BACKGROUND/REASONS FOR RECOMMENDATION
On December 18, 2007 the Board of Supervisors conducted a public hearing for a General
Plan Amendment relating to the Affinito Property - Portofino Townhouse Project in the
unincorporated community of Bay Point (County File:GP#05-0001). The Board closed the
public hearing and adopted Resolution No. 2007/703 approving related applications for the
Affinito Property — Portofino Townhouse Project, including the General Plan Amendment
(County File: GP#05-0001) and applications for rezoning and development plan for said
property (County Files: RZ#05-3173 and DP#05-3102).
In approving the project, the Board designated that the Affinito Property- Portofino Townhouse
Project General Plan Amendment(County File: GP#05-001)as the First Consolidated General
Plan Amendment for Calendar Year 2008. Attached to this report is Board Resolution No.
2008/53 which consolidates the Affinito Property- Portofino Townhouse Project General Plan
Amendment as the First Amendment to the General Plan for the current calendar year as
allowed under State Planning Law.

The Board of Supervisors of Contra Costa County RESOLVES that:
Part I - General. Contra Costa County is carrying out a program to systematically
review the County General Plan for the purposes of keeping the Plan current and
maintaining consistency the County's development ordinance. California Planning and
Zoning Law provide that the mandatory elements to a jurisdiction's General Plan can only
be amended four times in a Calendar Year.
The Board has considered the proposal described in Part II below to amend the County
General Plan at a public hearing on December 18, 2007, and after the close of said
hearing declared its intent and directed staff to prepare this resolution for adoption. The
Board therefore declares that adoption action described below constitutes an amendment
to the Land Use Element of the County General Plan in the Calendar Year 2008.
Part II — Affinito Property — Portofino Townhouse Project General Plan
Amendment (County File: GP#05-0001). A copy of Resolution No.17-2007 adopted by
the East County Planning Commission is on file with the Clerk of the Board in which the
Commission sets forth its recommendation to approve the proposed amendment of the
County General Plan for the Affinito Property- Portofino Townhouse Project General Plan
Amendment, County File: GP#05-0001 , as described in the Board's subsequent Resolution
No. 2007/703.
RESOLUTION 2008/53
There is also on file with Clerk of the Board, a Board Order and Resolution No. 2007/703,
both dated December 18, 2007, which constitutes the Board's record of hearing and
decision on the Affinito Property- Portofino Townhouse Project General Plan Amendment,
County File: GP#05-0001 (listed under item DA , December 18, 2007 Board Meeting).
The Board hereby adopts the amendment to the Land Use Element Map of the County
General Plan relating to the Affinito Property— Portofino Townhouse Project General Plan
Amendment, County File: GP#05-0001 , which is specified in Board Resolution No.
2007/703, as the first consolidated amendment to the County General Plan for Calendar
Year 2008. A copy of the map reflecting this amendment to the Land Use Element Map,
which re-designates the subject property to the General Plan designation Multiple Family
Residential — Medium Density (MM), and which is attached to this resolution and on file
with the Clerk of the Board, shall be endorsed-approved by the Clerk.
Part III — CEQA Notice. A Notice of Determination for a Mitigated Negative
Declaration of Environmental Impacts concerning the adoption of this Plan amendment and
related applications was filed with the County Clerk on December 21 , 2007 by the
Community Development Department, as directed by the Board under its Resolution No.
2007/703.
