SPECIFIC:REQUIs•T(S)OR RECOMMENDATIONS)&BACKGROUND AND JUSTIFICATION
RECOMMENDED ACTION:
A. FIND that the sale of the Henry Avenue parcel (Parcel X2-4) will not have a significant effect on the
environment,and DETERMINE that the project is exempt from the requirement of the California Environmental
Quality Act as a Class 12 Categorical Exemption under County Guidelines and Section 15312 of the State CEQA
Guidelines, and DIRECT the Director of Community Development to file a Notice of Exemption with the
County Clerk and DIRECT the Public Works Director to arrange for payment of a $50.00 handling fee to the
County Clerk for fi ling and a$25.00 fee to Community Development for processing of the Notice of Exemption.
B. DECLARE that this Board intends to convey to the Pinole Redevelopment Agency,the real property described in
the attached notice for $55,160.00 in accordance with the terms Lconditio/nsofe Purchase and Sale
Agreement to be on file in the Public Works Department.

C. DECLARE that this Board will*meet on November 6,2007 at 9:30 a.m. or thereafter,in the Board's Chambers,
County Administration Building,Martinez,California,to consummate this conveyance by a four-fifths vote and
the Clerk of this Board is DIRECTED to publish the attached notice in the Contra Costa Times pursuant to
Government Code Section 6061.
FISCAL IMPACT:
The Pinole Redevelopment Agency will pay the Contra Costa County Flood Control and Water Conservation
District (District) $55,160.00 for the above real property rights upon consummation of the sale.
REASONS FOR RECOMMENDATIONS AND BACKGROUND:
The project consists of the sale of approximately 3,940 square feet of District owned property to the Pinole
Redevelopment Agency. The property is located north of Pinole Creek and east of Henry Avenue. The District no
longer needs this property and wishes to sell it as surplus property to the Pinole Redevelopment Agency. In October
of 2005 General Plan Conformance was obtained from the City of Pinole.
CONSEQUENCES OF NEGATIVE ACTION:
The District will retain ownership of the property and be required to maintain property no longer needed for District
Purposes.

Real Property in the City of Pinole, County of Contra Costa, State of California, being a
portion of Parcel One described in the Deed to Contra Costa County Flood Control &
Water Conservation District (CCCFC & WCD) recorded February 24, 1958 in Book 3125 of
Official Records at Page 330, and as shown as Parcel X2-4 on the map entitled, "CCCFC &
WCD Pinole Creek Tidelands to Freeway Composite History Map", dated February, 1981,
Drawing No. ED-452 Contra Costa County Public Works Department Records, described
as follows:
Parcel X2-4 Fee Title
Beginning at the most Northerly corner common to Parcel C and Parcel D as shown on
Subdivision MS 79-2 filed June 10, 1980 in Book 86 of Parcel maps at Page 34; thence
South 820 48' 40" East 241.77 feet; thence South 70 41' 20" West 279.68 feet; thence
South 770 56' 23" West 173.37 feet to a point on the Northeasterly line of CCCFC &WCD
Property as described in the Deed recorded May 12, 1966 in Book 5119 of Official
Records at Page 370, said point also being a point on the arc of a non-tangent curve,
concave to the Southwest, a radial from said point bears South 620 06' 24" West; thence
along said Northeasterly line the following two (2) courses: 1) Northwesterly along said
curve, having a radius of 222.00 feet, through a central angle of 240 30' 43", an arc
distance of 94.97 feet; 2) North 520 24' 19" West 95.27 feet to a point on the Easterly
right of way line of Henry Avenue as shown on said Map (86 PM 34), also being a point
on the arc of a non-tangent curve , concave to the Northwest, a radial from said point
bears North 520 24' 19" West; thence Northeasterly along said right of way and along
said curve, having a radius of 400.00 feet, through a central angle of 210 07' 54", an arc
distance of 147.53 feet to a point of reverse curvature; thence Northeasterly along said
curve, having a radius of 350.00 feet, through a central angle of 140 52' 07", an arc
length of 90.83 feet to the point of beginning.
Excepting therefrom, all of Parcel D as shown on said Map (86 PM 34). Containing an
area of 3,940 square feet of land, more or less.
Bearings are based on Subdivision MS 79-2 filed June 10, 1980 in Book 86 of Parcel Maps
at Page 34.

Notice is hereby given that the Board of Supervisors, as Governing Body of the Flood Control and
Water Conservation District of Contra Costa County, on October 16, 2007, declared its intention to
convey to the Pinole Redevelopment Agency the property located on Henry Avenue and more
particularly described in the Board Order dated October 16, 2007, Item No. C.21
Notice is further given that it is proposed to convey said property to the Pinole Redevelopment
Agency for $55,160.00, being the fair market value of the property.
The Board will meet on Tuesday, November 6, 2007, at 9:30 a.m. in the Board Chambers, County
Administration Building, 651 Pine Street, Martinez, California, to make such conveyance by at
least a four-fifths vote.
