(District I) Project No. 0662-6R4263-08 SPECIFIC REQUEST(S)OR RECOMMENDATIONS)&BACKGROUND AND JUSTIFICATION , RECOMMENDED ACTION: APPROVE the York Street Pavement Reconstruction Project contingency fund increase of $17,000 for a new contingency fund amount of $33,064.90 effective December 16, 2008, and APPROVE and AUTHORIZE the Public Works Director, or designee, to execute Contract Change Order No. 2 with Ghilotti Bros., Inc., effective December 16, 2008, in an amount not to exceed $15,000, to a new payment limit of $193,713.90 for unforeseen sub-grade over-excavation, North Richmond area. (Measure C Funds) (District I) Project No. 0662-6R4263-08. FISCAL IMPACT: The Project contingency funds are currently insufficient to cover the increased cost. The increase in contingency funds will be funded by Measure C Funds (10 %). DATE: December 16, 2008 PAGE: 2 of 2 REASONS FOR RECOMMENDATIONS AND BACKGROUND: Additional funding is required to increase the contract contingency amount to .pay the contractor for extra work items. The extra work was a result of unforeseen sub-grade over-excavation. Approval of the contingency fund increase is required to compensate the contractor for the additional work. CONSEQUENCES OF NEGATIVE ACTION: The lack of approval would prevent successful completion of this contract and preclude payment to the contractor for required work.
