RUPF, Sheriff-Coroner Costa DATE: OCTOBER 10, 2008 --- County .-coa � SUBJECT: APPROVE and AUTHORIZE the Sheriff-Coroner, or designee,to execute an interagency agreement with the City and County of San Francisco for the distribution of fiscal year 2007 Super Urban Area Security Initiative (SUASI) funds. SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION RECOMMENDATIONS) APPROVE and AUTHORIZE the Sheriff-Coroner, or designee, to execute an interagency agreement with the City and County of San Francisco, as fiscal agent, for the fiscal year 2007 Super Urban Area Security Initiative (SUASI) grant in an amount not to exceed $1,271,041'for communication interoperability and homeland security related expenditures, including the full indemnification of the City and County of San Francisco against any claims arising out of the performance of this contract, for the period October 12, 2007 through September 30, 2009. FISCAL IMPACT No County Costs. Revenue; 100%US Department of Homeland Security Super Urban Area Security Initiative (SUASI) grant funding through the City and County of San Francisco, the grant fiscal agent. Urban Area Security Initiative Grant Program (UASI) funds address the unique planning, equipment, training, and exercise needs of high threat, high density urban areas, and assist them in building an enhanced and sustainable capacity to prevent,protect against, respond to, and recover from acts of terrorism. California is home to five of these urban areas and the Bay Area UASI, for which the City and County of San Francisco is the fiscal agent, has received a total of$28,320,000. The Office of the Sheriff has been participating with the other nine Bay Area counties, the cities of San Francisco, Oakland and San Jose, and with the State of California Office of Emergency Services Region 1I as part of the Bay Area SUASI. The targeted SUASI homeland security funding for the County is to develop interoperable communications between the County and other Bay Area SUASI members, and to perform information sharing and collaboration and citizen preparedness. The City and,County of San Francisco uses a standard form contract language with all nine Bay Area UASI partner agencies requiring the full indemnification of the City and County of San Francisco. The indemnification clause holds the County responsible for costs, which shall include "...reasonable attorney's fees, consultants and experts and related costs and San Francisco's costs of investigating any claims against San Francisco." Risk Management has reviewed the contract and is comfortable with the indemnification clause in the contract since the City and County of San Francisco is acting solely as a fiscal agent for this funding. CONSEQUENCES OF NEGATIVE ACTIONS Should the Board choose not to take action on this item, the County will lose its share of 2007 SUASI grant funding. This funding will be used primarily to fund communication interoperability equipment acquisition, training and travel related expenses.
