Vincent Caballero, Building Inspector,presented the staff report including photographs of the premises. He stated Ms. Arnhart came to the Building Inspection Department(BID)November 13, 2006 to submit plans to obtain permits for repairs to be made at 1345 Battery Street. Therefore, he asks that the Board amend the abatement order to 60 days rather than 30 days. Thus giving the owner time to obtain the necessary permits and commence the work. Should the owner fail to submit the needed application to Community Development Department (CDD) and BID within allotted time,;direct the County Abatement Officer to abate the unsafc structure deferring all costs to the property owner. Chair Gioia opened the public hearing with no speaker cards presented. Ms. Suzanne Arnhart, theproperty owner, complained of not being notified when a property is "red tagged" also that a five day hearing notice was insufficient time to prepare for an abatement hearing. She stated she had tried to submit plans to the BID on four different occasions only to be delayed by the CLD because they asked for an interior-framing plan; which she noted is not normally required. She felt the pictures Mr. Caballero took are a bit one sided stating, granted there was a fire and it accurately shows the damage, although it does not show the condition of the beck of the building or the sides that are repairable. Chair Gioia asks for comments from the BID. Mr. Carlos Baltodano, Director, BID, responded to Ms. Arnhart's complaints stating: 1) Ms. Arnhart's statement being correct, for fire damage a permit is issued over the counter,but in this particular case the structural damage and severity of the fire required a more extensive work report showing exactly what work needed to be done. 2) Regarding the notification process. The Clerk of the Board followed standard appeal hearing notice procedure applying a 5 working day notice of hearing. Chair Gioia moved to close the public hearing and adopt staff recommendations with the amendment of 60 days rather than 30 days abatement notice with building permits to be obtained by January 15, 2007. AFFIRM the county abatement officer's determination in the Notice and Order to Abate by finding that the structure is unsafe and Hazardous , and the above-referenced real property is a public nuisance in violation of Contra Costa County Ordinance Code section 712-4.014,and State of California Health and Safety Code Sections 17920.3 and 17922 . ORDER the property owner to abate the public nuisance by removing the unsafe and Hazardous structure from the property within 30 days of the mailing of the Board decision. DIRECT the county abatement officer to remove the unsafe and Hazardous structure from the property, and charge the cost of the work and all administrative costs to the property owner, if the property owner does not comply with the Board's order to abate the public nuisance. FISCAL IMPACT: The Cost of removing the unsafe and Hazardous structure from the property is estimated to be r $12,000. The above-referenced property is located in a p1 zoning district Contra Costa County Ordinance Code section 712-4.014 giving County Building Department enforcement authority of State of California Health and Safety code section 17920.3,which declares any dwelling unit that endangers life, health, safety or welfare of the public or occupants thereof is a substandard building. The county abatement officer made an initial inspection of the above-referenced property on March 17,2006. The count 11 abatement officer observed Fire damage to walls and roof causing roof and ceiling members to sag, split or buckle. I Re-inspection of the property on September 8,2006, showed that the property continued to be in violation of California Health and Safety code section 17920.3. The Notice and Order to Abate was served on the property owners and all known to be in possession of the property by certified mail on September 8,2006, and posted the above- referenced property on September 8,2006. The Property owner filed an appeal of Notice and Order to Abate on September 18,2006. Notice of this appeal hearing was sent to .the property owner by the Clerk of the Board - see Clerk of the Board's mailing confirmation. ORDINANCE CODE 14-6.410 NOTICE IS HEREBY GIVEN that fire damage has rendered the structure located at 1345 Battery St, Richmond, Contra Costa County; APN# 409-031-004 unsafe and hazardous . This condition is a violation of Contra Costa County Ordinance Code section 712-4.014 And State of California Health and Safety Code Sections 17920.3 and 17922. YOU ARE HEREBY ORDERED TO ABATE SAID PUBLIC NUISANCE. You must abate the nuisance by removing the fire damaged structure, from the property within 15 days of the issuance date of this Notice and Order to Abate. The issuance date`is specified below. If you do not abate the public nuisance, the County will remove the fire damaged structure from the property. The abatement will be by public employees, private contractor or other means. The cost of said abatement, if not paid, may be levied and assessed against the property as a special assessment lien and may be collected at the same time and in the same manner as ordinary county taxes are collected, subject to the same penalties, procedures and sales in case of delinquency. YOU MAY APPEAL FROM THIS ORDER OF ABATEMENT, but any such appeal must be brought prior to the expiratio of the number of days specified above for completion of abatement.
