REASONS FOR RECOMMENDATIONS AND BACKGROUND:
The FC District has applied for and anticipates receiving Proposition 84 grant funding from the California
Department of Water Resources for geotechnical sampling and analysis of the levees of Wildcat and San Pablo
Creeks in the North Richmond Area. The geotechnical documentation developed in this investigation will be
submitted to the U.S. Department of Homeland Security's Federal Emergency Management Agency (FEMA) to
show that the levees meet the requirements of Section 65.10 of the National Flood Insurance Program (NFIP)
regulations. In order for the FC District to receive the California Department of Water Resources Proposition 84
grant funding, it must have in place a Labor Compliance Plan(LCP)that meets the requirements of subdivision(b)
of Labor Code Section 1771.5.
The proposed LCP embodies all current Federal and state labor requirements routinely applied by Contra Costa
County and implements the more thorough payroll compliance assessments specified by the state for Proposition 84
grant funding.
CONSEQUENCES OF NEGATIVE ACTION:
If a Labor Compliance Plan is not in place,the FC District will be unable to obtain grant funding from the California
Department of Water Resources.
