All costs associated with this action are being assumed by Central Contra Costa Sanitary District Funds (100%). REASONS FOR RECOMMENDATIONS AND BACKGROUND: Central Contra Costa Sanitary District has taken the initial steps toward formation of five assessment districts: • Alhambra Valley Assessment District No. 2007-1 (AVAD No. 2007-1) • Alhambra Valley Assessment District No. 2007-2 (AVAD No. 2007-2) • Alhambra Valley Assessment District No. 2007-4 (AVAD No. 2007-4) • Alhambra Valley Assessment District No. 2007-6 (AVAD No. 2007-6) • Alhambra Valley Assessment District No. 2008-7 (AVAD No. 2008-7) Owners in the Alhambra Valley are interested in the formation of these assessment districts for the purpose of extending sewer service to their properties. These five AVADs would be created by CCCSD which would be responsible for constructing the new sewer as well as levying, collecting, and enforcement of the assessments to cover the costs of engineering and construction. Construction of these 11,740 linear feet of sanitary sewer will be a benefit to Contra Costa County and its residents. Central Contra Costa Sanitary District has adopted five resolutions requesting Consent to Conduct Assessment Proceedings for Alhambra Valley Assessment Districts: • AVAD No. 2007-1, Resolution No. 2007-182 • AVAD No. 2007-2, Resolution No. 2007-185 • AVAD No. 2007-4, Resolution No. 2007-197 • AVAD No. 2007-6, Resolution No. 2007-200 • AVAD No. 2008-7, Resolution No. 2008-018 Consent of Contra Costa County through the Board of Supervisors is required in order for the formation of the proposed assessment districts to proceed. CONSEOUENCES OF NEGATIVE ACTION: Consent by the Board of Supervisors is required in order for the formation of the proposed assessment districts to proceed. Without Board consent, CCCSD will not be able to form the proposed assessment districts and ultimately fund sewer service to the properties. (Central Contra Costa Sanitary District Funds) (District II) The Board of Supervisors of the County of Contra Costa resolves: Central Contra Costa Sanitary District has submitted, to this Board of Supervisors, five Resolutions of Intention to order improvements and levy contractual assessments within five assessment districts: • Alhambra Valley Assessment District No. 2007-1 (AVAD No. 2007-1) • Alhambra Valley Assessment District No. 2007-2 (AVAD No. 2007-2) • Alhambra Valley Assessment District No. 2007-4 (AVAD No. 2007-4) • Alhambra Valley Assessment District No. 2007-6 (AVAD No. 2007-6) • Alhambra Valley Assessment District No. 2008-7 (AVAD No. 2008-7) together with adopted boundary maps of the proposed Assessment District. All of the land to be assessed lies within the territory of this County of Contra Costa. This Board of Supervisors consents to the assumption of jurisdiction by the Central Contra Costa Sanitary District, with the understanding that the Board of Directors of the Central Contra Costa Sanitary District may hereafter take each and every step required for or suitable for consummation of the work and levying, collecting, and enforcement of the assessment to cover expenses thereof. Boehme Secretary of the District �Ex k ; b ; r Z RESOLUTION NO. 2007- 180 RESOLUTION OF INTENTION TO CREATE TRUNK SEWER ALHAMBRA VALLEY ASSESSMENT DISTRICT NO. 2007-1 FOR THE PURPOSE OF INSTALLING SEWER IMPROVEMENTS WHEREAS the public health and the environment would be best protected by the expansion of the public sewer system; WHEREAS the construction and installation of a sanitary sewer pipeline, together with appurtenant work and facilities, in areas not presently connected to the sewer system would facilitate the elimination of potential public health problems due to failing septic systems; and WHEREAS it would be convenient and advantageous to establish a boundary around an area within which the District and property owners may enter into contractual assessments and make arrangements to finance public improvements to parcels which are developed and where the costs and time delays involved in creating an assessment district pursuant to alternative provisions in the law would be prohibitively large relative to the cost of the improvement. THEREFORE, the Board of Directors of the Central Contra Costa Sanitary District resolves: 1. This Board intends to approve the following improvement under the authority of the Municipal Improvement Act of 1911, as amended, to wit: Construction and installation of approximately 6,050 linear feet of sanitary sewer line, together with appurtenant work and facilities located at Alhambra Valley Road, Monteira Lane, Quail Hollow, Sheridan Lane, Strentzel Lane, and Wanda Way in unincorporated Martinez, California. 2. This Board finds that the parcels within the Alhambra Valley Assessment District are shown within the boundaries of the map entitled, "Proposed Boundary of Trunk Sewer AVAD No. 2007-1." 3. This Board intends to levy a special assessment upon participating parcels within the described district in accordance with the special benefit to be received by each parcel of land, respectively, from the improvement. The improvement proposed will not confer any special benefit upon any publicly owned land. Hence, there shall be omitted from special assessment all public streets, alleys, and places and all land belonging to the United States, the State of California, the County of Contra Costa, and Central Contra Costa Sanitary District now in use in the performance of a public function. 4. This District will provide loan financing for the improvements to be repaid by assessments on the property of participating parcel owners. Assessments shall be paid over a maximum period of fifteen (15) years with interest at a rate to be fixed by the District. Ex h: b; -r .Z 5. The procedure for the collection of assessments will be the placement of assessments on participating parcel owners' tax bills. The first assessments will be placed on owners' tax bills in fiscal year 2008-2009. 6. This Board appoints Curtis Swanson, Environmental Services Division Manager, to prepare the report required by Section 5898.22 of the Streets and Highways Code. 7. A public hearing shall be held on this matter on February 21, 2008 at the District offices, 5019 Imhoff Place, Martinez. This date is tentative and may be modified in the future. 8. At its September 1, 2005 meeting, the District Board of Directors approved the Alhambra Valley Trunk Sewer Project. Subsequently, a Notice of Determination was filed in compliance with the California Environmental Quality Act (CEQA). The Board independently finds that this project is-exempt from the California Environmental Quality Act (CEQA) under District CEQA Guidelines Section 5.2(b)(3), since it can be "seen with certainty that there is no possibility that the activity in question may have a significant effect on the environment." This certainty is based on the District's past experience with numerous sewer construction projects of this nature, the relatively short distance involved, and the District's mitigating construction specifications that would be required of the project.
