Barry, AICP, Director of Community Development DATE: February 27, 2007 SUBJECT: Transportation for Livable Communities Funding SPECIFIC REQUEST(S) OR RECOMMENDATIONS(S) & BACKGROUND AND JUSTIFICATION RECOMMENDATIONS ADOPT two resolutions of support for Transportation for Livable Communities Funding from the Metropolitan Transportation Commission, one for the Bailey Road Transit Access Improvement Project, Bay Pointe, and the second for the Iron Horse Trail Overcrossing of Treat Boulevard Project, Contra Costa Centre. FISCAL IMPACT None. Local match funds are budgeted Redevelopment funds. BACKGROUND/REASONS FOR RECOMMENDATIONS The Contra Costa County Redevelopment Agency submitted two successful applications to the Contra Costa Transportation Authority for Transportation for Livable Communities (TLC)- County portion funding. The improvements which will include sidewalk widening, security lighting, landscaping and road widening necessary to accommodate a bicycle trail, will enhance access to planned transit-oriented development projects of high density housing and retail. • Iron Horse Trail Overcrossing of Treat Boulevard, Contra Costa Centre- $640,377 The Iron Horse Trail is a significant element of the transportation choice available to the residents, employees, and transit patrons that come to Contra Costa Centre and the Pleasant Hill BART Station.The Iron Horse Trail Overcrossing will permit users to safely access employment, transit and residences. Because the funding ultimately comes from the Metropolitan Transportation Commission (MTC) the Agency, as the applicant, must adopt resolutions in support of MTC funding. Transit-Access Improvements, Bay Point WHEREAS, the Contra Costa County Redevelopment Agency (herein referred to as "APPLICANT") is submitting an application to the Metropolitan Transportation Commission (MTC) for $988,788 in funding from the 2006 Regional Transportation Improvement Program (RTIP) Augmentation for the Bailey Road Transit Access Improvement Project (herein referred to as "PROJECT" or "PROJECTS") for the MTC 2006 RTIP Augmentation, as authorized by MTC by Resolution 3790 (herein referred to as "PROGRAM"); and WHEREAS, SB 45 (Chapter 622, Statutes 1997) substantially revised the process for estimating the amount of state and federal funds available for transportation projects in the state and for appropriating and allocating the available funds to these projects; and WHEREAS, as part of that process, MTC is responsible for programming projects eligible for Regional Improvement Program funds, pursuant to California Government Code Section 14527(b), for inclusion in the RTIP, and submission to the California Transportation Commission, for inclusion in the State Transportation Improvement Program; and WHEREAS, MTC will review and include, if approved, 2006 RTIP Augmentation projects in the federal Transportation Improvement Program (TIP); and WHEREAS, MTC has requested eligible transportation project sponsors to submit applications nominating projects to be programmed for Regional Improvement Program funds in the RTIP Augmentation; and WHEREAS, applications to MTC must be submitted consistent with procedures, conditions, and forms it provides transportation project sponsors; and WHEREAS, APPLICANT is a sponsor of transportation projects eligible for Regional Improvement Program funds; and WHEREAS, the RTIP Augmentation project fact and fund sheet of the project application, attached hereto and incorporated herein as though set forth at length, lists the project, purpose, schedule and budget for which APPLICANT is requesting that MTC program Regional Improvement Program funds for inclusion in the RTIP Augmentation; and WHEREAS, Part 2 of the project application, attached hereto and incorporated herein as though set forth at length, includes the certification by APPLICANT of assurances required by SB 45 in order to qualify the project listed in the RTIP Augmentation project nomination sheet of the project application for programming by MTC; and WHEREAS, as part of the application for 2006 RTIP Augmentation funding, MTC requires any resolution adopted by the responsible implementing agency to state that the project will comply with the procedures specified in Regional Project Funding Delivery Policy i i (MTC Resolution No. 3606, revised, and as may be further amended). NOW, THEREFORE, BE IT RESOLVED, that APPLICANT approves the assurances set forth in Part 2 of the project application, attached to this resolution; and be it further RESOLVED, that APPLICANT will comply with the provisions and requirements of the Regional Project Funding Delivery Policy (MTC Resolution No. 3606, revised, and as may be further amended), that PROJECT will be implemented as described in the complete application and in this resolution and, if approved, for the amount programmed in the MTC federal TIP, and that APPLICANT and PROJECT will comply with the requirements as set forth in the 2006 RTIP Augmentation Policies and Procedures (MTC Resolution No. 3790); and therefore be it further RESOLVED, that APPLICANT has reviewed the project and has adequate staffing resources to deliver and complete the project within the schedule set forth in the RTIP Augmentation project fact and fund sheet of the project application, attached to this resolution; and be it further RESOLVED, that APPLICANT is an eligible sponsor of projects in the State Transportation Improvement Program; and be it further RESOLVED, that APPLICANT is authorized to submit an application for State Transportation Improvement Program funds for PROJECT; and be it further RESOLVED, that there is no legal impediment to APPLICANT making applications for Regional Improvement Program funds; and be it further RESOLVED, that there is no pending or threatened litigation which might in any way adversely affect the proposed PROJECT, or the ability of APPLICANT to deliver such PROJECT; and be it further RESOLVED, that APPLICANT authorizes its Executive Director, Redevelopment Director, or designee to execute and file an application with MTC to program Regional Improvement Program funds into the RTIP, for the projects, purposes and amounts included in the project application attached to this resolution; and be it further RESOLVED, that a copy of this resolution shall be transmitted to MTC in conjunction with the filing of the APPLICANT application referenced herein. Subject: Resolution of Local Support SAFETEA STP/CMAQ Funding authorizing the filing of an application for federal Surface Transportation Program (STP) and/or Congestion Mitigation and Air Quality Improvement (CMAQ) funding and committing the necessary non-federal match and stating the assurance to complete the project. The Board of Directors of the Agency (the "Board") RESOLVES THAT: WHEREAS, the Contra Costa County Redevelopment Agency (herein referred as APPLICANT) is submitting an application to the Metropolitan Transportation Commission (MTC) for $640,377 in funding from the federal Surface Transportation Program (STP) and/or Congestion Mitigation and Air Quality Improvement (CMAQ) program for the Iron Horse Trail Overcrossing of Treat Boulevard (herein referred as PROJECT) for the MTC Transportation for Livable Communities Program 2006 Capital Program (Resolution 3606) (herein referred as PROGRAM); and WHEREAS, the Safe, Accountable, Flexible, Efficient Transportation Equity Act: A Legacy for Users (SAFETEA) (Public Law 109-59, August 10, 2005) continues the Surface Transportation Program (23 U.S.C. § 133) and the Congestion Mitigation and Air Quality Improvement Program (CMAQ) (23 U.S.C. § 149); and WHEREAS, pursuant to SAFETEA, and the regulations promulgated thereunder, eligible project sponsors wishing to receive federal Surface Transportation Program and/or Congestion Mitigation and Air Quality Improvement Program (STP/CMAQ) funds for a project shall submit an application first with the appropriate Metropolitan Planning Organization (MPO), for review and inclusion in the MPO's Transportation Improvement Program (TIP); and WHEREAS, the Metropolitan Transportation Commission (MTC) is the MPO for the nine counties of the San Francisco Bay region; and WHEREAS, MTC has adopted a Regional Project Funding Delivery Policy (MTC Resolution No. 3606, revised) that sets out procedures governing the application and use of STP/CMAQ funds; and WHEREAS, APPLICANT.is an eligible project sponsor for STP/CMAQ funds; and WHEREAS, as part of the application for STP/CMAQ funding, MTC requires a resolution adopted by the responsible implementing agency stating the following: 1) The commitment of necessary local matching funds of at least 11.47%; and 2) That the sponsor understands that the STP/CMAQ funding is fixed at the programmed amount, and therefore any cost increase cannot be expected to be funded with additional STP/CMAQ funds; and 3) That the project will comply with the procedures specified in Regional Project Funding Delivery Policy (MTC Resolution No. 3606, revised); and 4) The assurance of the sponsor to complete the project as described in the application, and if approved, as included in MTC's TIP; and 5) That the project will comply with all the project-specific requirements as set forth in the Transportation for Livable Communities Program. NOW, THEREFORE, BE IT RESOLVED that the Redevelopment Director, on behalf of the Contra Costa County Redevelopment Agency is authorized to execute and file an application for funding under the Surface Transportation Program (STP) and Congestion Mitigation and Air Quality Improvement Program (CMAQ) of SAFETEA for Iron Horse Trail Overcrossing of Treat Boulevard and be it further RESOLVED that the APPLICANT by adopting this resolution does hereby state that: 1. APPLICANT will provide at least $83,213 in non-federal matching funds; and 2. APPLICANT understands that the STP/CMAQ funding for the project is fixed at the MTC approved programmed amount, and that any cost increases must be funded by the APPLICANT from other funds, and that APPLICANT does not expect any cost increases to be funded with additional STP/CMAQ funding; and 3. APPLICANT understands the funding deadlines associated with these funds and will comply with the provisions and requirements of the Regional Project Funding Delivery Policy (MTC Resolution No. 3606, as revised); and 4. PROJECT will be implemented as described in the complete application and in this resolution and, if approved, for the amount programmed in the MTC federal TIP; and 5.
