DATE: i November 14, 2006 �r =- COUNTY SUBJECT: Adoption of Government Code Section 31'470.13 Regarding Safety Membership in Retirement SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION i I I I RECOMMENDATION: . I ADOPT Resolution No. 2006/ authorizing the' provisions of Government Code Section 31470.13 be adopted and made applicable in Contra Costa County, to employees in the classifications of Director of Hazardous Materials Program- Exempt (VLD2) and Assistant Director of Hazardous Materials Program (VLFA) effective November 1, 2006. i I BACKGROUND: I! I II In 1999, thell Board of Supervisors adopted GovernmeI ht Code Section 31470.13 regarding safety membership 11, in the Contra Costa County Employee Retirement Association (CCCERA). This government code covers officers and employees whose functions fall within the scope of Hazard Materials Services. At the time, the County classifications meeting these criteria included Hazardous Materials Specialist I and II and Hazardous Materials Technician. Recently, at the request of the Health Services Department, Human Resources revised and. retitled the Director of Environmental Health-Hazardous Material's-Exempt to Director of Hazardous Materials Program-Exempt (VLD2) and revised the Deputy Director of Environmental Health-Hazardous Materials Program Manager to Assistant Director of Hazardous Materials Program (VLFA). I' The classification revisions removed the environmental health portion of the job and placed more emphasis on ,the hazard materials services. Incumbents of either position are subject to exposure to chemical releases, explosions, chemical clouds, etc.!, and have overall responsibility for the managementli and implementation of the Incident Response Team. Pursuant to the statute cited above, these duties fall within the scope of hazardous materials services and is thereby eligible for safety membership in retirement. i I I I I � I! I I NOW, THEREFORE, BE IT BY THE BOARD RESOLVED that, effective November 1, 2006, the provisions of Government Code Section 31470.13 are hereby adopted and made applicable,in Contra Costa County to employees in the classifications of Director of Hazardous Materials Program-Exempt (VLD2) and Assistant Dilrector of Hazardous Materials Program (VLFA).
