BUEREN, PUBLIC WORKS DIRECTO oaa u z Costa DATE: November 18, 2008 County SUBJECT: Execute a contract with Universal Building Services, Countywide (Unincorporated County Stormwater Utility Assessment Fund) (All Districts) SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION RECOMMENDED ACTION: APPROVE AND AUTHORIZE the Public Works Director, or designee to execute a contract with Universal Building Services(UBS)effective November 1,2008 through October 31,2011,with a payment limit of$442,132, to provide routine street sweeping services once per month for-all curbed streets in unincorporated Contra Costa County. Countywide. Project No. 751'7-6W7223 FISCAL IMPACT: No impact to the General Fund. Contract will be-paid for with Stormwater Utility Assessment Revenue from the unincorporated areas (Fund 7517) designated to the County Watershed Program (100%). The San Francisco Bay and Central Valley Regional Water Quality Control Boards (RWQCBs)have each issued Contra Costa County(County) a Municipal Stormwater Discharge Permit under the National Pollutant Discharge Elimination System (NPDES) that governs stormwater and non-stormwater discharges from areas owned and operated by the County. In order to comply with our NPDES Permits municipal maintenance performance standards,all.,curbed.streets in the unincorporated areas of the County must be swept at least once per month. Street sweeping removes sediment, debris, and other contaminants that might normally enter the storm drain system and flow untreated to creeks and other natural waterways. Adoption of this contract will continue mandatory monthly sweeping of curbed streets in the following four service areas and unincorporated communities: West County (El Sobrante, North Richmond, Rodeo, Crockett,Rollingwood and Montara Bay) Central County (Pacheco, Clyde, industrial north Martinez/Concord, Pleasant Hill)Note, Delta Diablo East County (Discovery Bay)' South County (Alamo) Sanitary District is responsible for funding and servicing Bay Point. The County Watershed Program will administer this street sweeping contract in order to comply with the municipal permits. The County Watershed Program is not responsible for non-routine street sweeping related to road improvements and maintenance (chip seal cleanup) and/or construction projects, which are not related to the municipal permits. The contractor, UBS competed against three other companies in an electronic closed bid process (RFPDepot) and presentedthe lowest overall bid. UBS is currently providing successful routine street sweeping services which are not related to compliance with municipal permits to the County. CONSEQUENCES OF NEGATIVE ACTION: The County's contract with UBS terminates on October 31,2008,and a new contract is necessary to continue street sweeping services and to reflect the newly-issued municipal permits. Without this contract,the County will not be in compliance with its Municipal Stormwater Discharge NPDES Pen-nits with the San Francisco Bay and Central Valley Regional Water Quality Control Board(s) which couldresult in enforcement action and fines of up to $15,000 per day.
