Company in connection with Drainage Area 57, Line B, Pacheco area. (District II) Project
number 7538-9975-SAS6D8334.
SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION
RECOMMENDATION(S):
ADOPT Resolution No. 2008/20—accepting completion of the Acquisition of Off-site Right of Way
Agreement with O'Brien Land Company in connection with Drainage Area 57, Line B, project number 7538-
9975-SAS6D8334, (cross-reference DA 05-00058), as recommended by the Public Works Director, Pacheco
area. (District II)
FISCAL IMPACT:
No impact to the General Fund.
BACKGROUND/REASON(S) FOR RECOMMENDATION(S):
The property rights were required for drainage improvements for Drainage Area 57, Line B, which were to be
construction per conditions of approval for Subdivision 8984. These improvements are approximately located
along Pacheco Boulevard at the Burlington Northern Sante Fe Railroad overcrossing. The rights have been
acquired.
CONSEQUENCES OF NEGATIVE ACTION:
The agreement and surety bond will not be exonerated.

On December 20, 2005, this Board approved the Acquisition of Off-site Right of Way
Agreement with O'Brien Land Company, in connection with off-site drainage improvements for
DA57, Line B, which was the requirement for Subdivision 8984.

Subsequently, on August 15, 2006, the Board approved the Easement Agreement with
Burlington Northern Sante Fe Railway Company in connection with said improvements.
NOW BE IT RESOLVED that the Acquisition of Off-site Right of Way Agreement and
payment bond 0418236 in the amount $20,000.00 issued by International Fidelity Insurance
Company are exonerated.
