LANGO, DIRECTOR OF GENERAL SERVICES °` ming, COSTA DATE: December 9, 2008 �----- COUNTY SUBJECT: FIRST AMENDMENT TO LEASE FOR 2523 EL PORTAL DRIVE, SUITE 203 & 206, SAN PABLO FOR THE HEALTH SERVICES DEPARTMENT (T00557) (CP#08-63) SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION RECOMMENDATION 1. APPROVE a First Amendment to Lease with Jupiter Investment, L.L.C. to extend the lease for 2523 El Portal Drive, Suite 206, San Pablo, for a two (2) year term commencing December 1, 2008, and ending November 30, 2010, and to terminate County's occupancy 2523 EI Portal Drive, Suite 203, as of November 30, 2008, for continued use by the Health Services Department, under the terms and conditions more particularly set forth in the First Amendment to Lease. 2. AUTHORIZE the Director of General Services, or designee, to EXECUTE the First Amendment to the Lease on behalf of the County, and to EXERCISE any options to extend the amended Lease. 3. DETERMINE that the project is a Class 1(a) Section 15301 Categorical Exemption under the California Environmental Quality Act (CEQA). 4. DIRECT the Department of Conservation and Development Director, or designee, to file a Notice of Exemption with the County Clerk, and DIRECT the Director of General Services, or designee, to arrange for the payment of the handling fees to the Conservation and Development Department and County Clerk for filing of the Notice of Exemption. FINANCIAL IMPACT The First Amendment to Lease has a savings of $22,452 over the two year term with the termination of Suite 203, and will decrease the County's obligation to pay rent to $288,240 over the two year extension term. The rent associated with the First Amendment was anticipated and budgeted in the Health Service Department's approved FY 2008/2009 budget. BACKGROUND The County currently leases office space on both the first and second floors of the building located at 2523 EI Portal Drive in San Pablo, including Suites 203 and 206, for the operation of Mental Health Services. The Health Services Department would like to expand its occupancy on the first floor of the building by expanding into space currently leased by a private entity. That private entity has agreed to concurrently vacate its space on the first floor when the County vacates its leased space in Suite 203 on the second floor. That private entity terminated its lease for its space on the first floor effective December 1, 2008. This action extends the lease for Suite 206, and eliminates the County's occupancy of Suite 203, in the 2523 EI Portal Drive, San Pablo building.
