SPECIFIC REQUEST(S) OR RECOMMENDATIONS(S) &BACKGROUND AND JUSTIFICATION RECOMMENDATIONS APPROVE and AUTHORIZE the Deputy Director, Redevelopment to carry forward an unexpended balance ($2,490) of Emergency Shelter Grant(ESG) funds for the Contra Costa County Emergency Shelter Project from program year FY 1998/1999 (Project Agreement ESG 98-04)to ESG program year FY 1999/2000(Project Agreement ESG 99-01). FISCAL IMPACT No General Fund impact. ESG funds are provided to the County annually on a formula allocation basis by the U.S. Department of Housing and Urban Development. BACKGROUND/REASONS FOR RECOMMENDATIONS The Contra Costa County Health Services Department(HSD) was awarded $101,400 in FY 1998/1999 ESG funds to help support year round operating costs at the two County run emergency homeless shelters. There is $2,490 in unused ESG funds which, if carry-forward to the FY 1999/2000 budget, may be used for shelter operating costs in that fiscal year. The Director of General Services is directed to mail notices to the construction trade journals specified in Section 22036 of the Public Contract Code at least 30 days before the date of opening the bids. However,if the SBE fails to set proper fair market values for the utitlities it assesses,the County could experience substantial revenue losses. III,BACKGROUND/REASONS FOR RECOMMENDATIONS The counties of California were defendants in major litigation in which many utilities challenged the State Board of Equalization (SBE) central assessments of utility"unitary"property, Although the SBE sets such values,the counties obtain the proceeds of the taxes and thus have a very direct interest in the process.The litigation culminated in the Master Settlement Agreement(MSA)which set agreed values for all centrally assessed utilities for several years. The MSA will terminate at the end of the current fiscal year, 1999-2000. Although the SBE is authorized to set values for centrally assessed utilities,the counties have attempted to monitor the valuation process,which already has starting for the 2000-2001 fiscal year. The counties have acted through a State-wide committee of the County Counsel's Association,which negotiated the MSA on behalf of the counties. To this point,the SBE has proven very resistant to input from the counties and,indeed,has indicated that it will set values without correcting what the Committee believes are several methodological errors. Further,the SBE has informed the Committee that it will no longer allow access to the Information necessary to monitor the value-setting process,except as required under Revenue and Taxation Code Section 833(c). Section 833(c)provides: " ...When requested by resolution of the board of supervisors of any county ... the[SBE]shall permit the auditor or the assessor of the county ... to examine any and all records of the[SBE]." The Committee has asked that each county have its board of supervisors pass such a resolution so as to allow a county group to monitor the SBE's utilities valuations, The Auditor and Assessor join this Office in asking the Board to adopt such a resolution.
