER CONSERVATION DISTRICT DOES ORDAIN AS FOLLOWS : SECTION 1. Ordinance No. 79-12 of the Contra Costa County Flood Control and Water Conservation District is hereby repealed. SECTION 2 . SECTION IX of Ordinance No. 84-54 of the Contra Costa County Flood Control and Water Conservation District is amended, to authorize credit for drainage fees paid under former Ordinances Nos. 79-12 and 80-12 , to read: SECTION IX. CREDIT. Drainage fees previously paid shall be credited as follows : 1) Where drainage fees have been partially paid under former Ordinances No. 79-12 and No. 80-12 , fees shall not be required for any part of the total area for which the fee was paid; 2) Where drainage fees have been paid other than pursuant to an adopted drainage fee ordinance, credit shall be given for the dollar amount of the fee paid for the development site; 3) Where drainage fees have been paid pursuant to this ordinance or other ordinance based on impervious surface, the credit shall be based on the ordinance in effect at the time of the additional payment. SECTION 3 . URGENCY. This ordinance is for the immediate preser- vation of the public peace, health and safety within the meaning of Government code §25123. By inadvertent error Ordinance No. 84-54 failed to repeal Ordinance No. 79-12 in SECTION 1, and incorrectly referred in SECTION 2 (SECTION IX) to Ordinance No. 79-36 , instead of Ordinances Nos. 79-12 and 80-12 . This ordinance is necessary so that excessive drainage fees are not collected under Ordinance No. 79-12 , and to permit credits for fees collected under former Ordinances Nos. 79-12 and 80-12 . Passage as an urgency measure will avoid confusion and improper collection of fees, and permit the appropriate application of credits to all parties affected. ORDINANCE NO. 84- 65 00 77 SECTION 4 . EFFECTIVE AND OPERATIVE DATES. This ordinance becomes effective immediately on passage, and within 15 days of passage shall be published once with the names of supervisors voting for and against it in the Antioch Daily Ledger, a newspaper published in this county.
