(District II) Project No. 0662-6R4095 SPECIFIC REQUEST(S)OR RI-COMMENDATION(S)&BACKGROUND AND JUSTIFICATION RECOMMENDED ACTION: APPROVE and AUTHORIZE the Chair, Board of Supervisors, to execute the amended Temporary Permit for geotechnical, biological and archaeological studies and Surveys with East Bay Municipal Utility District(EBMUD), effective April 14, 2008 through November 1, 2009, for the Alhambra Valley Road Widening Project. FISCAL IMPACT: There is no impact to the County General Fund.All funding comes from the project,90%High Risk Rural Road Grant (H R3) and 10`%n Proposition 1 B Funds. (District 11) Project No. 0662-6R4095 DATE: December 9, 2008 PAGE: 2 of 2 BACKGROUND AND REASONS FOR RECOMMENDATIONS: The Public Works Department is in the initial phase of the Alhambra Valley Road Widening Project. Itis necessary to conduct geotechnical, archaeological and environmental testing and surveys to determine the impact in the surrounding area before the project can move forward. The original permit was effective through November 12, 2008. It is necessary for further testing and surveys to determine any environmental impacts. EBMUD required this permit include indemnification language. CONSEQUENCES OF NEGATIVE ACTION: The project would not be able to move forward. TEMPORARY PERMIT FOR GEOTECHNICAL, BIOLOGICAL:Aft ARCHAEOLOGICAL STUDIES AND SURVEYS (Amended) Contra Costa County Project Name: Alhambra Valley Road Widening Public Works Department & Bicycle.Facility Improvement Project Real Property Division Project No.: 0662-6114095 255 Glacier Drive Parcel No. .362-100-001 Martinez, CA 94553 Permission is hereby granted to Contra Costa County, its contractors and their authorized agents, to enter and bring the necessary workers, tools and equipment on the property of parcel number 362- 100-001 located on Alhambra Valley Road for the purpose of performing geotechnical, biological, and . archaeological surveys, which will include soil samples. These activities are required for the Alhambra Valley Road Shoulder Widening and Bicycle Facility Improvement Project and will require limited excavation of multiple soil pits and excavation for borings. The borings will be approximately 6-12 inches in diameter by 20 — 40 feet deep. Each pit will be backfilled and tamped following the collection of data. Any excess soil from the borings may be spread out on the property following the collection of data. A truck or track mounted drill and backhoe will be used on site for the boring activities. Environmental activities may require surface assessment for habitats, botany, and wetlands. Excavation of multiple soil pits with use of hand tools for wetland delineation will be roughly 12-18 inches in depth. They will be refilled following the collection of data. Permission is granted subject to the following conditions: 1. County will provide forty-eight (48) hours notice to the District prior to entry upon the property by calling Ranger Supervisor Rod Tripp at (510) 287-2022. County will also coordinate a pre- project meeting with the District prior to conducting geotechnical work. 2. County will leave the premises in a clean, orderly condition and will repair, replace, or compensate for any existing improvements that may have been disturbed or removed during the course of the work 3. County will have a copy of this permit in possession while on District property 4. County's activities shall at no time interfere with the operations of District of any other activities.permitted by District and shall not damage the land, improvements, or other property . of District or any private improvements or other property on District property. 5. County expressly agrees to indemnify, defend, and hold harmless District, its directors, officers and employees from and against any and all loss, liability, expense, claims, costs, suits and damages including attorney fees arising from its activities on District property under this permit. 6. District reserves the right to cancel this permit at any time if in the District's opinion its land, existing improvements or other property is being damaged or at risk of damage, or if any of the terms and conditions of this permit have been or are being violated. County shall provide District copies of all field data and final reports as they become available. 9. County shall keep all gates closed and locked. _ 10.County acknowledges that there are cattle grazing in the area of the permit and extreme care needs to be taken by County so as to not disturb the cattle. It is further understood and agreed that permission to do the work and perform the acts stated herein shall remain in force and effect April 14, 2008 through November 1, 2009. The District shall in no way be liable for any equipment, personal property or other materials brought onto the,property and the County or its contractor(s) shall be responsible for safeguarding and protecting all equipment and personal property left on the premises. Signing this agreement does not imply that the District agree with the concept of the project, its location, or the proposed improvements.
