FISCAL IMPACT:
CCTA will pay the actual costs for Real Property staff right of way services.
REASONS FOR RECOMMENDATIONS AND BACKGROUND:
CCTA requires a variety of right of way services but has no right of way staff and has contracted with the County for
these services. On June 21, 2006 the Board approved the original agreement No. 208 for the State Route 4 East
Widening Somersville Road to State Route 160 project for right of way acquisition services for Segments 1 and 2.
The parties now wish to modify the scope of services to include additional right of way acquisition services for
Segment 3 of the project and increase the total payment limit of the Agreement.
CONSEQUENCES OF NEGATIVE ACTION:
CCTA would not be able to contract for the County's right of way services.

WHEREAS,the Contra Costa Transportation Authority and Contra Costa County entered into
Agreement No. 208 on June 21, 2006; and
WHEREAS, at that time the Authority envisaged only an interim median widening for Segment 3 of
the project; and
WHEREAS,the Authority is now proceeding with final design and right-of-way acquisition for an
ultimate facility in Segment 3 of the project; and
WHEREAS,the parties now wish to modify the scope of services to include additional right of way
acquisition services for Segment 3 of the project and increase the total payment limit of the Agreement;
now therefore be it
MUTUALLY AGREED:
(1) that Item 4 of the Agreement is amended to increase the total amount by $1,428,000 for a
new total of$2,853,000; and
(2) all other items and conditions of the Agreement shall remain in effect.
In witness whereof, the parties hereto have executed this Amendment 1 to Agreement No. 208 effective
as of the 281h day of November 2007.

Dear Mr. Maxwell:
In June 2006, Contract 208 was approved authorizing Contra Costa County Public Works Real Property Division
(County), to provide various right of way services to the Contra Costa Transportation Authority (CCTA) for the
SR4(e) Widening Project - Somersville Road to 160. The contract covered the acquisition of approximately 40
properties in the Somersville Road to Lone Tree Way/A Street area, in an amount not-to-exceed $1,425,000.
Subsequent to that contract CCTA has requested the County to provide right of way services for the remainder
of the project, Lone Tree Way/A Street to SR4 160 (Segment 3). Segment 3 impacts an additional 60+
properties. On August 13, 2007 County received written authorization from Caltrans to perform the right of
way activities for Segment 3.
Enclosed for your review and approval are the cost estimate and work plan for Segment 3. County is
requesting CCTA to amend contract 208 to include Segment 3 and allocate an additional $1,428,000 for right
of way services, for a total contract amount not-to-exceed $2,853,000.
This project will require the involvement of several members of the Real Property staff. As the Principal Real
Property Agent, I will be designated as project manager for right of way services. I am supported by trained
staff members who will assist me, and, in some cases, lead all necessary right of way activities. The work plan
and cost estimate assume having to obtain a Resolution of Necessity and Order of Possession on
approximately one-third of the 60 property owners. If properties proceed to trial, we may need to amend our
contract to cover the time and effort associated with an eminent domain trial.

RIGHT OF WAY WORK PLAN
SR 4 SOMMERSVILLE TO 160
SEGMENT 3
1. Administration (RPA) — The general project management of right of way. These services will be
performed by County Real Property staff and include:
a) Developing and monitoring right of way project schedule;
b) Obtaining and reviewing title reports;
c) Working with design team to develop property rights needs;
d) Attending regularly scheduled trend/staff meetings;
e) Attending and making presentations at public meetings, if necessary;
f) Soliciting consultants for appraisal and relocation services. Because of the business impacts, it is
likely that, in addition to a real estate appraiser, we will need a goodwill appraiser and furniture,
fixtures and equipment appraiser;
g) Selecting consultants, administer contracts and process payments.
h) Setting up individual acquisition files for each parcel;
i) Investigating ownerships, easements and title concerns;
j) Assisting in the preparation of R/W Certifications for submittal to Caltrans;
k) Processing tax bill payments;
1) Providing status reports; and
m) Transfer to state.
2. Valuation (RPV) — The preparation and review of appraisals for approximately 60 parcels held under
approximately 50 different ownerships. The appraisals will be in conformance with state standards. A
combination of Real Property staff and consultants (MAI designated appraisers) will be used. Real
Property staff would be assigned the less complex appraisals and some or all of the single family
residential appraisals. In addition to Real Estate appraisers, it may be necessary to hire a Goodwill
appraiser, and possibly Furniture, Fixtures and Equipment (FF&E) appraiser to deal with the impacts on
businesses. These services include:
a) Preparing and mailing Letters of Invitation to appraise;
b) Providing technical information to appraisers;
c) Acting as liaison between appraisers and design/engineering team; and
d) Preparing, reviewing and approving appraisals.
3. Negotiations (RPN) — Real Property staff will do all the acquisitions. Agents will be assigned a varying
number of parcels according to the complexity of the appraisal/acquisition issues. Duties include:
a) Review of title reports, appraisals, legal descriptions, maps and other documents in sufficient detail
in preparation for negotiations;
b) Maintaining a complete acquisition file on each property assigned;
c) Preparing appraisal summary statements, deeds, easements and right of way contracts;
d) Initiating contact with property owner(s) or their representative to present written offer.
Conducting negotiations and following up with property owners as necessary to arrive at a mutually
agreeable settlement;
e) Acting as a liaison with appraisers, relocations consultants and CCTA staff;
f) Utilizing legal counsel where necessary in development of final agreements; and
g) Advising Principal as to necessity of eminent domain action.

4. Condemnation (RPC) — In cases where an eminent domain action is necessary in order to secure the
right of way for project construction Real Property will work with County Counsel to obtain orders of
possession. Real Property has worked closely with County Counsel to expedite this process so that
certification and construction schedules can be met. On parcels where a negotiated settlement cannot be
reached and litigation is expected County Counsel will contract with outside counsel for legal services.
Real Property duties include:
a) Identifying and locating all parties to the action;
b) Adoption of Resolution of Necessity by County Board of Supervisors;
c) Preparing condemnation packages and exhibits for County Counsel; and
d) Service of Order for Immediate Possession to all parties
e) Provide all services necessary to support County and outside legal counsel in eminent domain
actions.
5. Relocation (RPR) — It appears that there are approximately 14 sfr/mfr units which will require relocation
assistance. To complete these relocations, Real Property will secure the services of a relocation
consultant to provide relocation services to the displaced businesses and tenants. Services will include:
a) Reviewing and approving the relocation impact study;
b) Reviewing and approving all relocation claims;
c) Processing claims for payment;
d) Providing oversight and input to consultant; and
e) Acting as liaison between consultant and CCTA staff.
6. Demolition (RPD) — If requested, Real Property would secure the services of a demolition contractor
and hazardous material consultants for the removal of structures and potential remedial clean up of those
sites. This work would include:
a) Preparation of a scope of work for demolition;
b) Preparation of a scope of work for hazardous material clean up;
c) Solicitation of bids;
d) Awarding contracts and obtain necessary documents and approvals;
e) Coordinating with utilities for disconnections; Processing payments; and
f) Working with field representative designated by CCTA for contract compliance and completion.
7. Property Management (RPM) — Property management issues arise on parcels that are owned or under
possession of the public agency. Real Property has at its disposal the Maintenance Division, General
Services department and contractors to promptly respond to the various issues that arise. The most
common items are:
a) Security of buildings prior to demolition;
b) Removal of illegal dumping on sites;
c) Weed abatement; and
d) Payment and cancellation of taxes.
8. Surplus (RPS) - Portions of properties not needed for the transfer to the State may be viable for
disposal as surplus to generate income for the Authority. We are able to provide the services for the
disposal of property by various scenarios including public auction, direct sale to private individual, direct
sale to public agency, and exchange. The initial review indicates that there may be portions of 2-4 parcels
that could be considered surplus.

Summary of Issues In June 2006, the Authority entered into Agreement No. 208 with Contra
Costa County Public Works Real Property Division to provide right of way
acquisition services for Segments 1 and 2 of the SR 4 (e) Somersville Road
to SR 160 Project,which covered only the western portion of the project
from Somersville Road to A Street. However, sufficient funds have now
been identified to proceed with design of the ultimate facility in Segment 3.
Therefore, the agreement with the County needs to be amended to provide
additional acquisition services for the entire project.
Recommendations Staff recommends that the Authority authorize the Chair to execute
Amendment No. 1 to Agreement No. 208 with Contra Costa County to
increase the budget by $1,428,000 for a new not-to-exceed amount of
$2,853,000.
Financial Implications Sufficient funding for this agreement is included in the Measure C and
Measure J Strategic Plans.
Options The Authority could decide to not amend the agreement to include Segment
3, however, this could delay the delivery of this widening project.

Background
In June 2006, the Authority entered into Agreement No. 208 with Contra Costa County to provide right of
way acquisition services for Segments 1 and 2 of the SR 4 (e) Somersville Road to Route 160 Widening
Project. At that time, the Authority was proceeding with an interim median widening for Segment 3, (A
Street to Route 160) which did not require any right of way acquisition. However, with the successful
receipt of an additional $85 M from the CMIA program,the Authority is now proceeding with final
design of the ultimate configuration of Segment 3 as envisioned in the project's Environmental
Document. Therefore, staff seeks authorization to amend the County's agreement to cover the additional
services needed to acquire the necessary right of way in Segment 3.
The original agreement covered services for approximately 40 affected parcels in Segments 1 and 2, for
an estimated budget of$1,425,000. Amendment 1 includes services for an additional approximately 60
affected parcels in Segment 3, for an estimated additional budget of$1,428,000. Therefore,the requested
new not-to-exceed amount is $2,853,000.

It should be noted that since the Authority entered into Agreement No. 208, a significant change to
include a wider median for future transit has been adopted. This change affects the number of parcels on
this project. Staff has reviewed the estimated level of effort needed for the entire project with County
staff and believe the new requested not-to-exceed amount will be sufficient for the staff services to
acquire all affected parcels. However, consistent with the scope of work for the original agreement, the
budget assumes that acquisitions will occur through negotiated settlements or through a Resolution of
Necessity and subsequent Order of Possession. Should any properties proceed to trial, a subsequent
amendment to this agreement would be necessary. Furthermore, work associated with project close-out
activities and to transfer to the State is not included in the current scope-of-work:

e) Acting as liaison between consultant and CCTA staff.
6. Demolition (RPD) — If requested, Real Property would secure the services of a demolition contractor
and hazardous material consultants for the removal of structures and potential remedial clean up of those
sites. This work would include:
a) Preparation of a scope of work for demolition;
b) Preparation of a scope of work for hazardous material clean up;
c) Solicitation of bids;
d) Awarding contracts and obtain necessary documents and approvals;
e) Coordinating with utilities for disconnections; Processing payments; and
Q Working with field representative designated by CCTA for contract compliance and completion.
7. Property Management (RPM) — Property management issues arise on parcels that are owned or under
possession of the public agency. Real Property has at its disposal the Maintenance Division, General
Services department and contractors to promptly respond to the various issues that arise. The most
common items are:
a) Security of buildings prior to demolition;
b) Removal of illegal dumping on sites;
c) Weed abatement; and
d) Payment and cancellation of taxes.
8. Surplus (RPS) - Portions of properties not needed for the transfer to the State may be viable for
disposal as surplus to generate income for the Authority. We are able to provide the services for the
disposal of property by various scenarios including public auction, direct sale to private individual, direct
sale to public agency, and exchange. The initial review indicates that there may be portions of 2-4 parcels
that could be considered surplus.

Contra Costa County for Right of Way Acquisition Services
Summary of Issues In June 2006, the Authority entered into Agreement No. 208 with Contra
Costa County Public Works Real Property Division to provide right of way
acquisition services for Segments 1 and 2 of the SR 4 (e) Somersville Road
to SR 160 Project, which covered only the western portion of the project
from Somersville Road to A Street. However, sufficient funds have now
been identified to proceed with design of the ultimate facility in Segment 3.
Therefore, the agreement with the County needs to be amended to provide
additional acquisition services for the entire project.
Recommendations Staff recommends that the Authority authorize the Chair to execute
Amendment No. 1 to Agreement No. 208 with Contra Costa County to
increase the budget by $1,428,000 for a new not-to-exceed amount of
$2,853,000.
Financial Implications Sufficient funding for this agreement is included in the Measure C and
Measure J Strategic Plans.
Options The Authority could decide to not amend the agreement to include Segment
3, however, this could delay the delivery of this widening project.

Background
In June 2006, the Authority entered into Agreement No. 208 with Contra Costa County to provide right of
way acquisition services for Segments 1 and 2 of the SR 4 (e) Somersville Road to Route 160 Widening
Project. At that time, the Authority was proceeding with an interim median widening for Segment 3, (A
Street to Route 160)which did not require any right of way acquisition. However,with the successful
receipt of an additional $85 M from the CMIA program, the Authority is now proceeding with final
design of the ultimate configuration of Segment 3 as envisioned in the project's Environmental
Document. Therefore, staff seeks authorization to amend the County's agreement to cover the additional
services needed to acquire the necessary right of way in Segment 3.
The original agreement covered services for approximately 40 affected parcels in Segments 1 and 2, for
an estimated budget of$1,425,000. Amendment 1 includes services for an additional approximately 60
affected parcels in Segment 3, for an estimated additional budget of$1,428,000. Therefore, the requested
new not-to-exceed amount is$2,853,000.

It should be noted that since the Authority entered into Agreement No. 208,a significant change to
include a wider median for future transit has been adopted. This change affects the number of parcels on
this project. Staff has reviewed the estimated level of effort needed for the entire project with County
staff and believe the new requested not-to-exceed amount will be sufficient for the staff services to
acquire all affected parcels. However, consistent with the scope of work for the original agreement, the
budget assumes that acquisitions will occur through negotiated settlements or through a Resolution of
Necessity and subsequent Order of Possession. Should any properties proceed to trial, a subsequent
amendment to this agreement would be necessary. Furthermore, work associated with project close-out
activities and to transfer to the State is not included in the current scope-of-work.
