SPECIFIC REQUEST(S)OR RECOMMENDATIONS)&BACKGROUND AND JUSTIFICATION
RECOMMENDED ACTION:
APPROVE the Port Costa Treatment Facilities Upgrades Project contingency fund increase of$120,000.00
for a new total of $460,000.00 effective January 8, 2008, and APPROVE and AUTHORIZE the Public
Works Director, or designee, to execute Contract Change Order No. 3, in an amount not to exceed
$54,000.00, and Contract Change Order No. 1 - Supplement No. 1, in an amount not to exceed
$84,174.30, with Valentine Corporation, effective January 8, 2008, to a new payment limit of
$855,195.90 for extra work that was not included in the original plans and specifications.
FISCAL IMPACT:
The Project contingency funds are currently insufficient to cover the increased cost. The increase in
contingency funds will be funded by the 100% Sanitary District 5 Funds.

REASONS FOR RECOMMENDATIONS AND BACKGROUND:
The Regional Water Quality Control Board (RWQCB) has mandated repairs to the SD 5 sewage treatment
facility in Port Costa to improve the quality of effluent into the Carquinez Strait. The original Time
Schedule Order(TSO) imposed by the RWQCB, eleven tasks were required to be completed by November
30, 2007. Three of these tasks involve the filter beds. The filter bed structures themselves require
rehabilitation, but also the media in the beds (sand and gravel) needs to be hauled away and
replacement media brought in and installed.
The original bid documents included work that would address all eleven tasks required by the RWQCB.
However, in October 2006 only one bid was received and it was $524,000 over budget. Bid analysis
revealed that most of the higher costs were attributed to the filter work. The contractor included unit
costs for hauling the sand and gravel in and out of Post Costa that were several times greater than the
engineer's estimate. Difficult access across a busy mainline railroad also makes this a challenging project
and therefore increases the cost of that item.
There were no additional funds available at that time to fund the additional expense. The decision was
then made by Public Works to re-bid the project without the filter bed work. Perhaps by splitting up the
work, more and better bids could be obtained for the remaining work which was electrical and
mechanical in nature.
Under the new bid structure, the project attracted additional bidders and a contract was awarded on
February 13, 2007. Even with the filter work removed, the bid was still $109,000 over the engineer's
estimate. Public Works staff considered various ways to complete the filter work left out of the contract.
One possibility identified was to include this work under existing Public Works maintenance contracts,
which include material hauling.
After reviewing all the possibilities, it was determined that we include the filter bed work into the original
contract with Valentine Corporation with Contract Change Order (CCO) #1 in July. During the
construction of the beds, it was discovered the filter bed media quantity was insufficient for the plant to
operate properly, so additional media was placed. This resulted in an amendment to CCO #1,
Supplement #1, in the amount of $84,174.30. Also, during construction problems arose on Erskine
Street and CCO #3 was written and approved to authorize the construction to replace 200 linear feet of
6-inch sewer. The existing sewer line was failing and resulted in raw sewage backing up into the street.
A separate crew from the contractor was mobilized and the problems were repaired quickly.
The Public Works Director reports that said work has been inspected and complies with the approved
plans, special provisions and standard specifications and recommends its acceptance as complete as of
December 5, 2007.
CONSEQUENCES OF NEGATIVE ACTION:
The contractor will not be paid.
