APPROVE AND AUTHORIZE TERMINATION OF LARGE HANGAR RENTAL AGREEMENTS, MT. DIA.BLO PILOTS ASSOCIATION LEASE, TIE-DOWN RENTAL AGREEMENTS WITH TENANTS AT BUCHANAN FIELD,PACHECO AREA. (District IV). SPECIFIC REQUESTS)OR RECOMMENDATIONS)&BACKGROUND AND JUSTWATION 1. Recommended Action: A. APPROVE and AUTHORIZE the Director of Airports to terminate(1)large hangar rental agreements with each of William P.Ludwig,Raymond Nilson and John Cicero,(2)the tenancy-at-will of Larry Bradley and Bruce Bolla in a large aircraft hangar,(3)the lease of Mt. Diablo Pilots Association for premises and tie-down spaces at Buchanan Field,and(4)twenty-two other tie-down rental agreements specified in Section III,below. B. AUTHORIZE County Counsel to initiate legal action to retake the leased premises if necessary. H. Financial Impact: No financial impact to the County General Fund. All fees collected are deposited into the Airport Enterprise Fund.Termination of the existing tenants will allow development of the vacated premises for a multi-hangar development. DATE: November 6,2007 PAGE: 2 III. Reasons for Recommendations and Background: The County is presently the lessor under large aircraft hangar rental agreements with Raymond Nilson, William P. Ludwig and John Cicero for hangars that are located on the west side of Buchanan field(the "Large Hangar Tenants'). The County was party to a lease agreement dated March 14, 1995 with Mt. Diablo Pilots Association (the "MDPA"), which expired on February 29, 2000, and is now a month-to- month lease. The County also leases tie-down space to the following tenants:Concord Flying Club;Felix Boston, Steve Elefant; Samuel Gilchrist; Beverly Levy; Pete Mitchell; John L. Potter, Keith Ritthaler; Russell Roe;Virginia Schaefer;David Shepard;Johannes L.Verhoek;Malcolm Wright;Manley Ormsby; Larry Bradley; Chris Rampoldt, Bill Ludwig, Albert Bradley, Gary Byer, Chester Robbins j Andre Ptaszynski,and Gary Guthrie(the"Tie-Down Tenants"). The County previously permitted Milan Haven to hangar his aircraft at Buchanan Field pursuant to a Permit for Hangar Space. Mr.Haven is deceased and his hangar space has been rented by his former associates Bruce Bolla and Larry Bradley who are tenants-at-will in the hangar space(the"Tenants-at-Will,"and together with the Large Hangar Tenants,the MDPA and the Tie-Down Tenants, the"Parcel Tenants"). All of the Parcel Tenants are tenants at Buchanan Field on a month-to-month basis and have tenancies subject to termination with thirty days notice from the County. Each of the Parcel Tenants rent space on approximately 10.5 acres adjacent to Marsh Drive at Buchanan Field (the "Parcel"). The County is negotiating lease and development terms with CCR Hangars I, sponsored by the Aviation Development Group("ADG"), for development of the Parcel and anticipates requesting the Board's authorization to lease the Parcel to CCR Hangars I for development in December 2007. In order for the Parcel to be leased to and developed by CCR Hangars I,the Parcel Tenants must be provided thirty(30) days notice of termination of their rental agreements in order that they can vacate the Parcel in advance of it being leased to CCR Hangars I. f IV. Conseauences of Negative Action: i Delay in authorizing and approving termination of the Parcel Tenants rental agreements will prevent the County from entering into a lease with ADG for development of the Parcel and delay rental income to the Airport Enterprise Fund and increased possessory interest tax revenue to the County general fund. i 1
