Recommended Action: C9 AUTHORIZE the Director of Airports, or designee, to NEGOTIATE long-term ground lease and development terms between the County,as Landlord,and Holiday AirTours the party that has submitted an aviation development proposal of approximately 3 acres of land on the west side of the Byron Airport. II. FINANCIAL IMPACT: There is no negative impact on the General Fund. County Administrator Auditor-Controller Community Development By Deputy Federal Aviation Administration SUBJECT: Approve Negotiation of Ground Lease Terms with Holiday AirTours, Byron Airport DATE: October 14, 2008 PAGE 2 III. REASONS FOR RECOMMENDATION/BACKGROUND: The Byron aviation development is approximately 3 acres of land owned by the County and located on the westerly side of the Byron Airport(see attached map). The site is proximate to the Byron runways,adjacent to other aviation uses and designated for aviation uses on the Byron Master Plan. The parcel is under the jurisdiction of the Byron Airport and entirely within the unincorporated County. The County circulated a Request for Proposals in July 2007 with a response deadline of January 10, 2008. One proposal was submitted that was not fully responsive to the solicitation. The proposer was given additional time to provide the added detail but decided to forgo the opportunity due to the shifting economic climate. In August 2008, the Contra Costa County Public Works—Airports Division received a letter of interest to develop the approximate 3 acres on the subject site. The proposed development concept is for a Fixed Base Operation (FBO) which may include: (1) aircraft sales, leasing and management, (2) flight training, (3)air charter service, (4) aircraft parking, tie-down and hangar space, (5)jet fuel and aviation gas, (6)pilot rest area,weather briefing and flight planning services,and(7)ancillary services(such as food,rental car and the like). In accordance with prior discussions with the Federal Aviation Administration's (FAA) Airports District Office(ADO)regarding development at Byron Airport,the County notified existing commercial tenants at Buchanan Field and Byron Airport to solicit other competitive interest in the property. The County initiated a second development competitive solicitation process that provided a response deadline of September 11, 2008, for all competitive interests in the sites to be submitted to the County Airport Office. The County received no additional letters of interest in developing the subject properties. Negotiation of lease terms would expand economic development activity at the Byron Airport, provide additional revenues to the Airport Enterprise Fund, and allow Contra Costa County to expand aviation related business available at the airport. A business proposal must be consistent with the Airport Master Plan and General Plan for consideration. IV.
