As to fees charged for services in mobilehome parks, the Board requested information on 'whether these new fees could be passed o\through to mobilehome owners under the County's Mobilehome Space Rent Stabilization Ordinance ("Mobilehome Ordinance") (Contra Costa County Code, Division 520.) SUMMARY: Only a few of the recently adopted mobilehome park and special occupancy fees apply to mobilehome apply to mobilehome park owners. Under the County's Mobilehome Space Rent Stabilization Ordinance, none of these fees that are charged to park owners are allowed to be automatically passed through to mobilehome owners. Fees charged to a park owner in connection with a new capital improvement could be passed through to mobilehome owners as a component of a capital improvement rent increase. Other fees charged to a park owner .may be considered for pass-through only if the park owner seeks a major rent increase, which has never been done under the County's Mobilehome Ordinance. Other fees are not subject to pass-through at all. DISCUSSION: l A. The County's Mobilehome Ordinance. The County's Mobilehome Ordinance limits the amount of rent a park owner may charge for covered mobilehome spaces in mobilehome parks. The Mobilehome Ordinance allows for a limited lautomatic annual rent increase (Contra Costa County Code, § 540-2.404), and al limited (partial) pass-through of any Community Development administration fee (none imposed at this time) (Contra Costa County Code, § 540-2.406). The only other rent increase allowed by the Mobilehome Ordinance are limited-duration) capital improvements rent increases for new capital improvements (Contra Costa County Code, §§ 540-2.204(c), 504-2.408; article 540- 2.12), and major rent increases (Contra Costa County Code, § 540-2.410, article 540-2- 10). A park owner seeking a major rent increase, if challenged, must disclose (among other things) actual income and operation expenses for the two-year period prior to the projected rent increase (Contra Costa County Code, § 540-2.1002(e)).
