The Advisory Board consists of 21 members: three nominated by each of the County Supervisors, five At Large members and one At Large Alternate. The Internal Operations Committee reviews appointments to the five At Large seats and their Alternate. At its February 3, 2003 meeting, the Internal Operations Committee reviewed and approved the Advisory Board's nomination to appoint Maria Rigazio-Wilson, and now recommends to the Board of Supervisors appointment of this individual. BACKGROUND: The Advisory Council for Domestic Violence (ACAD) was transferred from the leadership of the Superior Court and reconstituted as an advisory body to the Board of Supervisors on January 28, 2003. The Board of Supervisors, on January 28, requested the Internal Operations Committee to consider and make recommendations on whether five of the ACAD seats should be designated as "At Large" seats, as proposed by staff, or as "District" seats. At Large seats are defined as countywide, and would be recruited and nominated by ACAD to the Internal Operations Committee, which would then make its recommendation to the Board of Supervisors. District seats are specific to each district, and would be recruited and nominated by each County Supervisor to the Board of Supervisors. The Internal Operations Committee met with ACAD staff and considered the question of seat designation at its February 3, 2003 meeting, and recommends that the five seats in question be designated as "District" seats. The IOC also recommends that the ACAD By-laws be amended to reflect the new seat designations. Name The name of this advisory body to the Contra Costa Board of Supervisors shall be the"Contra Costa County Advisory Council Against Domestic Violence", hereafter referred to as"ACAD." II. Purpose (Mission Statement) There is hereby established an Advisory Council Against Domestic Violence. The general purpose of ACAD shall be as follows. A. Reduce and prevent the overall number of incidents of domestic violence in Contra Costa by promoting a coordinated, integrated, system-wide response to domestic violence, family violence and elder abuse. B. Address issues related to victims, perpetrators,and children. C. Provide a forum for communication and information exchange among providers of domestic violence services in an effort to encourage and stimulate expansion of best or promising practice within the field. D. Assess current responses to domestic violence and makes policy recommendations. III. Membership The membership of ACAD shall consist of thirty-seven(37) members. The Council shall be composed of the agency head or designee of each of the following entities A. Membership Requirements In order to reflect the diverse ethnic and racial makeup of the persons and families in the community, each member must reside or work in Contra Costa County. If a member's work status or residence changes, they must notify ACAD in writing, within 30 days of their change in status. The chair will review the change of status and determine if the member is still eligible for membership according to these by-laws. If they are found to be ineligible,the member will be asked to resign his/her position. D. Responsibilities of Membership 1. Have an interest in and commitment to the mission-and goals of ACAD. 2. Demonstrate a knowledge of domestic violence prevention and intervention services in Contra Costa County and an interest in and commitment to improvement of those services. 3. Attend ACAD meetings. 4. Attend annual training conference. E. Resignation Any member who desires to resign their position with ACAD must do so in writing and file it with the Chair and Secretary of ACAD. IV. Organization A. Executive Committee: The Executive Committee has primary responsibility for approving and moving recommendations forward to the Board of Supervisors. The purpose of the Executive Committee is to ensure coordination of efforts across all ACAD committee activities. The Executive Committee is comprised of. 1. Chair 2. Vice Chair 3. Secretary 4. Subcommittee Chairs B. Subcommittees: The purpose of the Subcommittees is to reduce and prevent domestic violence in Contra Costa County by enhancing the response of primary service providers. Subcommittees are: 1. Legislation 2. Police/Victim Relations ACAD By-Laws 213103 2 3. Court Services 4. Batterer's Intervention Programs 5. Health Systems 6. Response Data V. Officers The officers of ACAD shall be the Chairperson, Vice-Chairperson, and Secretary. VI. Duties of Officers It shall be the duty of the chairperson to preside at all meetings. In the absence or disability of the chairperson,the vice-chairperson shall assume the duties of the chairperson. Should both senior officers be unavailable, the secretary shall preside. The secretary shall keep the minutes of all meetings, or may designate who shall do so, with the approval of the Chair. The secretary shall send all notices of meetings and/or agenda, attend to correspondence and send out publicity as directed,or may designate who shall do so with the approval of the Chair. VII. Elections/Terms A. AC'AD: 1. Ex-Officio Members' terms do not expire. District Seat Members shall serve for a term of two calendar years. Any vacancies during the term of the District Seat Member shall be filled for the remainder of that two calendar year term. District Seat Members may serve more than one two year term if reappointed. 2. ACRD shall elect its officers every two years, at the last meeting of each even numbered calendar year. 3. New officers shall assume their duties at the first meeting of the calendar year following their election. 4. Officers shall serve for a term of two years. Any vacancies during the term of the officer shall be filled for the remainder of that two calendar year term. Officers may serve more than one two year term if re-elected. 5. Should an officer resign;the vacancy will be filled by election at the next regular meeting. 6. Ex-officio Members with two absences in a calendar year may be removed from membership by a majority vote of the general membership. District Seat Members with two absences in a calendar year may be recommended to the Board for replacement by a majority vote of the general membership. 7. Vacancies will be filled per the Maddy Local Appointive List Act of 1975. B. Subcommittees: 1. The Council elects Subcommittee Chairs. 2. Subcommittee Chairs recommend members for their respective Subcommittees to the Council Chair. 3. The Chair designates the Subcommittee members, strongly considering the recommendation of the Subcommittee Chair. Any conflicts shall be resolved by a discussion and vote of the Executive Committee. ACAD By-Laws 213103 3 VHT. Duties of ACAD The general duties of ACAD shall include hosting the annual training conference and providing recommendations to the Board of Supervisors and other appropriate policy-makers to: A. Improve coordination and cooperation among all sectors of the domestic/family and elder abuse response and service system. B. Support and recommend improvements for programs and activities advising the public as to remedies available from the courts and law enforcement and procedures for accessing appropriate system interventions. C. Support the development and maintenance of programs designed to address issues related to domestic/family violence and elder abuse victims, perpetrators and children. D. Promote public education concerning domestic/family violence and elder abuse, its causes and impacts on families and the community; heighten public awareness of the magnitude of the problem; and dispel myths concerning the same. E. Provide an ongoing forum for consensus and resolution ofdomeestic/family violence and elder abuse issues. F. Form subcommittees to assist in the planning, policy, goal and priority recommendations and such other functions, as ACAD deems necessary. G. Promote ongoing and expanded cross training among the various disciplines that address domestic/family violence and elder abuse issues. Executive Committee Duties: A. Set ACAD agendas. B. Determine program or policy goals. C. Consider and approve recommendations and reports to the Board of Supervisors. Executive Committee Goals: A. Work towards a coordinated, integrated system-wide response to domestic/family violence and elder abuse. B. Establish and support subcommittees to facilitate a working forum for interaction and information exchange among agencies dealing with the victims and agencies dealing with perpetrators of domestic/family violence and elder abuse. C. Identify and analyze the components of current responses to domestic/family violence and elder abuse, monitor, as directed, policy changes recommended by ACAD to the Board of Supervisors and other policy-makers. Subcommittees Duties: A. Make specific recommendations to the Executive Committee to reduce and prevent domestic/family violence and elder abuse in Contra Costa County. Subcommittees Goals: A. Work towards a coordinated, integrated system-wide response to domestic/family violence and elder abuse. B. Provide a working forum for interaction and information exchange among agencies dealing with the victims and perpetrators of domestic/family violence and elder abuse. ACAD By-Laws 213103 4 C. Identify and analyze the components of current responses and recommend changes to the Executive Committee/ACAD as appropriate. IX. Meetings A. ACAD meetings shall be held at least once per quarter,with the Annual Training Conference constituting the Fall Quarter meeting. B. A quorum must be present for any vote on matters before ACAD to be valid. A quorum shall be defined as 30% of designated voting representatives as defined in the member section. C. All meetings of ACAD shall be open to the public and all.interested persons shall be permitted to attend meetings. Time shall be set aside for limited public comment on items not on the posted agenda. D. A Notice of the meeting, with an attached agenda, shall be posted in a public notice area not less than ninety-six(96) hours prior to the meeting,pursuant to the Brown Act and the Better Government Ordinance. X. By-Laws/Amendments These by-laws will govern ACAD membership, organization and meetings of the ACAD. These by- laws may be amended at any regular ACAD meeting, a quorum being present, with prior notice to the membership. XI. Annual Training Conference ACAD shall coordinate and sponsor an annual training conference,the cost of which shall be paid through registration fees for expenses, and in-kind staff time for planning as approved by individual agency members. XII. Annual Objectives Council shall review and adopt objectives annually at the first meeting of the calendar year. XIII. Reports to the Board of Supervisors ACAD shall submit a status report on the activities of ACAD as directed, but no less frequently than annually, to the Family and Human Services Committee of the Board of Supervisors. In addition, ACAD shall submit an annual report to the County Board of Supervisors in accordance with Section IV of Resolution No. 2002/377(6/18/02) ACAD$y-.Laws 213103 5
