(District III) SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION RECOMMENDED ACTION: APPROVE disbursement of$338,000.00 from the Dougherty Valley CSA M-29 Capital Reserve Fund per the "Memorandum of Understanding between Contra Costa County, the City of San Ramon, Shapell Industries and Windemere Ranch P,'artners Relating to the Development of Dougherty Valley"approved January 8, 1998,to City of San Ramon to purchase furnishings and equipment for the Corporation Yard. FISCAL IMPACT: There is no impact to the County General Fund. The CSA M-29.Capital Reserve Fund was set up to partially reimburse the developers for the costs of capital facilities.The balance in the account exceeds the current request for funds. (District III) DATE: December 9, 2008 PAGE: 2 of 2 BACKGROUND/REASON(S) FOR RECOMMENDATION(S): The Capital Reserve Fund is comprised of surplus monies from CSA M-29,set aside for the funding of community facilities such as the Dougherty Valley Community Center,Police Station,Library, Senior Center,and Corporation Yard. The fund receives its money at the end of every fiscal year. If there is any surplus of the tax/assessment monies after all budgeted general maintenance for that year is complete,the money goes into the Capital Reserve Fund and can only be used for community facilities. The distribution of the monies is outlined in the"Memorandum of Understanding between Contra Costa County, the City of San Ramon, Shapell Industries and Windemere Ranch Partners relating to the development of Dougherty Valley". The Memorandum of Understanding was approved by the Board on January 8, 1998. Shapell Homes (Shapell) is obligated to construct the Corporation Yard as a condition of the Settlement Agreement. The cost of the facility is in excess of the Facilities Fee Budget; therefore Shapell is requesting release of these funds to City of San Ramon for the purpose of purchasing necessary furnishings and equipment. On November 6,2008 this Board approved disbursement of$2.36 million to Windemere BLC Land Company (Windemere) from this fund. The amount was mutually agreed upon by Shapell and Windemere as the last payment Windemere could receive from the Capital Reserve Fund, leaving only Shapell eligible for any reimbursement from the fund. CONSEQUENCES OF NEGATIVE ACTION: The City of San Ramon will not receive a disbursement from the CSA M-29 Capital Reserve Fund to purchase necessary furnishings and equipment for the Corporation Yard.
