BOARD OF SUPERVISORS FROM: STEVE WEIR, County Clerk-Recorder , ;, Costa DATE: February 13, 2007 County sT'4 C---- Co(,�nt�/ SUBJECT: APPROVE and AUTHORIZE the Clerk-Recorder to execute an addendum to the Memorandum of Understanding with the Dept. of Justice for Electronic Recording program oversight. SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION RECOMMENDED ACTION: APPROVE AND AUTHORIZE the Clerk-Recorder, or designee, to execute an addendum to the Memorandum of Understanding with the Department of Justice for County participation in the Electronic Recording Delivery System program. The addendum is for the period July 1, 2006 through June 30, 2007. FINANCIAL IMPACT: There is no impact to the County General Fund for this program. It will be funded by dedicated Recorder Modernization Trust Fund monies. The cost is determined annually based on the number of Real Property documents recorded in the previous year. Contra Costa's share for FY 2006/07 is $32,931. REASONS FOR RECOMMENDATION/BACKGROUND: On November 1, 2005, the Board approved and authorized the Clerk-Recorder to participate in this program and to enter into a Memorandum of Understanding with the A.G. for oversight of the program. This program will enable the County to improve and modernize its systems of recording and handling Real Property documents by electronically receiving documents from trusted and contracted agencies. This will improve efficiency and increase service delivery to county residents. AB 578, GC 27393 requires the Attorney General to develop regulations for review, approval and oversight of the California Electronic Recording Delivery Program. Govt. Code 27397 requires any county that establishes an electronic recording system to pay the Attorney General for the cost of regulation and oversight of the program. This Memorandum of Understanding permits Contra Costa to pay the Attorney General each year for its proportionate cost of developing and implementing the California Electronic Recording Delivery Program. CONSEQUENCES OF NEGATIVE ACTION: Service to residents will not improve if Contra Costa does not participate in the California Electronic Recording Delivery Program.
