Following the Board's February 12 action identifying potential sites for a state-operated community re-entry facility, I was contacted by citizens and fellow elected officials concerned about the potential impacts that a state re-entry facility would have on our communities. Due to the accelerated state application process for local jail construction funds,people were generally not aware that the Board was considering this matter, even in a preliminary way. Due to the absence of public testimony on the matter,the Board was unaware of the strong sentiment of opposition to the placement of a re-entry facility in this County. For this reason,I ask the Board to reconsider its February 12 actions in light of the public concern that has been expressed. ADDENDUM TO D.1 FEBRUARY 26, 2008 On this day, the Board of Supervisors reconsidered February 12, 2008 Board action to advance for state consideration the five parcels identified by staff as potential sites to host a state re-entry facility, and direction to the County Administrator to return to the Board with information on superfund sites as possible re-entry facility sites. Chair Glover stated he requested as the Chair to bring this matter back to the Board, remarking this issue had come before the Board two weeks ago. He indicated not only does he have major concerns with the Antioch site but all sites within the County. He clarified he was not against re-entry facilities because of the need for people to be provided services as they reenter a community, but he strongly emphasized that the sites identified by staff are not traditional re-entry facilities, and explained these facilities would bed up to 500 offenders. He went on to say the Board considered in their last Deliberation that if a site was found, we would have the ability to apply for funds that would allow the County to build onto the facilities that exist today within the County system, and he noted there would still be a need for the County to do this at some time within the future. Supervisor Piepho noted for the record she opposed the Antioch site on February 12, 2008 and reiterated that when the issue of locating a re-entry facility first came before the Board she expressed concern about its closeness to highly populated communities. She said the Board recognizes the need for jail beds but she is not convinced that trading state money for the beds would be worth accepting community impacts that might come with a re-entry facility. She announced copies of the addenda that define the conversations the Board had with the Sheriff and the Sheriff s Department employees could be obtained with the Clerk of the Board's office. Supervisor Gioia said in all the previous discussions, all Board members asked important and thoughtful questions and expressed concerns about how this would move forward. He recalled on February 12, 2008, Board members decided to consider potential sites for a community re-entry facility and keep options open. Supervisor Gioia said he would rather see money used for violence prevention programs as opposed to increasing the number of beds. He went on to say at some point there needs to be discussion about a local state partnership on the re-entry system. He said the Board needs to figure out in the future how to address re-entry.. Supervisor Bonilla said she agrees with the Board and questioned whether the Sheriff had any opinion that he could share as the expert on the County's current jail system, and pointed out the Board relies on the Sheriff for strategic planning of the County jail. She stated the time frame given by the state is not enough time to approach the'community for feedback. She requested a referral to the new Public Safety Committee to discuss overcrowding of the Countyjail, and in the prevention of crime. 1 3 John Cullen, County Administrator, said the Sheriff told the Board two weeks ago that at this point, it is a matter of policy and a financial decision for the Board. Chair Glover said in his role on the Justice Committee of the California State Association of Counties (C SAC) Executive Committee he presents today's action of the,,Board, which will hopefully give an opportunity to have a positive dialogue on how this can be done to minimize impacts on the communities. Supervisor Uilkema said the County needs to explore other options that are available to carry out a long-term goal. She said according to the Sheriff, this problem will not go away, and said she hopes there will remain an interest in the subject. ti Chair Glover called for public comment and the following spoke: ■ Walter Ruehlig, Chair, Antioch Unified School District, said he is opposed to this project, as 4673 students would be affected by the prison facility proposal. Supervisor Gioia noted currently offenders serve their time in state prison and are paroled back to the County they came from. He pointed out the state is trying to move to these models to have offenders transferred in their last nine months to these re-entry facilities in the County. He asked attendees of the Board meeting for suggestions about these re- entry facilities and how re-entry facilities that are community based could.be designed to improve the chance of success. ■ Devi Lanphere, Antioch Chamber of Commerce, agreed with Supervisor Gioia's suggestion to get the stakeholders involved and find out what works,in their community. She told the Board the Antioch Chamber of Commerce opposes considering the Deer Valley site for a 500-bed re-entry facility and said the site does not meet the criteria for many reasons. ■ Michael Hall, Antioch resident, said the issue should have been what is good for the County. He said backpedaling on political issues to clean up the mess made two weeks ago is unacceptable. ■ Gary Gilbert, United Citizens for Better Neighborhoods, noted the'Board of Supervisors has continued to view Antioch as its dumping ground. He told the Board inmates do walk away from these facilities, and then communities and schools go on lock down. ■ Gary Agopian, Antioch Unified School District, (Trustee), said the Antioch Unified School District Board approved a letter to the Board stressing their concern about the proposal to consider the use of a site across the site from the new High School and a mile away from Deer Valley High School and Diablo Vista Elementary School. He informed the Board he was upset at the lack of communication between the School District and the County. 2 ■ Jim Conley, Antioch resident, told the Board he e-mailed a letter opposing the Antioch site. He said the Board has failed the citizens of Antioch and the County by not stepping on the land before a vote went in. He said he finds-it hard to believe in a 5/0 vote one-way at one meeting and a 5/0 vote the opposite way tow weeks later, and emphasized a vote is a vote. Supervisor Gioia clarified the Board had voted to keep options open to get information even though it was viewed that some options did not make sense. He said there should have been a larger debate with stakeholders but the time frame the state presented was not enough. He elaborated the Board needed to look at sites to show due diligence to the state and explained that even if sites would be removed, the state would ask the County if available sites had been looked at under the County standard. ■ Brian Kalinowski, Antioch City Council, asked the Board to place the City of Antioch's resolution into the record for this item. . He asked the Board to direct the County Administrator to bring back options for consideration for citizens in this County to know that the Board takes the concept of day facilities or transitional facilities important and said this would be alibenefit to the County..He said the Antioch City would be happy to be a partner with the Board, adding that Antioch is an unacceptable site. ■ Allen Payton, Antioch resident, told the Board he appreciates the e'omments made by the Board but it is not their comments but the vote that counts. He asked the Board to consider some sites if they need to stay at the table with the state but to remove Antioch or any sites close to schools, churches,,or neighborhoods, and business and employment areas. ■ Janet Kennedy, Martinez City Council, recalled the City of Martinez had sent a letter to the Board expressing their concerns about the two Waterbird Way sites. She informed the Board she appreciates their willingness to look at this further and emphasized the proposed site is located outside the°'Urban Limit line. ■ Greg Manning, Mayor, City of Clayton, informed the Board he wrote a letter to the Board objecting to all the sites chosen for are-entry facility. He pointed out one needs to think not only of the citizens but those who would be incarcerated and returning. He said the City of Clayton Counsel agree with the" recommendation by the Chair. ■ Ralph A. Hernandez, Chair, Citizens for Democracy, told the Board he understood that to consider something proposed is not necessarily.to allow it. He said there are purposeful,political misrepresentations by certain groups who want to use this to discredit Chair Glover in particular. He said Supervisor Gioia made this very clear in the addendum for.the Board Minutes that the decision made is to keep all choices open and on the table, and the Board did not say the County would like to build new beds. 3 Chair Glover said he has been clear since the first vote there would never be a prison built in Antioch and remains opposed to this. He stressed the Board did do "due diligence"by asking people to call, write and to support the action before the Board today. Sheet+ Hank Stratford RESOLUTION NO. 2008/18 'RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANTIOCH OPPOSING THE SITING OF A NEW PRISON FACILITY IN THE CITY OF ANTIOCH WHEREAS,the City Council recently learned, by reading the newspaper, of Contra Costa County's intention to consider siting a prison facility in our community; and WHEREAS, neither elected officials nor city staff were contacted by Contra Costa County representatives, or.by our District Supervisor; and WHEREAS;the facility is located within a mile of the largest high school in the eastern Contra Costa area(with a student population of 3,300),,within a mile of a brand new Kaiser Permanente Hospital facility, across the street from the propsed Dozier- 0Libbey Medical School (with an anticipated population of 750 students), and in the heart of a new residential area to be developed in the community; and' WHEREAS, the proposed location is located in a detention basin; and WHEREAS, the County's own Flood Control District was unaware of the proposal;and WHEREAS, the item was placed on the agenda, considered and app roved by the Board, with no attempt at gaining City input; and WHEREAS, this facility has the potential to create negative impacts on the quality of life for residents of Antioch, Brentwood, and all of Contra Costa County; and WHEREAS, not a single citizen has expressed support for the:concept; and WHEREAS, there are other sites within Contra Costa County more suitable for the location of such a facility: NOW THEREFORE BE IT RESOLVED by the Antioch City Council, we unanimously oppose in the strongest terms the proposed Antioch location for a State prison facility,and that the Council calls on Supervisor Federal Glover to now take the actions necessary, which should have been previously undertaken,to oppose this facility. The 123-acre parcel consists of marshlands that served as a dredge spoils disposal site in the early 1970s. It currently is characterized mostly by wetland habitat: The. site was previously slated for development in the early 1980s, but was deemed infeasible because of the extensive wetlands present on the .site. The site ultimately was sold to a partnership, of the Flood Control District; the Muir Heritage Land Trust, and the East Bay Regional Park District (EBRPD) for the delinquent taxes owned on the property. This., partnership is detailed in a Memorandum of. Understanding (MOU) that was approved by the Board on July 23, 2002. The primary. use of the property, as. stipulated in the MOU, is for wetlands restoration and mitigation. Secondary uses include an educational and interpretive program with the Muir Heritage Land Trust and a staging area for the EBRPD (this property is located at the. confluence of the'Ironhorse Trail and Bay Trail). Any other use of the property would need approval from the Muir Heritage Land Trust and the EBRPD. A copy of the MOU is attached for reference. A restoration plan has been completed for the parcel and is awaiting implementation. Once these 'marshlands and wetlands have been restored, the parcel is intended to be used as mitigation for the upcoming US Army Corps of Engineers Lower Walnut Creek restoration project, which is located on the adjacent parcel. As you may know, in 2002 CCCFCD, Muir Heritage Land Trust(MHLT) and the East Bay Regional Park District (EBRPD) cooperated to purchase that tax-defaulted property using funds from the Trust for Public Lands. The shared goal was the restoration of wetlands and fish/wildlife habitat on the site. According to an MOU executed by the three parties (attached for your information), the primary use of the property is to be restoration to mitigate for impacts to wetlands and other habitat resulting from CCCFCD's planned Walnut Creek Channel project, as required by the regulatory agencies, as well as other future CCCFCD projects. Secondary compatible uses provided for in the MOU include interpretive signage (MHLT ) and trail staging, public education area and a multi-use trail connecting the Iron Horse Trail on the Walnut Creek Channel to the San Francisco Bay Trail at the Benicia Bridge. The MOU further calls for future transfer of property ownership to another entity which will provide long-term maintenance and conservation of the property. The source of funding for the acquisition, along with the terms of the agreement and the intentions of the respective parties, would seem to rule out this site as a viable candidate for construction of a jail. I have had my husband's truck stolen after an escapee hid out 'on my property. I narrowly missed an encounter with a naked escapee that was captured hiding in the creek underbrush.next to my home a year- or two ago. Almost-everyday we listen to the shooting, -at the gun range at the Jail. The sounds from pistols to assalt weapons pepper the air for miles around. We understand the need for this range, and the importance to all the officers who use it. We live with it and,look forward 'to the 10pm curfew! At the Marsh Creek Jail things have been built and enlarged without proper public notice or public input. A few days ago we saw the Heliport sign! When :did `that get approved? _. Over the years we have dealt with escapees from the detention center, noise from the shooting range and the traffic these have. put on our roads. We oppose a future prison due to but not limited to the following reasons: 1) Roads are currently at there capacity for traffic and can not accommodate the increased amount of traffic. a prison would bring. 2) There are no public facities such as sewer, public transit or even hotels. 3) As Licensed Realtors in the state of California I know it to be fact that our property value will decrease if a prison is allowed. Our area is blessed with many (most) million dollar properties. Our small ranches are one of the last places in Contra Costa County where families can still have the country dream just outside of town. Ourdaughter and her family (our 10 month old grandchild) live just a few homes down. We want the quality o.f life for the "new generation" . We feel there are other more appropriate options for a prison such as Richmond or Martinez for examples where there are public facilities such as public transit, public sewer, larger more major roadways and facilities for visitors such as hotels. Please do not put the prison on Marsh Creek Road in Clayton. If the prison does pass we and our family who have enjoyed living here for the past almost 30 years will have to move from the area. County, address, Clayton. We, as 25 year residents of this neighborhood strongly oppose the use of this site for the re-entry facility. The detention farm was here when we purchased our property and has occasionally been problematic, what with escapees and the additon of open air waste treatment ponds. This proposal for a new prison to house more hard-core offenders will present many more issues than the existing farm. There will be the possibility of more septic systems and more open air treatment ponds. There is no public transportation and the already highly impacted use of Marsh Creek Rd. would surely increase. As it is, these rural roads do not get much attention from our county. The possiblity of escape is still present, whether it is a minimum or maximum prison. This is a small community and we can be most vocal when the need arises. We, as long time residents of! this county, strongly urge the board to seek other locations within the county that would be more suitable to this type of facility. We had not been given any written .notice of. this meeting or it's agenda, so time was not possible to attend this meeting.
