'Diablo Unified School District ■ Pittsburg Unified School District • West Contra Costa Unified School District BACKGROUND: The Williams Settlement Legislation, signed into law in September 2004, requires all California County Offices of Education to monitor schools in deciles 1 through 3 on the 2003 base Academic Performance Index. D El Cerrito, CA 94530 Dear Mr. Gioia: Enclosed is the annual report on the schools identified in the Williams Settlement within Contra Costa County for fiscal year 2008-09. The Contra Costa County Office of Education collected documentation from 55 schools in Contra Costa County representing five school districts: • Antioch Unified School District • John Swett Unified School District • Mt. Diablo Unified School District • Pittsburg Unified School District • West Contra Costa Unified School District California Education Code section 1240(c)(2)(B) requires that schools identified in the Williams Settlement in our county be visited within the first four weeks of school, that noted areas be reviewed, and that a report be submitted to you and your governing board for inclusion at a regularly scheduled November board meeting. It is the legal obligation of the Contra Costa County Superintendent of Schools to provide this information to the Contra Costa County Board of Supervisors. The Williams Case was a class action lawsuit filed in San Francisco County Superior Court in 2000 against the State of California and state education agencies including the California Department of Education. The basis of the lawsuit was that the agencies failed to provide public school students with equal access to instructional materials, safe and decent school facilities, and qualified teachers. Governor Schwarzenegger settled the suit and subsequent legislation charges County Superintendents of Schools with conducting audits of schools with Academic Performance Index ratings in deciles 1, 2, and 3 according to data from 2006. The audit team has the responsibility of meeting with school officials and reporting information. The intention is to identify areas of need and to use the funds from the Williams Settlement to address these needs. The enclosed report presents data from those visitations in Contra Costa County that took place in Fall 2008.Teams from the Contra Costa County Office of Education visited classrooms in order to count books and check the physical condition of the schools;in addition, the CCCOE reviewed teacher credentials. Sincerely ISurintenodent A. vick,Ed.D. of Schools Contra Costa County Required Areas for Williams Review California Education Code Section 1240 requires teams from the County Office of Education to visit schools identified as Williams Schools, review information in the areas noted below, and report to the District Board, the County Board of Education and the County Board of Supervisors the results of those visits and reviews. The purpose of the visit(s) as specified in California Education Code 1240 is to: 1. Determine if students have "sufficient" standards-aligned instructional materials in four core subject areas (English language arts, mathematics, history/social science and science),including science laboratory equipment in grades 9-12, and, as appropriate,in foreign languages,and health; 2. Determine if there is any facility condition that"poses an emergency or urgent threat to the health or safety of pupils or staff"; and 3. Determine if the school has provided accurate data on the annual school accountability report card related to the sufficiency of instructional materials and the safety, cleanliness, and adequacy of school facilities,including"good repair." The law further requires that the Superintendent of Schools office annually monitor and review teacher misassignments and teacher vacancies in schools ranked in deciles 1-3 (2006 Base API). Following are some basic terms to understand the basis of the report: • "Sufficient textbooks or instructional materials" means each pupil, including English language learners, has a standards-aligned textbook, or instructional materials, or both, adopted by the district's Board for use in class and at home. i • A school facility condition that poses an "emergency or urgent threat"is a "condition that poses a threat to the health or safety of pupils or staff while at school." • "Good Repair" means the school facilities are clean, safe and functional as determined pursuant to the school facility inspection and evaluation instrument developed by the Office of Public School Construction or a local evaluation instrument that meets the same criteria. Each school district that receives state funding for facilities maintenance is required to establish a facilities inspection system to ensure that each of its schools is maintained in "good repair." The playground surface continues to be of concern with significant cracks and lifting that constitute potential trip hazards, as noted in early FIT reports. Williams VIS'11 Keport 1 School: Turner Elementary Visit Date: 9/3/08 Facility Notes: 1. Interior Surfaces: a. Two ceiling tiles in P4 were stained 2. Electrical: a. Cover missing from light in the serving line of the cafeteria 3. Restrooms: a. Primary Boy's bathroom and Intermediate Boy's bathroom each had one broken urinal. Urinals were covered so they would would not be used by students. Replacements were on order. 4. Playground/School Grounds: a. Several small cracks in the cement near A were noted, but these had been identified and marked with red spray paint for repair. 5. Overall Cleanliness a.
