REGARDING EMERGENCY CLOSURES OF CHILDREN'S CENTERS

RECOMMENDATION:
ADOPT Resolution No. Z,2 W? 91el acknowledging emergency closure of Lavonia
Allen Children's Center in Bay Point, California and Contra Costa College Children's
Center in San Pablo, California as recommended by Employment & Human Services
Department Director. (District I and V)
FISCAL IMPACT:
This resolution allows the Department to seek reimbursement from the State for the
days of closure and will prevent budget reductions that will otherwise take place due to
non-attendance of children. The budget amounts are already included in the
Department's FY 2007-08 budget. If not approved, an appropriation adjustment will be
necessary to reduce the budget in proportion to the anticipated loss of revenue.

CDE reimbursement request I site closures February 12, 2008
BACKGROUND:
The two site closures were beyond the control of the Community Services Bureau, as
the scheduling of facility repairs fall under the purview of the Housing Authority (Lavonia
Allen Children's Center) and Contra Costa College District (Contra Costa College
Children's Center), respectively.
Lavonia Allen Children's Center was closed October 23, 2007 and November 6-7, 2007
due to the Housing Authority hiring an independent contractor to conduct maintenance
on the water pipes. This work required the Housing Authority to turn off the water in the
housing complex that includes the childcare center.
The Contra Costa College Children's Center was closed on December 21, 2007 due to
the district's need to have work crews replace water valves which required a water shut
off for the entire college.
In all cases, the work was not considered an emergency by the land-owning entities
(Housing Authority and Contra Costa College District), which, for their purposes, meant
that the work could be conducted during business hours. Since the Department was
only given 24-hour notice of the water shut off, the Department was unable to obtain
prior Board approval for the closures.
The State requires an executed board order from the County Board of Supervisors,
acknowledging that the closures were beyond the control of the Department. Meeting
this requirement will assist the Department to avoid a loss of funds for the days of non-
attendance by the affected children. The closure affected 40 State-funded children at
Lavonia Allen Children's Center and 21 State-funded children at Contra Costa College
Children's Center.
The Department seeks authorization to request from the State credited funds for the
days of closure, as permissible by the State Department of Education, Child
Development Division Management Advisory, dated February 1994.

WHEREAS,
Two childcare sites operated by the Community Services Bureau, Employment & Human Services
Department, namely Lavonia Allen Children's Center, and Contra Costa College District Children's
Center, were closed for a total of four (4) days of operation,
WHEREAS,
The two site closures were beyond the control of the Department as the scheduling of facility repairs fall
under the purview of the Housing Authority(Lavonia Allen Children's Center)and Contra Costa College
District (Contra Costa College Children's Center) respectively,
WHEREAS,
Lavonia Allen Children's Center was closed October 23, 2007 and November 6-7, 2007 due to the

to repair the water pipes,
WHEREAS,
Contra Costa College Children's Center was closed on December 21, 2007 due to the Contra Costa
College District turning off the water for the entire campus in order to replace water valves,
WHEREAS,
The Department was only given 24-hour notice of water shut off, and was therefore unable to obtain
prior Board approval for the closures,
WHEREAS,
The State of California requires a resolution from the Contra Costa County Board of Supervisors,
acknowledging that the closures were beyond the control of the Department, in order to avoid a loss of
funds for the days of non-attendance by the impacted children,
WHEREAS,
The closure impacted 40 State-funded children at Lavonia Allen Children's Center and 21 State-funded
children at Contra Costa College Children's Center,
NOW, THEREFORE, BE IT RESOLVED that the Board of Supervisors acknowledges that
the closures were beyond the control of the Department and hereby directs the
Employment & Human Services Department Director, or designee, to request from the
State of California, Department of Education, credited funds for the days of closure, as
permissible by the State Department of Education, Child Development Division
Management Advisory, dated February 1994.
