There will be no impact on the County General Fund. BACKGROUND On December 5, 2006 the Board of Commissioners accepted the updated report on the Section 8 Housing Choice Voucher(HCV) issues in the City of Antioch (City). The Board further directed a follow-up report regarding an action plan to address the issues of Section 8 program participants' contribution to the perceived deterioration of the quality of life in the neighborhoods of the City and the Housing Authority's responsiveness to the City and Contra Costa communities in general. Your Board directed that a pilot program be reviewed with the City staff to address.the concerns of the City and community groups. The Housing Authority recognizes that the federal regulations dictate some of the activities of the Authority regarding applicants' eligibility for the program, continued eligibility, and due process for termination from the Housing Choice Voucher program. There are activities that have been and will continue to be initiated by the Housing Authority to address the growing concern pertaining to the suburban proliferation of the Section 8 program participants throughout the County. The Housing Authority actions completed to date include: o Landlord workshops held on November 4, 2006 and February 10, 2007 in the City and focused on landlord responsibilities, evictions and screening of applicants. o Renter's workshop conducted on February 24, 2007 in the City and focused on the "Good Neighbor Guidelines" (See Attachment 1), HUD's Housing Quality Standards and Renter's Rights and Responsibilities. o Opened a Section 8 East County office on June 1, 2006 and is expanding the office from four permanent staff to seven permanent staff effective March 1, 2007. Since November 1, 2006 Section 8 participants from other jurisdictions entering the Housing Authority jurisdiction are now subject to criminal conviction background checks for the particular state and counties in which they have rental history. o The Housing Authority Hotline telephone number, initiated in June 2006 to receive citizen complaints from the East County area remains (925) 957-8050. Housing Authority Action Plan A) Housing Authority Responsiveness and Quality Control Action Plan: 1 Housing Authority has purchased software to upgrade its' website to allow for the completion of complaints on-line and then e-mailed directly to Housing Authority's electronic mail box. A consultant is upgrading the website. This upgrade will be completed on March 1, 2007. 2 Housing Authority has upgraded the telephone software to allow supervisor monitoring of telephone calls for quality control and training purposes. In addition, the software allows for system daily reporting by telephone extension for the number of telephone calls received, answered and routed to voice mail. 3 Update Housing Authority telecommunication procedures, train staff and monitor effectiveness 4 Quality control process developed by Managers to review all complaints and/or reported allegations of participant fraud to monitor investigative process, ensure appropriate documentation and coordinate appropriate action of staff. Maintain quality control log to be reviewed bi-weekly by Director. 5 Plans are to continue the landlord workshops on a quarterly basis in East County and expand to other areas of the county. B) Housing Authority and City of Antioch Code Enforcement and Violations Action Plan: 6 Procedures and forms being developed that will be used by Housing Authority inspectors to perform cursory review of the Section 8 property for City of Antioch Code.Violations while conducting their Housing Quality Standards (HQS) inspection. A copy of the inspector's assessment of possible Code Violations will be given to the landlord and a copy mailed to Code Enforcement apprising them of the general location of possible Code Violations. 7 The Housing Manager and the Director have been directed to train the inspection staff on these new policies and procedures and to establish monitoring and quality control criteria for staff. C) Section 8 HCV Program Fraud Action Plan: 8 The Housing Authority will expand the current Internal Program Auditor position to include fraud investigation and coordination. Position will solicit and coordinate investigation activities by the Housing Authority management and staff, HUD-OIG investigators, law enforcement agencies, Welfare and District Attorney Investigators and other agencies. That Internal Program auditing functions related to quality control will be shifted to the various Department heads. D) Section 8 HCV Program and Criminal Activity—The Housing Authority desires to have all Section 8 participants continually be in compliance with the program requirements, meet their family obligations and document the household as participants in good standing. The Housing Authority wants to ensure that the safe, quiet and peaceful enjoyment of neighborhoods will not be adversely affected as the suburban movement of Section 8 participants continues. To accomplish this proactive approach, the Housing Authority is proposing two (2) different methods to identify those participants that jeopardize the safety of neighborhoods throughout the County. The initial screening of applicants entering the program will now be expanded from one to five years free from criminal conviction background check history. To ensure that Section 8 participants remain in good standing the Housing Authority will require law enforcement data queries to be conducted during the annual recertification process. The latter will require cooperative and confidentiality/nondisclosure agreements with various law enforcement agencies throughout the County. These are two significant changes to the Section 8 Administrative Plan, which is the Housing Authority's policies, procedures and processes for operating the Section 8 Board of Commissioners February 27, 2007 Page 3 of 3 Program consistent with HUD requirements and local objectives. Changes to the Section 8 Administrative Plan require a thirty-day public comment period, subsequent approval by the Board of Commissioners, and final approval by the HUD San Francisco Office of Public Housing. Another proactive approach by the Housing Authority will also require cooperative and confidentiality/nondisclosure agreements with various law enforcement agencies throughout the County. This involves the Housing Authority receiving recurring reports from law enforcement agencies of arrests, warrants and public records of criminal activity within a community that may or may not involve Section 8 participants. If a Section 8 participant or address is identified in the report, the Housing Authority may request additional detailed reports. Action Items for Section 8 Administrative Plan: 9 Criminal conviction background check for initial eligibility will be expanded from one to five years free from drug related or violent criminal inactivity and will still require certifications or other documentation demonstrating rehabilitation or completion of probation. 10 As part of the annual reexamination process, families are required to provide updated information to the Housing Authority regarding the family's income, expenses, household composition and all other information the Housing Authority requires [CFR 982.551(b)]. The Housing Authority will now require each household member age 18 and over to execute a consent form for law enforcement database queries as part of the annual reexamination process. (See Attachment 2 with exhibit) 11 Develop guidelines and train staff for reviewing law enforcement database queries, procedures for processing documents and determining a participant's continued eligibility, on a case-by case basis, for the Section 8 program Explanation: The HCV contract,signed by all adult members of the household, the family obligations section specifically states: "The family(including each family member)must not engage in drug-related criminal activity or violent criminal activity or other criminal activity that threatens the health, safety or right to peaceful enjoyment of other residents and persons residing in the immediate vicinity of the premises." Law enforcement database queries are not criminal conviction records background checks but rather criminal activity information that can be provided by a law enforcement agency by name, social security number and/or address. These database inquiries during the annual reexamination process will ensure that the head of household and family members are participants in good standing, complying with their family obligations. If the database query indicates otherwise, the Housing Authority will take appropriate action as may be warranted on a case-by-case basis in accordance with federal regulations and Housing Authority Plan. Action Plan for Recurring Law Enforcement Participation of Criminal Activity Queries; 12 The Housing Authority will enter into cooperative agreements, including confidentiality and non- disclosure agreements, with local law enforcement agencies throughout the county to provide the Housing Authority on regular basis information of criminal activity, arrests, and warrants that may or may not pertain to Section 8 participants. If determined to be a Section 8 participant, the Housing Authority will take appropriate action, including additional law enforcement documentation, in accordance with the Federal Regulations and its Section 8 Plan. 13 The Housing Authority will explore the possibility of contracting with a local law enforcement agency to perform initial eligibility criminal conviction background checks for all applicants entering into the Section 8 program. Attachment 1 Good Neighbor Guidelines The Good Neighbor Guidelines were developed to assist you in how to be a good neighbor in your chosen community. The responsible actions of all who reside in your household will assist in ensuring that you and your neighbors enjoy a quiet, pleasant and peaceful environment. The following guidelines are provided to promote a better living environment for you and your family, this guide is subject to City Code or Ordinances in your area.. Repeated or serious violations of your lease or City Codes or Ordinances may result in termination of tenancy by the landlord or end of Section 8 participation by the Housing Authority, CONDUCT OF TENANTS AND GUESTS These guidelines are to help ensure your behavior, and the behavior of your household members and guests, contribute to a pleasant living environment for you and your neighbors. • Quiet Hours and Curfew A certain amount of noise is expected in a residential area. Residents are encouraged to be considerate of their neighbors at all times. Generally, quiet hours are from 10:00 p.m. to 7:00 a.m. Loud noises are discouraged after 10 p.m. During quiet hours, there should not.be noise that can be heard outside of your home. Juveniles have a curfew of 10:00 p.m. per Contra Costa County ordinance and therefore should not be outside past curfew. • Music and Loud Noises Musical instruments, audio equipment, and television sets should be played at a reasonable volume that does not disturb your neighbors. The use of such devices outside your home is discouraged except when played at a very low volume or with earphones. This applies to car stereos as well. Car stereos should not be played at a volume that will disturb your neighbors at any time of the day or night. Vehicles must be equipped with an adequate muffler to prevent excessive or unusual noise. • Dogs For safety purposes, the Housing Authority recommends that you keep a dog inside unless properly leashed and under control. Prolonged barking or aggressive behavior can alarm and disturb neighbors. Check your lease and City Codes or Ordinances in your area for information regarding dogs and pets. • Drug Free Environment No person can engage in criminal activity, including drug-related criminal activity, in or near your home. Drug-related criminal activity means the manufacture, sale, distribution, or use of an illegal substance or the possession with intent to manufacture, sell, distribute, or use controlled substances. Such conduct is a violation of the program rules and can result in your termination from the Section 8 Program. HOUSEKEEPING These guidelines are to help ensure that your home environment is safe, sanitary and.pleasant. • Smoke Detectors Do not remove the batteries or disable any smoke detector in your home. Immediately report any problems with the smoke detector to your landlord. • Vehicles You should have current registration and proof of insurance for all vehicles. All vehicles should be operational and must be parked in the garage, the driveway, or on the street, if permitted. Do not park on the sidewalk or anywhere on the front lawn. Do not drive a vehicle in an unsafe or unlawful manner or in a manner that disturbs your neighbors. You should not use parking areas or lawns for the repair of vehicles. Housing Authority Good Neighbor Guidelines Page 2 of 3 • Garbage Find out the day your garbage is picked up each week. Make sure all accumulated trash is removed. Never allow trash to accumulate. • Inside Storage and Egress For safety purposes, do not store items/furnishing near any wall heaters; you MUST have clearance of four (4) feet in front and two (2) feet on each side of wall heaters. NEVER use your hot water heater closet for storage. Do not place furniture, clothing, boxes, etc. in front of windows or doorways. All windows and doorways must have full clearance to open, close and lock. To prevent fire hazards, appliances should be clean and free of accumulated grease and food. • Outside Storage & Yard Areas Do not store household items, flammable chemicals (i.e. gasoline, paint thinner, pesticides, solvents, etc.) or other personal items on your front porch or front lawn. These items should be kept in your garage or suitable storage unit. All items (bicycles, outdoor toys, barbeque grills, etc.) should be secured inside your garage or storage unit at night, if possible. Check your lease regarding your responsibility for the maintenance of your front and back yard. • Window Coverings All windows should have coverings. These may or may not come with your home when you rent it. If not, you'll want to cover your windows to protect your privacy. Do not cover windows with bed sheets, newspaper, boards, etc. These items look"tacky" from the outside and detract from the overall attractiveness of your new neighborhood. • Renter's Insurance It is recommended you purchase renter's insurance for protection against damage/loss to your personal items in the event of fire, theft, or other catastrophe. Your landlord's insurance will only cover the structure in the event of property loss, NOT its contents. OBSTRUCTION OF JUSTICE You, your household members and your guests must refrain from preventing any emergency personnel such as law enforcement, fire department, animal control or an ambulance response team from performing their duties. Examples of prohibited activities are forming crowds, throwing items, etc. There must be full cooperation with any lawful order given by a peace officer. GUIDELINES FOR CHILDREN These guidelines are to help ensure the safety, health and security of the children that reside in your home. • Children at Play Do not allow children to play in any place where there is a risk to their health and safety. Attention must be paid to the surrounding areas and any potential causes of injury or harm to the child. • Children on Bicycles, Scooters and Skates. California's helmet law requires that persons under 18 years of age must wear a helmet while operating a bicycle, non-motorized scooter or skateboard, while wearing in-line or roller skates, or while riding upon a bicycle, non-motorized scooter or skateboard as a passenger upon the streets or an other public bicycle path. Housing Authority Good Neighbor Guidelines Page 3 of 3 • Supervision of Children Children under twelve (12) years of age should not be left alone at home. Younger children and toddlers should be supervised at all times wherever they are playing. Printed Name Signature Date Printed Name Signature Date Attachment 2 Law Enforcement Database Queries Under the HCV program, Title 24 Part 5 Subpart J (5.901 - 5.905) you may only pull criminal conviction records for applicants as part of your screening process. The CFRs do not authorize you to pull these records for participants using HUD authority. If you pull records under HUD authority for a participant, you can be fined $5,000 and convicted of a misdemeanor and the PHA can be sued in civil court. Law Enforcement database queries will not be used for screening applicants as part of the initial eligibility process. These queries will be'used to ensure that Section 8 participants remain in good standing on the Section 8 program and that they are complying with their program family obligations. This is just one method of documenting a participant's good standing and compliance with federal regulations. If law enforcement database inquiries are requested by address, the head of household voucher holder becomes accountable for any criminal activity reported for their residence. Benefits: o Proactive approach to dealing with criminal activity by family members. o Hold head of household responsible for all activities occurring at the Section 8 address by family members, guests and visitors that require law enforcement intervention. o After initial query for all participants can tailor law enforcement database query develop program to address annual queries for problem participants and those with criminal activity hits. Process to Implementation: o Added to the Housing Authority Section 8 Administrative Plan(Plan). o Posted 30 day notice for public comment. o Approval of Plan by the Board of Commissioners. o HUD San Francisco Office of Public Housing approval before implementation. o Fully implement after HUD approval utilizing the attached Consent Form. During approval process, Housing Authority must determine or negotiate the following: o Funding and staffing requirements. o Negotiate and formalize agreements with various law enforcement agencies. o Develop standards and guidelines on a case-by-case basis for Housing Authority appropriate actions toward a Section 8 participant with resulting law enforcement database query activity. CONSENT FORM TO CONDUCT LAW ENFORCEMENT DATABASE QUERIES H.O.H SS# Tenant# The Housing Authority must be assured that you and your family members remain in good standing in accordance with the family obligations of the Voucher Contract. Specifically Section 4, Paragraph D 4, "The family (including each family member) must not engage in drug-related criminal activity or violent criminal activity or other criminal activity that threatens the health, safety, or right to peaceful enjoyment of other residents and persons residing in the immediate vicinity of the premises". To ensure that you and your family are in compliance with the family obligations you and every adult member, 18 yrs of age or older, must sign this consent form. An annual criminal activity query report will be conducted as part of the Housing Authority annual re-certification process. If this query reveals a history of illegal drug or violent criminal history, or other criminal activity, appropriate action will be taken in accordance with federal regulations and Housing Authority policy. I hereby consent and authorize the Housing Authority of the County of Contra Costa to query criminal activity reports from any law enforcement agency. By execution of this consent form, adult household members' consent that he/she understands the above regarding criminal activity query checks from law enforcement agencies and that: • The Housing Authority of the County of Contra Costa may use the records in accordance with the federal regulations (24CFR 982.55) to determine your continued eligibility for the program. Termination of benefits is subject to the HA's grievance procedures and Section 8 informal hearing procedures. ADDENDUM to HA.1 February 27, 2007 On this day,the Housing Authority Board of Commissioners considered accepting a report from the Housing Authority of the County of Contra Costa on Section 8 housing issues in the City of Antioch. Rudy Tamayo, Housing Authority Executive Director,gave a Power Point presentation entitled, "Section 8 Housing Choice Voucher Update"(attached). He noted proposed modifications to the program that would include broader criminal background checks, new plans to address fraud, and a change for program participants that would increase the requirement of a clean criminal conviction background from one year to five years. He said the process of implementing these changes to the program could take up to 60 days to complete. Supervisor Glover asked if these proposals had been presented to the City of Antioch. Mr. Tamayo responded that they had not. Supervisor Glover asked if under current;practice,the file of a participant follows them when he or she transfers into Contra Costa. Mr. Tamayo said that yes,the participant's file, including criminal and background checks, follows him or her into the County. Supervisor Glover noted that many times, code violations seen on the exterior of a residence can be an indicator of criminal activity inside the residence. He asked if upping code violation enforcement—not just for Section 8 properties but for all properties—could be part of the process of reducing crime. Mr. Tamayo said that Housing Authority inspectors could assist in this process by informing various code enforcement agencies about issues they see in the field. Supervisor Uilkema asked if there was a waiting list for Section 8 housing or for public housing. Mr. Tamayo said that currently,there is no waiting list for Section 8 housing, but that there is a waiting list for public housing. Supervisor Uilkema said she has been hearing about many instances of fraud and she suggested pursuing ways to eliminate program fraud. She also suggested comparing the program's background checks to police background checks to see if they are matching up. Chair Piepho suggested that Supervisor Uilkema's concerns might fall instead under item HA.2,the next deliberation item on the Board's agenda. Supervisor Bonilla asked if law enforcement databases are being used for background checks. Mr. Tamayo said no, adding that those databases show a record of all activity rather than convictions. Supervisor Bonilla asked if the changes proposed today would mean that the background checks would now show all activity rather than just convictions. Mr. Tamayo said yes,that was what is being proposed. Supervisor Gioia commented that studies on recidivism show that having a house and a job reduce instances of recidivism. He said that rather than trying to solve the program's problems by making the February 6, 2007 Addendum to D.5 Page 2 of 2 requirements as strict as possible, he would like to see the problems being approached by looking at the Federal guidelines and seeing where the County has areas of flexibility, and then having a careful and rational discussion about how to solve the problems. The Chair called for public comment and the following people spoke: Ralph A. Hernandez,Antioch resident, said there is an issue in Antioch of program participants being publicized,which is against the law. He also commented on the issue of code enforcement, asking why the County's Housing Authority should have to do the job of the City of Antioch. (Handout provided) Arlene Hildebrand, City of Antioch, said the proposed changes are a step in the right direction but the City still has concerns that have not been addressed, such as the quality of the background checks and the process for annual re-certification. Supervisor Glover said he appreciates the suggestions presented today but wants to make it clear there is no agreement on a pilot program at this time. He said he would like to see an ad-hoc committee review of the pilot program. By a unanimous vote of 6-0 with none absent, the Housing Authority Board of Commissioners took the following action: ACCEPTED the report on the Section 8 Housing Choice Voucher Program Action Plan; and REFERRED the report to the Ad-Hoc Committee for review. I personally appeared before your body earlier today during your public meeting and related the aforementioned before you, under the agendized item#D.5. Based upon a number of previous and then discussed and disclosed information, etc., I believe that the Federal and State protected rights of the Housing Assistance Recipients' and Providers' rights may have been violated by the majority of the elected officials of Antioch(Mayor Donald P.Freitas,current Council Members James D. Davis, Brian Kalinowski, Arne Simonsen, and former Member Jim Conley), some of the City of Antioch's staff, some within the Antioch Police Department (headed by Chief James Hyde), some of Antioch's "CAT" and "VIPs" personnel, some within the City's NIS/Code Enforcement unit, as well as others within the community to be identified. Antioch's Section 8/Certificate Program, Housing Assistance, etc., Recipients and Providers (Landlords)have been,I believe,illegally and publicly targeted by their confidential information,related documentation, and privacy rights being publicly discussed, disclosed, and exposed. By the laws I am aware of it would be illegal if such is proven to have been the case(and it seems will continue until immediate and legal means are initiated to stop such). By law only those having the limited "legal need to know,a legal right to know, and a legal right of access" to the Housing Assistance Recipients' and Landlords' information and documentation is legal! It appears that this legal need, right, and of access, is not nor been the case in Antioch. Antioch's political gamesmanship and the related public propaganda concerning the programs, etc., must be stopped-beginning with the Mayor and City Council majority's obviously driven potentially illegal agenda(s)! Their complaints of illegal Section 8 tenancies,etc.,does not give them any legal rights to conduct or continue with their perceived illegal "witchhunt". That is not to say that any illegal activity should be ignored,on the contrary it should be pursued. But, it must be done within the legal parameters of the law! Each Elected Official and sworn Officer in California took an Oath upon taking their elected or appointed position(s)to uphold and protect the rights of the public. The Board's duties and responsibilities therefore make it clear that you must also take the appropriate action and steps whenever suspected and/or potential violations of the law and/or the rights of individuals are violated that are brought to you.
