Piepho, Chair of the Board of Supervisors, invited the public to speak. The following persons presented testimony: • Charles Evans, Richmond. Informing the Board of his civil rights and he feels they are not responding to his complaints. • Dee Dee Ferro, Bay Point. Neighborhood Traffic Management, belongs to a local group known as ACORN. • Rollie Katz, Business Manager, PEU, Local 1. Mr. Katz urging the Board take urgency action to allow temporary employees be allowed to vote. The following persons submitted comments via e-mail: Mr. Michael F. Sarabia,unknown location. Mr. Sarabia is very unhappy and concerned about Delta water run-off and the amount of salinity being allowed up river. O Ms. Gloria Ettling,El Sobrante. Requests a copy of ordinance pertaining to both outside and inside gas shut-off valves. I have strived to be respectful and timely on each occasion. My history of interaction with this board, despite my attempts to disengage, seems " destined to be consumed with indifference, disrespect and continued and varied yA violations of my rights and those of my family. If this board had taken the time to offer me more than indifference and\or arbitrary, discriminatory policy responses I would be in Oakland performing my official duties as tl; an employee for the Federal Government. My duties as a federal official directly affect the ability of more than 500 other federal employees to complete their work. Having to come here on a regular basis to defend my most basic rights is becoming an overwhelming task that puts an unreasonable burden on the limited resources that are available to me. It has become clear to me that this body has absolutely no interest in protecting my rights as a United States citizen and is quite comfortable in intentionally and willfully violating my rights anytime it desires. My complaints against this body have grown substantially over a relatively short period of direct interaction.My specific complaint currently is as follows: On January 23, 2007 was exercising my 1"Amendment rights under the United States Constititution. • My ability to exercise my rights was unreasonably and disrespectfully interrupted. • I was denied the due process allowed by the relevant state laws regarding free speech in this forum.. • I was forced to endure a policy which afforded me the following process: o Three minute maximum time limit regardless of any other considerations. o Opportunity to submit additional comments in writing if. o Face more drastic measures if upon disagreement to the unlawful policy. Please respond to this compliant according to your local procedures. East Contra Costa. Times Headline, Jan. 1: "Plan to get more out of Delta denied" - Sub-headline: "Agency that protects fish rejects permits for tide gates that state planned to build before seeking OK for increased capacity. " This was good news and I thought your voices in defense of our regional Delta water had been heard. But, the headline on Feb. 8: "Delta study revives canal idea" - "Report outlines options to balance state's drinking water needs against weakened ecosystem. " A detailed reading showed a poorly supported or illogical arguments. The .source of confusion may originate on the implications of the word "salinity" . A Project Manager of our local Water Agency spent about an hour carefully discussing with me, alone, the issue. When she mentioned "salinity", I thought of the natural salinity of Ocean waters. I asked, specifically, about the use of Tidal Gates designed to obstruct the lighter density saline waters but, she clearly dismissed this. Further discussion revealed that she was speaking of "salinity" in the sense of "salts and bromide" compounds found coming down the river, from pesticides and fertilzer run-off, .and not the ocean salts (salinity) going up-river with the Ocean tides. - Two details seem proper at this. point: First, The "Experts" recommended that -there would be no damage in the ecosystem in Mono Lake if the water level was reduced. After much litigation, the "Experts" finally admitted there was major and increasing damage due to "salinity" and Millions. of dollars had to be spend to undo damage. Second, The "Experts". convinced those in charge that delaying; by months, the water diversion from the big Delta water pumps would restore the Smelt fish population. But, the result was the opposite. The Smelt fish, a .significant small initial step in the food chain may soon disappear, with harmful consequences of unknown magnitude. The point of re-hashing this old. history is to point out that the evidence shows that our "Experts" seem to, evidently, know less than they think. This is not the first time, nor the last time, an "Expert" learns, if he, or she, has enough humility to admit the truth, and becomes a better professional but nobody is immune. History shows many examples where this happens and our. last, and only, hope is the "Non-Expert" Officials to put a stop to their mistakes. Someone wrote, long ago, "every President has a Bay of Pigs. " All experts, at one time, "exaggerate", cross the boundary in which an "Established Rule" applies and takes it too far, into a situation where that "Established Rule" does not apply, due to factors not yet discovered and understood -or unaware. The fact that the headlines of 1 January and 8 February seem contradictory does not speak well of the expertise of the decision makers, or writers of the press release. In sum, the idea of reducing the flow of clean water into the Delta, with the Peripheral Canal, 'will, beyond reasonable doubt, reduce the flushing action of the water in the Delta. Not recommended at home. To, allegedly, allow the Ocean tides to come in and clean the Delta is contrary to the Law of Gravity, it would require salt water pumping to do that -nobody suggested doing that! But, it is true that by reducing the flow of river water, the ocean salinity, and the overbite Asian crab, will. move upstream with, this time, predictable damaging consequences: The Asian crab may contribute, if not the key, for the decline in Smelt fish population. I read the reports on Mono Lake, and was there, it is with some trepidation that I bring this subject but, it appears that one result of less flushing. action in the Delta may, or may riot, bring an aroma that will hang over the Delta and, not only kill the tourist industry, but, in effect, evict Delta residents. When this effect becomes evident, the stench may drive voters to retaliate, but this will not happen for many years. A better solution: It is known that the problem with Delta water is the farming and urban runoff. It is unhealthy for the Smelt fish to live in this cocktail of chemicals which may, or may not, be killing them: Stop the runoff! Farmers can farm without runoff, some do already, or sell their water rights to Los Angeles. Once the runoff ends, there is no, known, reason for the water to be unhealthy. The 29 Million Californians that depend on .Delta water will not have to drink the cocktail of chemicals that may be killing our "canary" Smelt Fish. One of this chemicals in our Delta water attacks the central nervous systems with as yet unmeasured impact on: Autism, Parkinson's, Retardation, Alzheimer's, and who-knows-what-else. In addition to all the "salts and bromides" in the runoff, cities must add additional chemicals to make the water "taste better and smell less" and some of these chemicals contain, albeit heavily diluted, Chlorine, a highly reactive poison with, most probably, no long-term studies on its effect on bones, brain and nerves have been made with humans -it would be inhuman. <ccOftontra.napanet.
