ADOPT Resolution No. 2007/5 appointing Board members and other individuals to serve on Board committees, special county committees, and regional boards/ committees/ commissions for 2007 and abolishing certain ad hoc committees. 2. WAIVE the Board's policy on multi-year regional body appointments and appoint Supervisor Bonilla to complete Supervisor Gioia's tern on the Contra Costa Transportation Authority Governing Board ending January 31, 2008. 3. CONSIDER sending a delegate to the National Association of Counties (NACo) Legislative Meeting to be held in March in Washington, D.C., and to the Annual Conference to be held in July in Richmond, Virginia. 4. INDICATE that this RESOLUTION supersedes in its entirety Resolution No. 2006/711, which was adopted by the Board of Supervisors on November 14, 2006. Piepho Page 2 ----------------------------------------------------------------------------------------------------------------------------------------- BACKGROUND Each year when the Board of Supervisors reorganizes, the incoming Chair reviews and makes recommendations to the Board on committee assignments. The annual review of committee assignments is governed by a policy (attached) adopted by the Board in March 2000. Transmitted herein are my recommendations for committee assignments for 2007. My recommendations seek to balance the workload of the Supervisors as well as to consider some of the outstanding responsibilities and appointments of the Supervisors on regional bodies. At one time, it was the Board's practice that the Chair of the Board did not serve on a standing committee, e.g., Finance; Internal Operations; Transportation, Water, and Infrastructure; Family and Human Services committees. This practice was set aside in the last two years due to the pressing need for continuity on some of the very complex issues on referral to these committees. Consistent with the more recent practice, I am recommending that 1 continue to serve on the Board's Finance Committee. Also, when the Board added the Capital Facilities Committee as a standing committee, it specified that its members were to be the Chair and Vice-Chair of the Board. Again, for reasons. of continuity, I am recommending that Supervisor Gioia remain with me on the Capital Facilities Committee, which is a departure from past practice. 1 am recommending that the Board, with Supervisor Gioia's concurrence, waive its policy on multi- year regional body appointments and appoint Supervisor Bonilla to complete Supervisor Gioia's term on the Contra Costa Transportation Authority Governing Board ending January 31, 2008. 1 also ask that the Board consider sending a delegate to the National Association of Counties (NACo) Legislative Meeting to be held on March 3-7, 2007 in Washington, D.C., and the Annual Conference to be held on July 13-17, 2007 in Richmond, Virginia. Last December, the Board adopted a federal legislative program that included requests for appropriations and adopted policy positions on numerous issues, the outcome of which could have significant fiscal and programmatic impact on Contra Costa County. NACo is the primary voice for counties in Washington, and participation by the County's governing board will help ensure that federal decision makers are aware of county issues and priorities. In a further effort to balance workload and, additionally, to conserve staff resources, I am recommending the suspension or elimination of the following committees whose work is now either complete or can be referred to the Board of Supervisors for continuing discussion: ■ Indian Gaming Ad Hoc Committee—In May 2004, the Board established this Ad Hoc Committee of the District I and II Supervisors to provide a venue for discussion and development of recommended actions on state and federal legislative platform positions, local policy, and relationships with other governments regarding specific proposals. There is no longer a need for the ad hoc committee because the Board has already addressed the more immediate issues and adopted policy positions on Indian gaming. Future issues and recommendations can be effectively handled by the full Board of Supervisors. Board Committee Appointments January 3,2007 Supervisor Mary N. Piepho Page 3 ----------------------------------------------------------------------------------------------------------------------------------------- ■ Environmental Justice Ad Hoc Committee—In October 2000, the Board established this Ad Hoc Committee of the District I and V Supervisors to work with the Board and the CAO to ensure the fair treatment of people of all races, cultures, incomes with respect to the development, adoption, implementation, and enforcement of environmental laws, regulations, and policies. The Board adopted a countywide environmental justice policy in 2003 and the County Administrator's Office continues to oversee department compliance with the policy directives. ■ Urban Limit Line Ad Hoc Committee—In October 1998, the Board established this Ad Hoc Committee of the District III and V Supervisors to conduct a detailed review of Urban Limit Line (ULL) issues and prepare a comprehensive report defining scope and process, available funding sources, and boundaries and timelines for an environmental review of the ULL and General Plan amendments; and the possible development of an East County Strategic Plan with the cities of Pittsburg, Antioch, and Brentwood. Recent passage of the Urban Limit Line ballot measure eliminates the need to continue the ad hoc committee. Board Committee appointments shall be categorized in accordance with the following descriptions and delineated as on the attached listing: a) Internal appointments that are subject to the annual reorganization process and to which the incoming Chair of the Board of Supervisors makes nominations to be approved by the Board of Supervisors. Ad Hoc committees of the Board also fall under this category. b) Regional appointments that are not subject to the annual reorganization process and to which the Chair of the Board of Supervisors makes nominations to fill vacancies, as they occur, in accordance with the agency's terms and by-laws, and which nominations shall be approved by the Board of Supervisors. c) Special Case/Restricted appointments, for which the specific assignments are dictated or are in some way restricted by statute or county ordinance, or for which the term of the appointment makes it impractical for it to be considered along with the other annual assignments e.g., a term that runs from July to June. Restrictions might include, for example, that a committee member represent a certain district, be the Chair of the Board, or vest in the Chair of the Board the authority to appoint an alternate. The Chair of the Board of Supervisors shall make nominations to these appointments to fill vacancies, as they occur, subject to any legislated restrictions, and which nominations shall. be approved by the Board of Supervisors. 2. Notwithstanding Paragraph 1 of this policy and as allowed by law, the Board of Supervisors maintains its right to nominate, reconsider and change appointments at any time, irrespective of the.tern of an appointment. 11.% 3.
