In regards to the claim you submitted on September 22, 2008 on behalf of Grade Tech, Inc.,
portions of the claim are timely and portions are untimely. The portions of the claim prior to September
22, 2007 that you presented against the County of Contra Costa governed by the Board of Supervisors fail
to comply substantially with the requirements of California Government Code Sections 901 and 911.2,
because they were not presented within one year after the event or occurrence as provided by law.
Because the portions of the claim prior to September 22, 2007 were not presented within the time allowed
by law, no action was taken on those portions of your claim. The claim was forkarded to the Board for
action only on the timely portions of the claims.

GradeTech Inc. was contracted with Contra Costa County's Department of Public Works
on June 1, 2007 to perform work on Reliez Valley Road Pedestrian Path County Project No.
0662-6R4286-05. GradeTech received the notice to proceed on June 13`h,2007 which set forth
the first chargeable working day on June 18, 2007. The following utilities were to be relocated
by'May 2007 (Per Contract Specification 10-1.04 Obstructions)to allow GradeTech access to the
contracted work.
EBMUD Water Main& 3'x5' Vault- Relocation Completed on 11/02/2007
PG&E 4" Steel Gas Main—Relocation completed on 8/02/2007
PG&E/Comcast/AT&T Joint Poles—Relocation Completed on 8/15/2007
The County was unable to have these utilities relocated by May 2007 or by the notice to proceed
date,this resulted in delaying GradeTech's ability to perform the work on schedule. The delay
forced the project into the wet winter months and extended the project from 60 working days for
another 8 months until completion. As such GradeTech incurred additional costs for general
Office Overhead while the project was extended out an additional 8 months. The following is
the amount due to GradeTech for theseadditional costs.

10-1.04 OBSTRUCTIONS
Attention is directed to Section 8-1.10, "Utility and Non-Highway Facilities," and
Section 15, "Existing Highway Facilities," of the Standard Specifications and these
special provisions.
The Contractor shall notify the Engineer and the appropriate regional notification
center for operators of subsurface installations at least 2 working days, but not more than
14 calendar days, prior to performing any excavation or other work close to any
underground pipeline, conduit, duct, wire or other structure. Regional notification

The following utility facilities require relocations to be performed by the utility
before the progress of the contract. These utilities will be relocated by May 2007. The
Contractor shall make arrangements with all other utilities to coordinate their relocation
work during the project. Delays due to utility relocations shall not be a basis for Right of
Way delay by the Contractor.

Water lateral and water meter concrete box may need to be relocated or adjusted
while the contractor is working on this project. The Contractor shall allow EBMUD
to coordinate their relocation work during the project.

PAYMENT
Full compensation for any coordination and work regarding sewer & water line
conflicts with utility companies shall be considered as included in the contract price paid

Please note Notice of Potential Claim for Right-of-Way delay due to
PG&E's work schedule. PG&E crews are currently working on the
Southern portion of the Gas main relocation on the project and yet to start on
the residential service laterals. Conversations with their crews have
informed us that the existing Gas main will not be depressurized/taken out of
service until the new line is in service and all the residential services are
connected. Their crews anticipate this taken them through the month of July
2007. Until the existing Gas Main is taken out of Service GradeTech Inc.
can not start on the retaining walls which are the controlling item of work.

EBMtJD will start relocating the water meters on 7/9/7 but will not be
relocating the laterals from the proposed storm system and this is anticipated to
result in delays and additional cost when water laterals are found to conflict with
the location of the new storm system.
Please note Notice of Potential Claim for Right-of-Way delay due to
PG&E's work schedule. PG&P: crews are currently clear of the new storm syste►n
from STA 125+40 to STA 130+70 but still need to complete the gas main
relocation form STA H 2+14.3 to STA 125+ D �-'._Ll�!v V\a—v �i�.

"sl Bay MUD water meters and service:laterals are in conflict with and delaying the proposed storm system. GradcTcch hus pot
holed and found conflict with the Water Service laterals in the proposed Storm Drain Pipe grade and requested that fill MUD lower
laterals while relocating water meters to allow for installation of the new storm drain pipe. As or 7/17/7 only one water meter had
been relocated and no laterals lowered. Per specification section 10-4.04 OBSTRUCTIONS,Uradc'rcch is to allow 1 13MUD to
Coordinate their relocation work during the project. Grade'rech feels it has allowed this period to take place and prior to our starting
the proposed storm.system. EB MI ID will not lower the laterals until they are exposed in the new storm drain(reach. This will
result in down time and loss ol'produc:lion while crews are on%land by time while waiting on ER MUD crews to carne on site anti
remedy conflicts and repair laterals broken during excavation. Cost and l ime impacts are yet to be determined but will include Down
Time for crews slid loss of production while awaiting IMMUD to repair and/or lower conflicting laterals that should be remedied

�� 113MUD will start relocating the water meters on 7/9/7 but will not be
relocating the laterals from the proposed storm system and this is anticipated to
result in delays and additional cost when water laterals are found to conflict with
�r the location of the new storm system.

PG&E's work schedule. PG&E crews are currently clear ofthe new storm system
from STA 125+-40 to STA 130+70 but still need to complete the gas main
relocation form STA 112+14.3 to STA 125+40.
PG&E is currently at least two weeks out from relocating the joint poles
which is delaying the work on the retaining walls.
Until the existing Gas Main is taken out of Service and poles relocated
GradeTech Inc. can not start on the retaining walls which are the controlling item
of work.
