SUBJECT: State Sudden Oak Death (SOD) Contract for FY 2008-09
SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION

RECOMMENDATION(S):
AUTHORIZE the Agricultural Commissioner or his designee, to sign an agreement with
the California Department of Food and Agriculture (CDFA). Agreement No. 08-0500
proposes to reimburse the County $55,992.24 for providing regulatory enforcement
activities. The contract is effective July 1, 2008 through June 30, 2009.
FISCALIMPACT:
This agreement provides revenue and will not result in an increase in net county

cosor negatively impact the Department budget.
BACKGROUND:
The California Department of;Food and Agriculture is the lead agency for a Multi-
Agency Task Force, known as the California Oak Mortality Task Force (COMTF),
which was formed to develop a coordinated effort to address what is called Sudden
Oak Death. Due to CDFA's responsibilities under the COMTF and its statutory
authority to establish quarantines, CDFA must enter an agreement with the
impacted county in order to comply with the requirements of AB 62 (Midgen).
The role of the County Department of Agriculture is to perform regulatory inspection
activities, to issue compliance agreements, and to do related survey work that will
assure that affected businesses including nurseries, firewood dealers, tree services,
green waste and compost facilities, etc., are in compliance with CDFA's Oak
Mortality Disease Control Regulations. The California Department of Food and
Agriculture reimburses the County for all costs involved in this program.
CONSEQUENCE OF NEGATIVE ACTION:
Negative action will result in the Department's failure to meet the terms of
Standard Agreement 08- 0500 resulting in the loss of the resulting program
and revenue. This may also result in harm to the State of California and to
Contra Costa County throughthe potential artificial spread of SOD in the
State. This organism causes"substantial damage to agriculture and our
environment.
