(Developer Fees) (All Districts) SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION RECOMMENDED ACTION: APPROVE and AUTHORIZE the Public Works Director,or designee to execute a Consulting Services Agreement Amendment No. 3 effective November 14,2006 with Ghirardelli Associates,Inc.,to increase the payment limit by $300,000 to a new amount of $950,000 for construction management services for subdivision inspection and construction management. FISCAL IMPACT: There will be no impact on the County General Fund. The current Consulting Services Agreement is for$650,000 and will be increased to a new total of$950,000 and shall be paid for by Developer Fees. (All Districts) DATE: November 14, 2006 PAGE: 2 of 2 REASONS FOR RECOMMENDATIONS AND BACKGROUND: Due to the overwhelming amount of development in the Dougherty Valley area,it is necessary to offer assistance to our field inspectors. The activity level within Dougherty Valley has been increasing since April of this year. It is anticipated the workload will continue to increase throughout the winter and continued heavy into the new year.As the workload increased,the County brought on additional inspection services to cover the increased work load.The entire cost of inspection services is covered by the Developer Fees. CONSEQUENCES OF NEGATIVE ACTION: If the Consultant Services Agreement Amendment with Ghirardelli Associates,Inc, is not approved, it may not be possible to complete inspections. AMENDMENT NO. 3 CONSULTING SERVICES AGREEMENT GHIRARDELLI ASSOCIATES, INC. PROJECT NAME: Subdivision Inspections 1. Parties: Effective on November 14, 2006, the County of Contra Costa County, a political subdivision of the State of California, hereinafter referred to as "Public Agency," and Ghirardelli Associates, hereinafter referred to as "Consultant," mutually agree and promise as follows: 2. Purpose: The parties desire to amend the agreement they entered into effective May 1, 2005, entitled "Consulting Servies Agreement," hereinafter referred to as the "Agreement." The Agreement is for providing subdivision inspection services, permit inspection, and other field support associated with development work in the County. This Amendment provides for an increased pay limit due to the continued assistance required for subdivision inspection, permit inspection, and other field support, and increases the payment limit $300,000 for a new total of$950,000. 3. Amendment(s) to Agreement: A. Item 1(e) "Payment Limit" is amended to read $950,000. 4. Remaining Provisions: Except for the changes made by this Amendment, all provisions of the Agreement shall remain in full force and effect. 5.
