FISCAL IMPACT: . None. The appellant has paid the appeal fee of$125.00 and staff time and material costs are covered by the Land Development Fund. III. BACKGROUND: This matter stems from the processing of an application for a small lot review for a new residence. The zoning ordinance requires that an applicant proposing development on a parcel that is substandard with respect to either lot area or lot width standards of the zoning district is required to first obtain approval of a (small lot) design review. In September of 2006, Mr. Ahmed, owner of a vacant lot zoned Heavy Agricultural, (A-3)at 2265 Sunset Road in the Knightsen area, submitted an application for small lot review to obtain building permits for the construction of a new 16,000 square foot, two-story single family residence, County File Z10611539B. The original interior floor plans appeared to be arranged in a manner that provided four separate independent living areas and each designed with separate exterior access doors. Each area.was fully equipped with kitchen (labeled pantry), living, office, utility and bath rooms on. the first floor and a master bedroom and bath, plus two additional bedrooms/baths on the second floor. The second floor was also divided into two non- contiguous areas. Considering the size, separation and layout of the first and second floor plans this proposed residence appeared to be a four unit multiple-family residence. To ensure the house was not multiple-family in nature the following interior changes were made. • Removing the separate exterior doors (to each living area) • Removing the multiple kitchen areas (labeled pantry) • Connecting the second floor • Removing all interior rooms from two of the livings areas (eliminating bedrooms, bathrooms, utility and kitchens) • Removing the kitchens from the two other living areas and converting the bedrooms in these areas to an office and media room • Requiring review of the plumbing and electrical plans prior to issuance of building permits With the changes incorporated into the revised site plans, staff continued processing the small lot design review application. It should be noted that although a number of interior changes were made, the exterior of the structure remains generally unchanged. November 6, 2007 Board of Supervisors Appeal of Zoning Administrator Administrative Determination (Ahmed Parcel) File#Z106-115398 Page 3 1. Small Lot Review Application The revised floor plans eliminates the four quad design and all kitchen areas with the exception of the primary kitchen. The processing of a small lot design review continued. A notice was sent to all property owners within 300 feet as is the practice with the small lot design review application. No requests for a hearing were timely filed. 2. Appeal of Zoning Administrator Administrative Decision Accepting that Residence Meets Zoning Standards The Community Development Department sent a letter on July 3, 2007 formalizing. the determination that the revised site plans, dated April 12, 2007,are in compliance with zoning standards and constitutes a single family residence. This is contingent upon review and approval of the plumbing and electrical details prior to the issuance of building permits. An adjacent resident, Kevin Dutt, filed an appeal of that decision in a letter dated July 26, 2007. The appeal was timely filed.in accordance with County Code §14- 4.004. Exhibit A is a chronological list of events that pertain to this application. IV. REVIEW OF APPEAL POINTS: Listed below is a summary of the appeal points from the appeal and staffs response. Dutt Appeal 1. Summary of Appeal Point: The proposed building is not a single family structure. Staff Response: The April 12, 2007 site plans have been revised to comply with all zoning standards. The Zoning Administrator determined that the removal of the multiple pantry areas and the four potentially independent living quads was sufficient to comply with the zoning standards. The appellant has not submitted any evidence to substantiate his statement that it is not a single family building. 2. Summary of Appeal Point: The proposed building has not been reviewed by the local Covenants, Codes and Restrictions (CC& R's) Board. Staff Response: The County's permitting process is not subject to the Architectural Review Committee Approval as this is a civil matter. However, Mr. Ahmed does November 6, 2007 Board of Supervisors Appeal of Zoning Administrator Administrative Determination (Ahmed Parcel) File#Z106-11539B Page 4 have approval from this Architectural Review Committee, see attachment "B". 3. Summary of Appeal Point: The design of the proposed building does not conform to the neighborhood. Staff Response: A small lot review notice was distributed with an opportunity to request a public hearing. At that time anyone could have requested a public hearing to discuss concerns with size, height, location or design and discuss the compatibility of the proposed house with the surrounding neighborhood. Since no one requested a public hearing,the small lot review was approved by the Zoning Administrator as is the practice of the Department. This appeal is of the Zoning Administrator's determination that the building is a single family house and the conformance to the neighborhood is not germane to this appeal since the period in which to request a hearing related to the small lot design review has expired. 4. Summary of Appeal Points 4 & 5: The proposed building will impact the water table levels and has a huge septic system. Staff Response: The appellant may feel that there is an impact to the water table and that the house has a large septic system, but the appellant does not offer any substantial evidence how this affects whether the building itself is a single family residence. Mr. Ahmed is required to comply with all Contra Costa County Environmental Health Department standards for a septic system and water supply. 5. Summary of Appeal Point 6& 7:All neighbors were not contacted and the majority of neighbors are upset and don't want this proposed building. Staff Response: The small lot notice requires all property owners within 300 feet (measured from the outside property line of the subject site)be notified of the project and be given an opportunity to request a public hearing. This list included the appellant and is attached; refer to Exhibit"C" Notice of Public Hearing. The notice' was sent out on June 27, 2007 stating that the last day to request a public hearing was by 5:00 p.m. July 9, 2007. Exhibit"D" attached has eight letters signed by neighbors who are in support of the project as designed. This disclaims the notion that neighbors do not want this proposed building. 6. Summary of Appeal Point: The access is proposed from the Quail Trail easement. Staff Response: Access from Quail Trail is not relevant to whether or not the proposed building is a single family residence. However, staff can find no evidence November 6, 2007 Board of Supervisors Appeal of Zoning Administrator Administrative Determination (Ahmed Parcel) File#Z106-115398 Page 5 (deeds, licenses or other restrictions) that restrict Mr. Ahmed's use of Quail Trail. 7. SummaryofAppeal Point: The proposed building faces the wrong way compared to existing house on Sunset Road. Staff Response: See Staff Response to Appeal Point#3. 8. Summary of Appeal Point: The building is being built under the veil of a single family house but is a multiple family building. Staff Response: The appellant does not provide any evidence to support this statement. V. CONCLUSION The comments of the appellant constitute observations and opinions. The comments do not provide any substantial evidence that the proposed building is something other than a single family residence. Staff recommends that the Board uphold the Zoning Administrator's decision that the proposed building is a single family residence. Ms. Kutsuris said that upon review of the appeal, staff did not find merit and recommends denial of the appeal. Chair Piepho opened the hearing and called for testimony from the applicant and appellants. The following people spoke on behalf of the appellant, Kevin Dutt: Mr. Duff , appellant, reiterated his appeal points including his opinion that the proposed home does not conform to the neighborhood because of its much greater size and height, that it does not seem to be intended to be a single family.structure and the septic system and leach field requirements. He also said that being directly across the street, he would be the most impacted. Sara Dutt echoed the concerns of Kevin Dutt. The following people spoke on behalf of the applicant,Naveed Ahmed: Ilene Dick, Farrella Braun & Martel, LLP, representing the applicant, said she believes staff made the correct determinations regarding the single-family designation and that the amount of lot coverage (.02 percent) of the structure was appropriate for the zoning. She said that septic system construction would be in compliance to code in regard to the septic system. Ms Dick clarified that the building is actually . 28.95 feet in height,the cupola bringing the measurement to 32 feet in height. Naveed Ahmed, applicant, requested that the Board deny the appeal. He also said that statements that he intends to move his extended family from overseas into the home are fabrications. Chair Piepho asked for clarification from staff regarding the regulations on height of the structure, the size of the garage and the leach field, and the continuity of area home styles. Ms. Kutsuris said that either height was acceptable in the zone. She said that while the garage was large, there was no evidence to suggest commercial use and the size of the garage is not grounds to find the structure to be other than a single family home. She also said the lot was in a class C flood zone, which has no special restriction or changes required, and the septic system would be required to comply with environmental services regulations. She further noted that the property is in an area where larger structures are the trend, and there is no maximum size limit. Chair Piepho called for public comment on the matter. There were no requests to speak. She closed the public hearing and returned the matter to the Board, recognizing that several letters had been received in support of the project. She asked Ms. Kutsuris to address concerns about add-ons or second dwellings on the property. Ms. Kutsuris said that Mr. Ahmed's lot is designated substandard. She said he would be required to have his property rezoned from A-3 to A-2 (minimum lot size 10 acres) to build a second structure. If he did purchase an additional half acre to bring his property to ten acres he could request a rezoning and a small-lot review would not be required. She said there was no indication this property is being situated for future division. February 26, 2007: Community Development Department Staff Issue a Letter Accepting the Revisions with Three Conditions of Approval —The three conditions of approval include:. • residence and garage must be one integrated structure • property owner to submit a statement of intended use A-2 • property owner shall record a statement to run with the deed_indicating that the development of the property is single family residential May 7, 2007: Applicant Submits Revised Plans and Objects to Third Condition The applicant submits revised plans dated April 12, 2007 but does not agree with the condition to record a deed restriction indicating the development of the property is to be strictly single-family in nature. May 21, 2007: Owner Submits a Letter Requesting the Third Condition be Eliminated — This letter states why the home should be considered a single family.residence. It also provides a chronology of the events occurring to date that includes attachments. June 27, 2007: Community Development Department Issues Notice of Opportunity to Request a Public Hearing "Small Lot Design Review" —The notice states the owner's intent to construct a single family residence. No request for a public hearing was timely filed. July 3, 2007: Community Development Department Issues a Letter Determining the Plans of April 12, 2007 Constitute a Single Family Residence —A letter issued by the Deputy Director (Zoning Administrator) of the Community Development Department recognized that the original plans were not single family residential in nature. However, the changes to floor plans (elimination of pantries and four separate quads) dated April 12, 2007 is sufficient in determining that this building is a single family residence. July 26, 2007: Appeal of the Zoning Administrator's Administrative Decision Affirming that the Building is a Single Family Residence —A neighbor of the subject property, Kevin Dutt (property owner of 2225 Sunset Road), filed an appeal with the County of the Deputy Director's (Zoning Administrator's) administrative decision accepting the April 12, 2007 plans as a single family residence. Mr. Ahmed has been working on designing his dream home from the time he purchased this .vacant 10 acre parcel in 2004. He and his architect, David Kesler, worked diligently with Community Development Department (CCD) staff to resolve CCD's concerns about whether the proposed home was a single-family dwelling under the County Code. After CCD staff issued the July 3, 2007 letter of approval (Attachment A), Mr. Ahmed met with many individual neighbors and their families about the plans for his home. He discussed with each of them the details of his project, shared with them his plans and listened . to any of their concerns. None were expressed. Asa result,Mr. Ahmed received 9 letters of support from adjacent property owners. (Attachment B.) Mr. Ahmed also has the required letter of approval from the Architectural Control Committee of the Knightsen Airpark subdivision, as required by that development's CC&Rs. (Attachment C.) In light of the unconditional support Mr. Ahmed received from almost all of his neighbors, imagine his surprise when, on July 26, 2007, Mr..Kevin Dutt, who is not even a resident of the Knightsen Airpark neighborhood, filed an appeal. I will refute all the reasons he gives for the Board to uphold his appeal below. However, I would like to note at the outset that while Mr. Ahmed respects Mr. Dutt's right to appeal the CCD staff's decision,we do not believe that his Appeal Letter Item#10 should be considered at all in the Board's deliberations. It states that"[w]e don't want a multiple family structure being built under the veil of a single-family building. His intent is to move everybody "family" from overseas to live here!"Not only is that September 11, 2007 Page 2. statement xenophobic and intolerant, as you well know, it has nothing whatsoever to do with whether CCD's decision about the status of Mr. Ahmed's home is correct or with any other planning or land use consideration. Significantly, contrary to Mr. Dutt's assertion that Mr. Ahmed did not meet with his neighbors, Mr. Ahmed did meet with Mr. Dutt after he filed this appeal. Unfortunately, after much discussion, Mr. Ahmed was unable to reasonably satisfy Mr. Duff's concerns. Based on the facts preceding issuance of the July 3, 2007 letter of approval and the reasons articulated by Current Planning Deputy Director Catherine Kutsuris' in that letter, Mr. Dutt's appeal should be denied. FACTS The only issue on appeal is whether the CCD staff s determination is correct. The CCD staff s letter and this appeal concern only whether Mr. Ahmed's home.is a single-family dwelling under the Contra Costa Zoning Code=nothing more and nothing less. In order to assess the appeal, it is necessary to be clear about what is a single-family dwelling under the A-3 zoning district in which this property is located. Under Zoning Code § 84-38.402 (4), Mr. Ahmed can have as of right"a detached single- family dwelling on each parcel and the accessory structures and uses normally auxiliary to it." The Zoning Code defines a single-family dwelling to be a"one-family dwelling" or a"detached building or part of it, designed for occupation as the residence of one family." Zoning Code § 82-4.258. A family is"(1.) Individual; or(2) Two or more persons related by blood. marriage, or legal adoption; or(3)A group of not more than five persons, excluding servants, who are not related by blood, marriage or legal adoption, living together as a single nonprofit housekeeping unit in a dwelling unit as distinguished from a hotel,club, fraternity or sorority house, dormitory or boardinghouse." Zoning Code § 82-4.236. The County subdivision ordinance follows that principle by defining a `dwelling unit' as "a building or a portion thereof, or a mobile home, designed for residential occupation by one person or a group of two or more persons living toiether as a domestic unit." Subdivision Code § 92-4.020. (Emphases added.) As is.clear from the plain language of the relevant County Codes, nowhere in the County's own Codes is there a definition,principle or guidelines that would make what was shown in Mr. Kesler's April 12, 2007 plans and approved by Ms. Kutsuris' letter anything other than what it is intended to be: a single-family dwelling., Given the above code analysis, it is important to note that the issue of whether.Mr. Ahmed's home was a single-family dwelling under the Zoning Code began, not with Mr. Dutt or any other neighbor, but with a February 26,2007 letter from CCD Planner Donna Allen. Ms. Allen found the proposed home to be a single-family structure for purposes of the County Code September 11, 2007 Page 3 only if Mr. Ahmed complied with three conditions: 1. designed the roofline and materials to be one integrated structure; 2. submit a signed statement that his intended use of the structure was for single-family purposes; and, 3. record a deed restriction that the property was solely for single-family use and could not be used by more than one family or for any commercial purpose. (Attachment D.) Mr. Ahmed readily complied with Nos. 1 and 2. It was because he did that he disputed the need for No. 3. Nonetheless, Mr. Ahmed redesigned the structure to address Ms. Allen's concerns. These plans also satisfied Ms. Kutsuris that this was.indeed a single-family dwelling. Her July 3, 2007 letter memorialized her finding. As required by that letter, Mr. Ahmed will submit electrical and plumbing plans consistent with that of a single-family home. Thus, Mr. Ahmed has twice satisfied County staff that his home is and will be used as.a single-family dwelling. First, he complied with Ms. Allen's extraordinary condition that he file a written statement of intended use with his permit application. Second, he redesigned the plans to make crystal clear that this was a single-family dwelling under the Code. Both of these acts by Mr. Ahmed more than adequately demonstrated to CCD staff that this structure would be used as a single-family dwelling under the County Code. THE APPEAL SHOULD BE DENIED. THERE ARE NO FACTS TO SUPPORT IT. ONLY ITEM NO. 1 REFERS TO THE SOLE ISSUE ON APPEAL—THE CCD FINDING THAT MR. AHMED'S HOME IS A SINGLE-FAMILY DWELLING. THE . REMAINDER OF MR. DUTT'S ITEMS ARE BEYOND THE SCOPE OF THE APPEAL. Mr. Dutt disagrees with Ms. Kutsuris' conclusion that Mr. Ahmed's home is a single- family home without stating any facts to support his disagreement. And except for Item No. 1 in his appeal,none of the reasons he gives has anything to do with whether the home is a single- family home or not. Under County Code § 14-4.004, governing administrative appeals such as this, Mr. Dutt has to "state the facts of the case and the grounds for his appeal including his special interest and injury." Yet,the only document we have from Mr. Dutt is his July 26, 2007 handwritten appeal. This document provides no credible facts or articulated reasons to support his one-line objections. His arguments can be reduced to 4 categories: 1. Mr. Ahmed's home is not a single- family home; 2. there are potential water impacts; 3. the siting of the entrance should be changed; and,4. the neighbors do not approve. Mr. Dutt has not and cannot show that he or his. property will be injured by the current plans for Mr. Ahmed's home. His appeal should be denied. September 11,.2007 Page 4 1. Mr. Ahmed's home is a single-family dwelling. It conforms to the zoning and CC&Rs. Ms. Kutsuris found that the April 12, 2007 plans showed a single-family dwelling. Mr. Dutt has simply concluded without any facts or explanation that these plans and Ms. Kutsuris' professional review and evaluation are wrong. Since this home is a single-family dwelling under the-County's application of its own Codes and expertise,by definition it conforms to the .neighborhood of other single-family homes situated on 10 acre lots in the A-3 zoning district. (Appeal Letter, Item No. 3.) Since the Knightsen Airpark subdivision is specifically limited to single-family homes of at least 2,000 square feet, this home also.conforms to the prevailing density and scale of the neighborhood. Since the County's determination is correct,there is no evidence that Mr. Dutt can point to that would make Mr. Ahmed's home non-conforming. 2. The septic system will be sized in accordance with County Environmental Health standards which will ensure no environmental impacts. Mr. Dutt claims that Mr. Ahmed's home will have"impacts to the water table"requiring a"huge" septic system. (Appeal Letter, Item Nos. 4-5.) However, Mr. Ahmed's septic engineer, Tim Johnston of Acorn On-Site, an experienced septic system engineer in Contra Costa County, has concluded that that is not true. According to Mr. Johnston,the septic system will be sized in accordance with the County Environmental Health Department's codes and procedures..As the Board knows, these codes and procedures ensure that the design and operation of the septic system will have no water quality impacts. Mr. Duff's claim that"water table levels"will be impacted is also not true for the same reason. 3. Mr. Ahmed's home is oriented on his 10 acre site to preserve his family's privacy and that of his neighbors, including Mr. Dutt. Mr. Dutt alleges some unstated harm from the siting of this home away from Sunset Road. (Appeal Letter, Item No. 9.) He also asserts, without factual basis, that this home wrongfully "accesses off quail trail [sic] easement". (Appeal Letter, Item No. 8.) Mr. Ahmed situated his home on only .02% of his 10 acre parcel for the common-sense purpose of minimizing his family's discomfort from the traffic noise, fumes and dust from Sunset Road. (Attachment E). There is no design guideline or other requirement that homes near Sunset Road must face the road. Moreover, this site orientation allows the home to meet building code and fire safety access requirements for ingress and egress with the added benefit of maintaining the privacy of Mr. Ahmed's family and that of his neighbors, including Mr. Dutt. As to Mr. Dutt's allegation that Mr. Ahmed will use a"quail trail easement" for access, there are no recorded deeds, licenses or other restrictions to show that there is a prohibition on using this road for Mr. Ahmed's (or anyone's) ingress and egress. The recorded subdivision map also makes clear that Quail Trail is a public road for use by all. Thus, Mr. Dutt suffers no harm September 11, 2007 Page 5 from Mr. Ahmed using Quail Trail for the same purposes as Mr. Dutt or other neighbors might— access to their properties. 4. Notice of the permit was given according to the County Code requirements. Mr. Dutt errs when he says the neighbors were not contacted and the majority of neighbors"are upset and don't want this!" (Appeal Letter Item.Nos. 6 and 7.) First, attached as Attachments A and Bare 9 letters from Mr. Ahmed's neighbors.in Knightsen Airpark and 1from the Architectural Control Committee. Mr. Ahmed satisfied his obligations as a.property owner in Knightsen Airpark when he met with those neighbors and its Architectural Control Committee. Mr. Dutt also complains that not everyone received notice of Ms. Kutsuris' July 3, 2007 letter. However, the County Code that governs appeals of land use decisions requires mailed notice of the pending permit application to owners within a 300-foot radius. Zoning Code § 26- 2.2104. This notice was given by CCD on June 27, 2007. (Attachment.F.) No one who received that letter asked for a hearing on the project. In fact, Mr. Dutt is the only negative response the County has received to Mr. Ahmed's project. CONCLUSION CCD's letter of approval is correct. .The appeal should be denied. The April 12, 2007 plans show that Mr. Ahmed's home is and will be used as a single-family home as defined by the County Code. Mr. Dutt provides no information that makes that decision wrong.
