(District III) SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION RECOMMENDATION(S): ADOPT Resolution No. 2009/ S? accepting completion of warranty period and release of cash deposit, for Road Acceptance 06-01222 (cross-reference Subdivision for 99-08381), for project being developed by Shapell Homes, a Division of Shapell Industries, Inc., a Delaware Corp., as recommended by the Public Works Director, Danville area. (District III) FISCAL IMPACT: None. BACKGROUND/REASON(S) FOR RECOMMENDATION(S): The improvements(bioretention street filters)have met the guarantee performance standards for the warranty period following completion and acceptance of improvements. CONSEQUENCES OF NEGATIVE ACTION: The Road Improvement Agreement and performance/maintenance surety rider will not be exonerated, and the billing account will not be liquidated and closed. (District III) On August 19,2008,this Board resolved that the(bioretention street filter)improvements for RA 06-01222 were completed as provided in the Road Improvement Agreement with Shapell Homes,a Division of Shapell Industries, Inc.,a Delaware Corp.,and now on the recommendation of the Public Works Director; The Board hereby FINDS that the improvements have satisfactorily met the guaranteed performance standards for the period following completion and acceptance. NOW THEREFORE BE IT RESOLVE that the Public Works Director is AUTHORIZED to REFUND the $1,500.00 cash deposit'(Auditor's Deposit Permit No. 472597, dated October 25, 2006) plus interest in accordance with Government Code Section 53079, if appropriate,to Shapell Homes,a Division of Shapell Industries, Inc., a Delaware Corp.,pursuant to the Road Improvement Agreement and Ordinance Code Section 94-4.406. (District 11I) Date: January 12, 2009 Page: 2 BE IT FURTHER RESOLVED that upon accepting the completion of warranty period by the Board of Supervisors,the Alamo Creek Owner's Association,shall ACCEPT the(bioretention street filter) improvements for maintenance in accordance with the Landscape Maintenance Agreement for the Alamo Creek Project dated December 4, 2007. BE IT FURTHER RESOLVED that the warranty period has been completed and the Road Improvement Agreement and performance/maintenance surety bond rider, Bond No 929 390 948 dated July 29, 2008, issued by National Fire Insurance Company of Harford, are exonerated.
