FIX Tuesday, February 27, 2007, at 9:30 a.m.,for a hearing before the Board of Supervisors to consider
a report from the Public Works Director regarding the Sidewalk Hazard Abatement Program and DIRECT
the Public Works Department to publish required notices pursuant to California Streets and Highways

To fix a hearing date for the Board of Supervisor to consider a report by the Public Works Director regarding the
Sidewalk Hazard Abatement Program.

There will be no hearing to consider the Public Works Director's report regarding the Sidewalk Hazard Abatement
Program.

Consider the report filed with flus Board by die Public Works Director specifying that sidewalk repairs fronting
multiple parcels of real property have been made costing a total of 545,000 and proposing that this Board
approve an assessment be levied against each parcel of real property for the cost of the sidewalk repairs made
fronting each parcel of real property listed in the report(including property tax roll collection fee and release of
lien fee),that the lien be turned over to the Assessor and Tax Collector so that die assessment can be added
to the next regular bill for taxes levied against said properties, and indicating that timely notice of a hearing on
this date before this Board was provided to the real property owners listed in the report in the nhannerrequiredby
law.

At die time this form was prepared there were approximately 17 property o«nhers who have not paidthe
Public Works Deparhnent after being invoiced for the sidewalk repairs made fronting theirproperty,and
whose property we will be asking die Board to make an assessment against to reimburse the Department
for die sidewalk repairs made. As required by Chapter 22,Section 5616 of the California Streets,and
Highways (S&H) Code, at the hearing each of the property owners shall have the opportwhity to
express their objections or protest's for the assessment for the cost of the sidewalk repairs being levied
against their property. It is difficult to say how many of the 17 property owlners.will show an interest and
be at the hearing. In fact, once they have received the hearing notification for'assessment against their
property the property owners may all pay up.
2. Is it controversial'? Yes X It could be. No
3. Noticing Requirenhents: Yes.
Code Section: Chapter 22, Section 5616 of the S&H Code.
4. Publication Requirements: Not required. As require by Section 5616 of the S&H Code,
the property owners involved with this hearing are to be notified by mail and property posting.
5. Who is to publish the Notice? The notice does not have to be published. The propertyowners eitherhave
to be noticed with two mailed letters or a mailed letter and a property posting. The Public Works
Departinent will handle the property owner noticing.
6. If posting of notice is required, who will post'? The Public Works Departnhent'will post.
7. If mailing the notice is required, who will provide the clerk Nvith the correct mailing list and labels? The
mailed notices will go out to the property owners through the Public Works Department. The clerk
doesn't have to deal with it.
8. When will this "fix hearing item"be listed on the Board agenda as a consent item?

Attached is a copy of the Hearing Confirmation Form for the hearing I have requested for
Tuesday, February 27, 2007.
At the hearing we will be asking the Board to consider a report by the Public Works Director
(Henry Finch to make the presentation) specifying that sidewalk repairs fronting multiple parcels
of real property have been made costing a total of $45,000 and proposing that the Board of
Supervisors approve an assessment be levied against each parcel of real property for the cost of
the sidewalk repairs made fronting each parcel of real property listed in the report (including
property tax roll collection fee and release of lien fee), that the lien be turned over to the
Assessor and Tax Collector so that the assessment can be added to'the next regular bill for
taxes levied against said properties.
