SUBJECT: Approval of Cancellation Agreement#26-525-2 and Contract#26-525-3 with Pradeep Kumar, D.
SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND JUSTIFICATION
RECOMMENDATION(S):
Approve and authorize the Health Services Director, or his designee (Jeff Smith, M.D.), to execute on behalf
of the County as follows:
1. Cancellation Agreement #26-525-2 with Pradeep Kumar, M.D., effective at the close of business on
December 31,2006; and
2. Contract #26-525-3 with Pradeep Kumar, M.D., a self-employed individual, (Specialty: Psychiatry), in
an amount not to exceed $375,000, to provide professional psychiatry services for patients at Contra Costa
Regional Medical Center and Contra Costa Health Centers, for the period from January 1, 2007 through
December 31,2008.
FISCAL IMPACT:
This Contract is funded 100% by Enterprise I Funds. Cost to the County depends upon utilization. As
appropriate,patients and/or third party payors will be billed or services.
BACKGROUND/REASON(S)FOR RECOMMENDATION(S):
On June 7, 2005, the Board of Supervisors approved Contract #26-525 (as amended by Amendment
Agreement #26-525-1) with Pradeep Kumar, M.D., for the period from June 1, 2005 through May 31, 2008,
for the provision of Psychiatric services, including, but not limited to, on-call and call-back coverage services
for the Psychiatric Emergency Room at Contra Costa Regional Medical Center and Contra Costa Health
Centers.

The Department and Contractor have mutually agreed to renegotiate the Contract Payment Provisions to
reflect the intent of the parties in which Dr. Kumar be paid at a rate of$121.20 instead of$100.90 per hour,
also allowing the Contractor's legal status to be changed from an Independent Contractor to a Self-employed
Individual Subject to Withholding. Therefore, in accordance with Paragraph 4. (Termination) of the Contract,
the Department and Contractor have agreed to a mutual cancellation of Contract #26-525-1. Approval of
Cancellation Agreement#26-525-2 will accomplish this termination.
Under Contract#26-525-3, Contractor will provide professional psychiatric services at Contra Costa Regional
Medical Center and Contra Costa Health Centers,through December 31,2008.
