BARRY, AICP COMMUNITY DEVELOPMENT DIRECTOR` DATE: February 26, 2008 SUBJECT: Cancel Contract with Douglas Herring & Associates and Execute Contract with Environmental Science Associates for the Preparation of an Environmental Impact Report for the Bayview Residential Subdivision in the Vinehill area of Martinez (District II) (Contract#49787) SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION RECOMMENDATION AUTHORIZE the Community Development Director, or his designee, to cancel the contract with Douglas Herring & Associates (#C49472); and APPROVE and AUTHORIZE the Community Development Director, or his designee, to execute a contract with Environmental Science.Associates (ESA) for the term from February 27, 2008 to March 1, 2009 with a payment limit not to exceed$329,050.50, to prepare an Environmental Impact Report for Bayview Residential Subdivision in the Vinehill area. FISCAL IMPACT .. The cost is covered by revenue received from application fees paid by developers and applicants. Douglas Herring & Associates (DHA) was hired as the prime consultant to prepare an Environmental Impact Report (EIR) on behalf of the Community Development Department (CDD) for the proposed residential subdivision project known as "Bayview Estates" in the Vinehill area of Martinez. The current work load of Douglas Herring & Associates does not allow DHA to perform the tasks in the approved Scope of Services until September 2008. The Community Development Department is recommending that the contract between DHA and the County be cancelled. Attached is a letter that provides written mutual consent on cancellation of the contract signed by DHA and the Director of Community Development. The cancellation is effectively immediately. The Community Development Department also recommends that Environmental Science Associates be retained for completion of the EIR.. Staff has selected ESA because of their experience with County processes, their expertise in land use (specifically within the County), their in-house resources including expert technical staff, their immediate availability and their track record of completing environmental reviews in a timely manner. Staff recommends that the Board of Supervisors approve and authorize the execution of a contract with ESA to finish the preparation of an environmental impact report for the Bayview Estates residential project.
