SUBJECT: NAVY MITIGATION FUND AND THE GREAT CALIFORNIA DELTA TRAIL,CLYDE,BAY
POINT AND EAST COUNTY AREAS. (DISTRICTS IV & V)
SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION
RECOMMENDED ACTION:
1. ACCEPT report on the Navy Mitigation Fund and funding opportunities for the "Great California Delta
Trail"; and
2. DIRECT the Public Works Director and Community Development Director to work with Districts 4 and 5 to
conduct a public process to review the expenditure plan for the Navy Mitigation Fund and develop a
recommendation for approval by the Board of Supervisors on a revised expenditure plan.

REASONS FOR RECOMMENDATIONS AND BACKGROUND:
At the October 31, 2006 meeting of the Board of Supervisors, the Board directed Public Works, Community
Development and County Counsel to explore funding for the planning and construction of the "Great California
Delta Trail"in Contra Costa County and to investigate the use of the Navy Mitigation Fund for this purpose and to
report back to the Board of Supervisors at a meeting in February 2007.
In September 2006, Governor Schwarzenegger signed SB 1556 (Torlakson) into law, creating the concept of the
"Great California Delta Trail,"which would begin at the San Francisco Bay Trail's terminus in Martinez and circle
through the Delta region to Sacramento.The Contra Costa County Board of Supervisors voted in 2006 to support SB
1556 and the concept of the Great California Delta Trail.
Funding for planning,design and construction is needed to make the"Great California Delta Trail"a reality and the
question of whether the Navy Mitigation Fund could be used for this purpose has been raised.
In 1989,the Board of Supervisors agreed to vacate a portion of the Port Chicago Highway within the boundaries of
the Concord Naval Weapons Station, at the request of the U.S.Navy. The County secured a$5 million mitigation
fund from the U.S.Navy to offset the impact of the Highway's closure and the loss of this major Central-East county
road artery for vehicular, bicycle and pedestrian traffic.
Of the original$5 million Navy Mitigation Fund,$1 million was allocated by the Board of Supervisors for bike and
pedestrian trails and$4 million was allocated for roads.Two funds were established,one for trails and one for road
purposes and the Board of Supervisors adopted an expenditure plan for each fund.Interest earned was to be used for
the purposes of the respective accounts. $1,059,663 of the trail fund was expended on projects identified in the
expenditure plan,but with interest accrued there is a remaining balance of$630,000. The Road portion of the fund
was allocated to a surface road project to complete the frontage road system along Highway 4. The Public Works
Department has developed some alternative projects including the Evora Road Gap Closure to serve this purpose.
However, community consensus for a project has not materialized as yet and very little of the road portion of the
fund has been expended. With the interest accrued, there is a balance of$7.5 million in the fund.
Public Works,Community Development and County Counsel have reviewed the documents pertaining to the closure
of Port Chicago Highway and the establishment of the Navy Mitigation Fund, including the agreements with the
Navy and the CEQA documents.Based on this review the determination is that the expenditure plan for the funds is
at the discretion of the Board.However,there should be a nexus between the source of the funds and the use and that
the funds should be used in the vicinity of the closure between the communities of Clyde and Bay Point. Public
Works and Community Development are working with Districts 4 and 5 to conduct a public outreach to review the
expenditure plan and receive input on the priorities for the funds.
Based on public input and working with Districts 4 and 5,a revised expenditure plan will be developed for approval
by the Board of Supervisors. Some of the issues that will be considered in the development of a revised expenditure
plan include:

• Evora Road is part of the County's General Plan and completing the frontage road system along
Highway 4 is an important transportation project. Diverting these funds to other uses will make it
more difficult to deliver a project to complete the frontage road along Highway 4.
• There are many transportation needs, both road and non road, in the Bay Point and Clyde
communities.
• There is a desire to fund development of the"Great California Delta Trail"
CONSEQUENCES OF NEGATIVE ACTION
A new expenditure plan will not be developed for the Navy Mitigation Funds.
