(District V) Project No. 0676-6P1600 (SCH90030377) SPECIFIC REQUFST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION RECOMMENDED ACTION: APPROVE and AUTHORIZE the conveyance of a Quitclaim Deed to San Marco Properties, LLC, pursuant to Government Code Section 25526.5 and AUTHORIZE the Chair, Board of Supervisors, to execute the Quitclaim Deed on behalf of Contra Costa County. DIRECT the Real Property Division to cause said Quitclaim Deed to be delivered to the Grantee for acceptance and recording. FISCAL IMPACT: There is no impact to the County General Fund. (District V) Project No. 0676-61?1600 (SCH90030377) DATE: October 28, 2008 PAGE: 2 of 2 BACKGROUND AND REASONS FOR RECOMMENDATIONS: In connection with the State Route 4 Willow Pass Grade Widening project, slope easements were required by Final Order of Condemnation on October 13, 1993 in Book 19039 at page 825. Under that Final Order, the slope easements were subject to future adjustment by the parties in order to meet the established finished grades of the San Marco project. The San Marco project has now been graded and a portion of these slope easements are no longer required for highway purposes and can now be quitclaimed back to the underlying fee owner. CONSEQUENCES OF NEGATIVE ACTION: i The County will not be in compliance with the condition established in said Final Order.
