HomeMy WebLinkAboutORDINANCES - 12041984 - 84-64 (2) ORDINANCE NO. 84- 64 -------------------- (Abandoned Vehicle Abatement ) The Contra Costa County Board of Supervisors ordains as follows (omitting the parenthetical footnotes from the official text of the enacted or amended provisions of the County Ordinance Code) : SECTION I_ Section 430-2 . 004 of the County Ordinance Code is amended, 430_2_004 Authority , findings , nuisance_ (a) Authority. This division is enacted pursuant to California Vehicle Code Sections 22660 , 22661 , 22662 , 22665 , and Government Code Section 25845 . (b) Findings_ The board finds and declares that the accumu- lation and storge of abandoned , wrecked, dismantled , or inopera- tive vehicles or parts thereof on private and public property not including highways creates a condition tending to reduce the value of private property, to promote blight and deterioraton, to invite plundering, to create fire hazards , to consititute an attractive nuisance creating a hazard to the health and safety of minors , to create a harborage for rodents and insects , and to be injurious to the public health , safety and general welfare. ( c) Nuisance . The presence of an abandoned , wrecked , dismantled, or inoperative vehicle or parts thereof , on private or public property not including highways , except as expressly hereinafter permitted , constitutes a public nuisance presenting an immediate threat to public health and safety which may be abated as such in accordance with the provisions of this division and code . Section 430-6. 008 is added to the Ordinance Code, to provide for abatement of inoperable vehicles which are incapable of being towed and valued at less than $200 , to read : 430-6. 008 . Inoperable non-towable Vehicles . --------- --------------------- ( a) This chapter ' s notice of intention is. not required for removal of a vehicle or part thereof which is inoperable due to the absence of a motor , transmission, or wheels and incapable of being towed, and is valued at less than two hundred dollars ( $200) by a person specified in the Vehicle Code Section 22855 , provided that the property owner has signed a release authorizing removal and waiving further interest in the vehicle or part thereof . Prior to final disposition under Vehicle Code Section 22662 of such a low-valued vehicle or part for which evidence of registration was recovered, the C.H.P. shall provide notice to the registered and legal owners of intent to dispose of the vehicle or part , and if the vehicle or part is not claimed and removed within 12 days after the notice is mailed , from a location specified in Vehicle Code Section 22662 , final disposition may proceed. The County, C.H.P. or any contractor thereof shall not be liable for damage caused to a vehicle or part thereof by removal pursuant to this section. ORDINANCE NO. 84-64 -------------------- 00 72 (b) This section applies only to inoperable vehicles located upon a parcel that is (1 ) zoned for agricultural use or ( 2) not improved with a residential structure containing one or more dwelling units . (Ord. 84- 64§2 : Veh.C. 522661 . ) SECTION 111 . EFFECTIVE DATE.
