SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION
RECOMMENDED ACTION:
DETERMINE that there is a need to continue the emergency action taken by the Board of Supervisors on
April 10, 2007, pursuant to Public Contract Code Sections 22035 and 22050, to implement the Lower Walnut
Creek Interim Protection Measures project, Pacheco area.
FISCAL IMPACT:
The total estimated contract cost is $8,500,000, funded by Flood Control Zone 3B Funds.

REASONS FOR RECOMMENDATIONS AND BACKGROUND:
A. On April 10, 2007, the Board of Supervisors declared an emergency and authorized the Chief Engineer to
proceed in the most expeditious manner to repair or replace the Lower Walnut Creek flood control facility
as directed by the US Army Corps of Engineers.
B. Repair status:
The Contra Costa County Flood Control and Water Conservation District (District) prepared the Lower
Walnut Creek Corrective Action Plan (CAP) and presented it to the US Army Corps of Engineers for
consideration on June 11, 2007. The CAP contained two phases of work. The first phase of the project
included significant sediment removal and levee reconstruction and was completed in early December 2007.
The US Army Corps of Engineers approved both phases of the CAP on-May 19, 2008. The second phase of
work included levee reconstruction at selected locations near the confluence of Walnut and Grayson Creeks.
This Phase 2 work was substantially completed in October 2008. The remaining tasks are focused on
mitigating the impacts of both phases of work. Specifically, this includes adjusting topography in
reconstructed marsh areas to reduce mosquito habitat and revegetating and monitoring areas disturbed by
both phases of work. These follow up tasks are expected to be complete in spring 2009.
CONSEQUENCES OF NEGATIVE ACTION:
Nonconcurrence with the above recommendation may significantly delay implementation of the remaining CAP
work in Lower Walnut Creek flood control facility and prevent the District from meeting the correction
schedule required by the US Army Corps of Engineers.
