FIND that the facts set forth below are true. AFFIRM the county abatement officer' s determination in the Notice and Order to Abate by finding that the substandard structure exists including, but not limited to; (a) Inadequate Sanitation (b) Structural Hazards (c) Nuisance (d) Faulty Weather Protection (e) Hazardous or Unsanitary Premises (f) Inadequate Maintenance (g) Inadequate Exits (h) Improper Occupancy The condition on the above-referenced real property is a public nuisance in violation of Contra Cost County Ordinance Code section 74-1.002 and CBC 102 . ORDER the property owners to abate the public nuisance by obtaining the necessary permits to repair the structure to bring it into compliance per the stated Ordinances within seven (7) days of the mailing of the Board decision. Or, VACATE the premises and OBTAIN a demolition permit and remove the entire substandard structure from the property within seven (7) days of the mailing of the Board decision. DIRECT the county abatement officer to remove the Substandard Structure from the property, and charge the cost of the work and all administrative cost to the property owners, if the property owner does not comply with the Board' s order to abate the public nuisance. DIRECT the county abatement officer to send the Board's decision by first class mail to the property owners and to each party appearing at this hearing, and to file the Board's decision with the Clerk of the Board of Supervisor. FISCAL IMPACT: The Cost of the removing the Substandard Structure from the property is estimated to be $25, 000.00. If the county abatement officer performs the work of abatement and the property owner does not pay, the actual cost of the work and all administrative cost may be imposed as a lien on the property after notice and a hearing, and may be collected as an assessment against the property. The above-referenced property is located in an R-6 zoning district. The California Building Code section 102 defines any building or structure constituting a hazard to safety, health or public welfare by reason of inadequate maintenance, dilapidation, obsolescence or fire hazard a building unsafe for use. The county abatement officer made an initial inspection of the above-referenced property on April 12, 2007 . The county abatement officer observed inadequate sanitation, structural hazards, faulty weather protection, hazardous or unsanitary premises, inadequate maintenance and inadequate exits.' Re-inspection of the property on December 12, 2007, showed that the property continued to be in violation of Contra Costa County Ordinance Code section 74-1.002 and CBC 102 . The Notice and Order to Abate was served on the property owners and all known to be in possession of the property by certified mail on January 11, 2008. The Property owners filed an appeal of Notice and Order to Abate on January 18, 2008. Notice of this hearing was sent "to the property owner by certified mail by the Clerk of the Board - see Clerk of the Boards' s mailing confirmation. When we purchased our home, this block used to be the best looking block in the area. During the last 10 years, a few homes have become neglected, especially the house at 1618 Elm Avenue. The county has been called in several times to clear the property of weeds and discarded items at the owner's expense. The house has not had utility service for sometime and the owner cannot live in the home because of the rundown condition. The house is an eyesore and an embarrassment to the neighborhood, as well as lowering our property values. Prior to the last county cleanup, it became a fire hazard when the owner, who lived in his van parked in front of the house, would BBQ in his front yard. Rats have been seen on the property and have been a problem for the homeowners living next door and even at our home. The roof of this house has been damaged when part of it fell in during this past winter. It is our opinion that it would be in the best interest of the neighborhood that this house be torn down.
