(District III) (Road Funds) SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION RECOMMENDED ACTION: APPROVE and AUTHORIZE the Public Works Director,or designee,to execute Amendment No. I to an existing Consulting Services Agreement with Nolte Associates Inc. effective February 27, 2007,update Appendix B for the new wage rates for 2007,and to increase the payment limit by$1,235,000 to a new payment limit of$1,335,000 in order to provide engineering services for the Vasco Road Safety Project,Brentwood area. FISCAL IMPACT: This contract amendment allows for an additional$1,235,000(100%Road Funds)above the previously approved contract for $100,000. There is no impact to the General Fund. (District III) (Road Funds) DATE: February 27, 2007 PAGE: 2 of 2 REASONS FOR RECOMMENDATIONS AND BACKGROUND: Public Works Department staff has been working with the Vasco Road Task Force in reviewing safety alternatives to improve Vasco Road over the last several years. The task force was formed due to concern for the public's safety while driving through the Vasco Road corridor. The Vasco Road Task Force developed a number of alternatives, one being the concept of a median barrier on Vasco Road. The Public Works Department had previously contracted with Nolte Associates Inc. (Nolte)for preliminary safety studies in support of the Vasco Road Task Force. Nolte's report titled"Contra Costa County Vasco Road Safety Improvement Study"dated March 17,2005 describes various alternatives for improving safety on Vasco Road. Meanwhile,Public Works had also entered into a consulting services agreement with Nolte for design services and specific engineering expertise in order to meet the design schedules for various County projects on an as needed basis. Staff selected Nolte through the standard consultant selection process of requesting proposals, selecting the top proposals for interviews,interviewing the top candidates,and then entering into an agreement. Considering the fact that Nolte has good knowledge of Vasco Road's existing design through the work on the preliminary studies for the Vasco Road Task Force and that it is important to move forward as quickly as possible, the Public Works Department is recommending that Nolte perform the design work under their existing consulting services agreement. The existing consulting services agreement with Nolte was established in July of 2006. As a part of this amendment we are also updated the rate schedule(Appendix B of the contract)to reflect current 2007 rates. We are also adding a provision in the amendment to the agreement that allows subsequent updates of hourly rates on a once-annual basis in the event that this project extends into 2008. CONSEQUENCES OF NEGATIVE ACTION: If the amendment is not approved, the design of the Vasco Road Safety Project will be delayed. AMENDMENT No. 1 ON-CALL CONSULTING SERVICES AGREEMENT NOLTE ASSOCIATES, INC. 1. Parties: Effective on February 27, 2007, the County of Contra Costa, a political subdivision of the State of California, hereinafter referred to as "Public Agency," and Nolte Associates Inc., hereinafter referred to as "Consultant," mutually agree and promise as follows: A. To increase contract payment limits by $1,235,000. $1,235,000 for the Vasco Road Safety Project, Phase I 2. Purpose: The parties desire to amend the agreement they entered into effective July 11, 2006 entitled "On- Call Civil Engineering Consulting Services Agreement," hereinafter referred to as the "Agreement." The Agreement is to provide design services, engineering analysis and recommendations on an on-call basis for Public Works Design staff. This amendment is necessary to reimburse the Consultant for expected work beyond the original limits of the existing on-call consulting services agreement. 3. Amendment(s) to Agreement: Amend Section 1(e): Agreement Payment Limits to $1,335,000: Design Support Payment Limits to $1,235,000 (Vasco Road Safety Project) Amend Section 8: Allowing Appendix B (wage rates) to be adjusted by Consultant once annually in September (for next fiscal year) to reflect staff rate adjustments to .individual compensation. Such changes shall be equal to consultant's actual changes in hourly rates. Consultant shall provide Public Agency with at least 30 days advanced written notice of the changes. Amend Appendix B: New Wage Rate Schedule for 2007 (attached and valid until Sept: 27, 2007) 4. Remaining Provisions: Except for the changes made by this Amendment, all provisions of the Agreement shall remain in full force and effect. 5.
