HomeMy WebLinkAboutMINUTES - 12092008 - C.7 HOUSING AUTHORITY OF THE COUNTY OF CONTRA COSTA TO: BOARD OF COMMISSIONERS FROM: Joseph Villarreal, Executive Director DATE: December 9, 2008 SUBJECT: CONTRACT WITH THE COUNTY OF CONTRA COSTA OFFICE OF THE SHERIFF FOR COMMUNITY POLICING SERVICES AT THE BAYO VISTA PUBLIC HOUSING DEVELOPMENT IN RODEO AND THE LAS DELTAS PUBLIC HOUSING DEVELOPMENT IN NORTH RICHMOND SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION I. RECOMMENDED ACTION APPROVE and AUTHORIZE the Executive Director of the Housing Authority to execute a contract, on behalf of the Housing Authority, with the Contra Costa County Office of the Sheriff to provide the Housing Authority's Las Deltas and Bayo Vista developments two Deputy Sheriffs for a twelve month period beginning April 1, 2008 and ending March 31, 2009. II. FINANCIAL IMPACT The cost for this service is $345,100 and is budgeted under the Authority's federally funded Capital Fund Program. No County General Funds are required. III. REASONS FOR RECOMMENDATION/BACKGROUND For fourteen (14) years the Office of the Sheriff has provided community policing duties at the Las Deltas and Bayo Vista housing developments. These are allowable costs under the federal Department of Housing and Urban Developments guidelines. The Deputies provide an opportunity for residents to participate in crime prevention, provides them with enhanced security and maximizes enforcement of laws regarding all criminal activity and loitering at the two developments. CONSEQUENCES OF NEGATIVE ACTION Should the Board elect not to approve and authorize the Executive Director to execute this contract, the Office of the Sheriff would not have sufficient resources to provide much needed law enforcement services at the Las Deltas and Bayo Vista Housing Develpments. Department: Office of the Sheriff-Coroner Subject: Interagency Agreement between Contra Costa County Office of the Sheriff-Coroner and Agency named below for the Project Pride Program. 2. Parties. During the term of this Agreement,the Contra Costa County Office of the Sheriff(herein Office of the Sheriff) will provide the Housing Authority of the County of Contra Costa (herein Agency) two full time deputies assigned to the elimination of drug-related activities,violent crimes and other related unlawful acts at the Las Deltas and Bayo Vista Public Housing Developments. A. The deputies will be assigned to work a forty-hour workweek on site under the supervision of the Office of the Sheriff's Bay Station Commander. No overtime costs are authorized under the terms of this Agreement. B. While on site,within the framework of the Community Oriented Policing Program, deputies will: 1. Make every effort to become an integral part of the Las Deltas and Bayo Vista communities; 2. Exchange accurate information with residents about crime,the community and the goals of policing 3. Provide residents with an increased sense of police care and build Lust and harmony between residents and the Office of the Sheriff; 4. Engage both residents and police in the mutual identification and resolution of issues of crime and disorder; 5. Reduce the fear of crime and enhance the quality of life in Las Deltas and Bayo Vista; 6. Continue the Drug Abuse Resistance Education (D.A.R.E.) program in conjunction with the local school district that will specifically target the youth who live in the Las Deltas and Bayo Vista Public housing developments. C. The deputies will work with other units in the Office of the Sheriff to maximize enforcement strategies directed specifically against the use and sale of illegal drugs in Las Deltas and Bayo Vista. D. Office of the Sheriff will provide: 1) A monthly program report that describes the activities conducted by the deputies at Las Deltas and Bayo Vista during the month; 2) Quarterly statistical reports and analysis measuring increases or decreases in 'the number of reported incidents of crime in North Richmond and Las Deltas,and in Rodeo and Bayo Vista; 3) A final statistical year end report and analysis of the program that documents the extent to which incidents of reported crime has increased or decreased in North Richmond and Las Deltas and Rodeo and Bayo Vista. In consideration of the provision of services as described in Section 1 above,the Agency will pay the County for actual costs in a sum not to exceed the Payment Limit in Section 4 of this Interagency Agreement. 3. Billing and Payment The Office of the Sheriff will submit to the Agency a properly documented demand for payment monthly,in the form and manner prescribed by Agency. The payment demand shall not exceed the equivalent to one third (1/3) of the total compensation identified in Section 2 (Compensation) above. Payment shall be based on services actually rendered. The following Special Conditions are applicable to the Contract between Agency and the County: 1. Independent Contractor Status This Agreement is by and between two independent contractors,and is not intended and shall no be construed to create a relationship of agent,servant,employee,partnership,joint venture or association. 2. Subcontract and Assignment The County shall not subcontract any of the services or assign any rights or obligations without prior written consent of the Agency. 3. Records The County shall at all times keep a complete and thorough record of the time expended and services performed on behalf of Agency,and shall also make available to Agency for audit all such records maintained. 4. Insurance The County is self-insured and will immediately advise the Agency if it ceases to be self- insured. S. Mutual Indemnification County agrees to indemnify and hold harmless Agency for the County's share of any and all claims,costs and liability for any damage,injury or death of or to any person or the property of any persons,including attorneys' fees,arising out of the willful misconduct or the negligent acts, errors or omissions of County, its officers or employees in the performance of this Agreement. Agency agrees to indemnify and hold harmless County for Agency's share of any and all claims,costs and liability for any damage,injury or death of or any person or the property of any person,including attorneys' fees,arising out of the willful misconduct or the negligent acts,errors or omissions of Agency,its officers or employees in the performance of this Agreement. 6.
