SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION
RECOMMENDED ACTION:
APPROVE and AUTHORIZE the Public Works Director,or designee,on behalf of Contra Costa County(County),
and the Redevelopment Director, on behalf of the Contra Costa County Redevelopment Agency (Agency), to
execute a Memorandum Of Understanding between the County,Agency and Central Contra Costa Sanitary District
(District) that details the process for and intent of the Parties with respect to amending certain sewer easements
located in the Iron Horse Corridor(IHC).

REASONS FOR RECOMMENDATIONS AND BACKGROUND:
In 1986, the County purchased the IHC from Southern Pacific Railroad (SPRR) with monetary help from the
District. In exchange for receiving the funds from the District,the County and the Agency granted easements to the
District,which had only had lease agreements with SPRR. Each easement states that the location specified therein
was based on the best information available at the time of execution,and allows the parties to amend the easements
upon determination of a more precise location of existing or proposed facilities.
To ensure a common understanding between the District,County,and Agency,the parties have agreed to enter into
a Memorandum of Understanding (MOU) that details the process of amending the easements to provide more
precise legal descriptions. In addition,under the MOU,the District will quitclaim the easement granted to it in 2003
by the County and, in exchange, the County will grant a new easement to the District.
In December of 1986, the Board of Supervisors determined that the sale of easements to Central Contra Costa
Sanitary District was exempt from the California Environmental Quality Act under State CEQA Guidelines, Section
15112.
CONSEQUENCES OF NEGATIVE ACTION:
The process for amending the easements and the roles of each party in that process would be less clear.
