FISCAL IMPACT No Impact to the General Fund. Franchise fees, which are calculated based on percentage of revenue received from customers, are collected by Garaventa Enterprises and paid to the Community Development Department as required under the County's Franchise Agreement. Franchise fee revenue is used by the Community Development Department to oversee the franchise agreement and implement programs to comply with the Integrated Waste Management Act. Amending the area served by Garaventa Enterprises as recommended will slightly reduce the number of customers served and the amount of franchise fee revenue collected. The reduction of franchise fee revenue is not anticipated to be significant. Under the Franchise Agreement, Garaventa Enterprises (contractor) agreed that public agency boundaries may be altered by virtue of actions taken by the Contra Costa County Local Agency Formation Commission (LAFCO). Under the agreement, the "County may make such alterations to the Franchise Area as the annexations necessitates" (see Section 33 from the franchise shown in Exhibit A). The City of Brentwood has requested that the County amend the Franchise Area boundaries to reflect the recent annexations by Brentwood known as "Hanson Ranch Annexation" (LAFC 06-25). The letter from the City of Brentwood including the LAFCO certificates of completion for the annexation is attached as Exhibit B. Staff recommends the Board amend the boundaries of the area served by Garaventa Enterprises to reflect the above-mentioned annexation. Staff will subsequently notify Garaventa Enterprises of the change in boundaries of their service area. .( 3 ) If. in any proceeding to which Contractor. is a party, a Receiver d s appointed with authority to take possession of Contractor' s property such that .would affect Contractor ' s ability to perform its duties and obligations under this Agreement. (4 ) Except as otherwise provided in Section 31 (Assignability) , in the event of a probate proceeding where the rights of Contractor under the Agreement would pass to another individual or other individuals . 32 . NOTICE PROVISIONS . ANNEXATION AND CHANGE OF FRANCHISE AREA BOUNDARIES. Contractor shall give notice to County by January 30 of the next calendar year of any geographic area in the Franchise Area or immediately contiguous to the Franchise Area, in which Contractor has commenced service within the preceding year, notwithstanding whether Contractor deems that area to be regulated or unregulated. ' Contractor realizes that the public agency boundaries may. be altered by virtue of actions taken by the Contra Costa County Local Agency Farmation Commission (LAFCO) . Contractor agrees that should a municipal corporation lawfully annex territory which is within the Franchise Area, County may make such alterations to the Franchise Area as the annexation necessitates . Should the Franchise Area boundaries be amended, Contractor agrees that it will abide by any change resulting from the Franchise Area change . Contractor agrees that the Board of Supervisors may make such alterations to the Franchise Area as are necessitated by such Local Agency Formation Commission actions and shall have no right or claim to damages or other relief .against the County for such alterations to the Franchise Area. However, nothing herein is intended to abrogate Contractor' s rights under Public Resources Code Section 49520 or any successor or similar statute. The City of Brentwood provides its own refuse and recycling services to its jurisdiction. The County areas around the City have refuse and recycling services provided for under the above mentioned franchise agreement. The City of Brentwood's boundaries have been changed due to a recent annexation, affecting the boundaries of your franchise with Garaventa Enterprises. The description of the most recent annexation is "Hanson Ranch Annexation" (LAFC 06-25). The City requests the County to amend the boundaries defined in the current agreement of the franchise to represent the current City boundaries and take appropriate action to relinquish its jurisdiction areas recently incorporated into the City of Brentwood. This policy was modified in August 2003 to incorporate a standardized PLA format, eliminate the core workforce , provision,and clarify that the$1 million threshold applies to the actual construction cost of a project, not simply the estimated-construction cost. The Board of Supervisors directed the County Administrator (CAO)to report to the Internal Operations Committee(IOC)in one year regarding the County's experience implementing and administering the PLA policy,and the CAO has been reporting periodically to the IOC since that time. At its October 15,2007 meeting,the IOC met with staff from the County Administrator's Office, and General Services and Public Works departments to review those construction projects that have met the PLA criteria since the September 2006 PLA update report,to assess the impact of the policy. Since the 2006 report,only the General Services Department(GSD)had projects—five in number--that were subject to the PLA Policy. The GSD reported no negative impacts to project costs or schedules. Of the 91 bids received on the 5 projects,union contractors submitted 80 bids,non-union contractors submitted 3 bids; and 8 bids were non-responsive. The County received multiple bids on all but one of the five projects, and the single bid was within 3%of the architect's cost estimate. This evidence suggests that the PLA policy is not negatively impacting competition. The PLA policy requires the County to award a project to the lowest responsive and responsible bidder. All five GSD projects were awarded to union contractors. Bids ranged from 13'/z%below to I0'/z% above architects cost.estimates. No wage violations or disputes were reported on any of the 25 PLAs relating to the 5 projects. This evidence suggests that the PLA policy is not negatively impacting project costs or schedules. Uilkema FROM: Jason Crapo Senior Deputy County Administrator SUBJECT: ' PROJECT LABOR AGREEMENT POLICY UPDATE Background On January 15, 2002,the Board of Supervisors adopted a policy requiring Project Labor Agreements (PLAs) on all County construction projects exceeding $1 million. In August 2003,this policy was revised to clarify that the $1 million threshold applies to the construction contract awarded, not the estimated cost at the time of bidding. Since the inception of the County's PLA policy,the County Administrator's Office has provided periodic reports to the Internal Operations Committee concerning the County's experience with implementation of the policy. The last update was provided in September 2006. The County has implemented the PLA policy with little disruption and with no identifiable impact on the cost or schedule for the delivery of capital projects. With over five years of experience since the PLA policy was created, PLAs have become an established aspect of the County's capital project delivery process. As PLAs have become a routine aspect of County capital projects, staff recommends that the IO Committee defer future reporting on this topic until interest arises in further examination or amendment of existing policy. Current Status Since the last report, the County has utilized PLAs on 5 additional projects, all managed by the General Services Department (GSD). Attached is a report from GSD concerning the department's recent experience with PLAs. Since the County's PLA policy was established in 2002, GSD has utilized PLAs on 10 capital projects and the Public Works Department has utilized PLAs on 2 projects (none within the past year). Neither department has reported any significant disruptions or negative impacts associated with the use of PLAs. Public Works reports that prior to the award of construction contracts, some additional time may be required educating contractors on the PLA process if they have not utilized PLAs on previous projects. Anecdotally,both Public Works and GSD report that some contactors indicate a reluctance to bid on County construction projects due to PLA requirements. However, the County continues to receive bids for construction projects that are generally consistent with cost estimates prepared prior to the bidding process. The use of PLAs has resulted in no identifiable negative impacts on'the overall cost or schedule for the delivery of County capital projects. Lango, Director of General Services SUBJECT: PROJECT LABOR AGREEMENT REPORT (SEPTEMBER 2006—SEPTEMBER 2007) BACKGROUND This report summarizes our experience with implementing and administering the County's Project Labor Agreement (PLA)policy. The policy was initially adopted by the Board of Supervisors in January 2002 and later revised in August 2003. At the time of adoption, the Board directed that an annual report of the PLA program be prepared and presented to the Internal Operations Committee. This report is provided to you for that purpose. SUMMARY OF PLA PROJECTS During the reporting period, there were five projects advertised for bids subject to the PLA policy totaling $31,661,138. One of the five projects (New Public Works Building) was divided up into twenty-one trade contracts. Each of the trade contracts, regardless of dollar amount, was subject to the PLA policy. A summary listing of the PLA projects that have been advertised and awarded is included in the attachment to this report. This information includes the architect's estimate of probable cost, the amount of the lowest responsive and responsible bid, the amount of the contract award, the number of bids received and how many of the bids were submitted by union and non-union contractors. SUMMARY OF PLA PROJECT BIDS AND CONTRACT AWARDS All five projects advertised for bids subject to the provisions of the PLA policy were awarded to union contractors. The number of bids received per contract averaged out to four with a low of one and a high of six. Architect/engineer cost estimates were $1,897,00.0 lower to $442,894 higher that base bid amounts. The low bid for two of the five projects subject to the PLA policy was lower than the architect/engineer cost estimate. Factoring out the District Attorney's Office Building project, the percentage variation between the award amounts and the cost estimates was —3.78%. In other words, the awarded bid amount was on average, 3,78% less than the estimated amount. REPORTED WAGE VIOLATIONS AND DISPUTES There have been. no reported wage violations/disputes relative to the twenty-five Project Labor Agreements. This policy was modified in August 2003 to incorporate a standardized PLA format, eliminate the core workforce provision,and clarify that the$1 million threshold applies to the actual construction cost of a project, not simply the estimated construction cost. The Board of Supervisors directed the County Administrator (CAO)to report to the Internal Operations Committee(IOC)in one year regarding the County's experience implementing and administering the PLA policy,and the CAO has been reporting periodically to the IOC since that time. At its October 15,2007 meeting,the IOC met with staff from the County Administrator's Office, and General Services and Public Works departments to review those construction projects that have met the PLA criteria since the September 2006 PLA update report,to assess the impact of the policy. Since the 2006 report,only the General Services Department(GSD)had projects—five in number--that were subject to the PLA Policy. The GSD reported no negative impacts to project costs or schedules. Of the 91 bids received on the 5 projects,union contractors submitted 80 bids,non-union contractors submitted 3 bids; and 8 bids were non-responsive: The County received multiple bids on all but one of the five projects, and the single bid was within 3%of the architect's cost estimate. This evidence suggests that the PLA policy is not negatively impacting competition. The PLA policy requires the County to award a project to the lowest responsive and responsible bidder. All five GSD projects were awarded.to union contractors. Bids ranged from 13'/2%below to 10'/z% above architects cost.estimates. No wage violations or disputes were reported on an),of the 25 PLAs relating to the 5 projects. This evidence suggests that the PLA policy is not negatively impacting project costs or schedules. We recommend that the IOC continue to monitor this program on an annual basis and that the County Administrator be directed to make a follow-up report to the IOC in one year's time.
