SUBJECT: Approval of Grant Agreement#28-317 with the State of California Department of Fish& Game
SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND JUSTIFICATION
RECOMMENDATION(S):
Approve and authorize the Health Services Director, or his designee (Randy Sawyer), to execute, on behalf
of the.County, Grant Agreement #28-317 (50875016) with the State of California Department of Fish &
Game to pay the County $5,000 for the County's Hazardous Material's participation in the Coast Guard's
Area Contingency Plan (ACP) for the period from July 1, 2008 through June 30, 2009, including agreeing to
indemnify and hold the State harmless for claims arising out of County's performance under this agreement.
FISCAL IMPACT:
Approval of this grant will result in $5,000 from the State of California Department of Fish & Game. No
County match required.
BACKGROUND/REASON(S) FOR RECOMMENDATION(S):
The Lempert-Keen Seastrand Oil Spill Prevention and Response Act was signed into law by the Governor
(Chapter 1248, Statues of 1990, commencing with Section 8670.1 of the Government Code). This
legislation requires that the Office of Spill Prevention and Response (OSPR) be responsible for oil spill
prevention, emergency oil spill response, statewide contingency planning, resource damage assessment, and
resource rehabilitation and restoration, plus review, approve, and report requirements mandated by the
Action. Contra Costa County Health Services Department will work with the Department of Fish & Game,
U. S. Coast Guard, and other local agencies to prepare the Area Oil Spill Contingency Plan ensuring that the
Contra Costa County element is considered through the grant program The primary goal for County
participating in the Coast Guard's Area Planning process is to assist in the update of the Area Contingency
Plan (ACP) participation in oil spill exercises, and to ensure consistency between the Federal, State and
local contingency plans.
Three certified sealed copies of the Board Order should be returned to the Contracts and Grants Unit.
