SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION
RECOMMENDATION(S):
ADOPT Resolution No. 2006/ 7/6 for Development Plan 02-03057 Branch Creek Vista (Lot 19), accepting
completion of the private improvements, for project being developed by Fairfield San Ramon South, LLC, San
Ramon (Dougherty Valley) area. (District III)
FISCAL IMPACT:
None.
BACKGROUND/REASON(S) FOR RECOMMENDATION(S):
The developer, Fairfield San Ramon South, LLC, has completed the private improvements per the Subdivision
Agreement, and in accordance with the Title 9 of the County Ordinance Code.
CONSEQUENCES OF NEGATIVE ACTION:
The completion of the private improvements will not be accepted and the warranty period will not begin. Developer
will not receive a refund of their cash deposit or ha ye theirpe✓rmance surety bonds exonerated.

Branch Creek Vista (Lot 19), for project being developed by Fairfield San Ramon
South, LLC, San Ramon (Dougherty Valley) area. (District III)
These improvements are approximately located near Bollinger Canyon Road and Watermill
Road.
The Public Works Director has notified this Board that the private improvements in
Development Plan 02-03057 Branch Creek Vista(Lot 19)have been completed as provided in the
Subdivision Agreement with Fairfield San Ramon South,LLC,heretofore approved by this Board in
conjunction with the filing of the Subdivision Map.

SUBJECT: Accepting completion of private improvements,Development Plan 02-03057 Branch
Creek Vista (Lot 19), for project being developed by Fairfield San Ramon South,
LLC, San Ramon(Dougherty Valley) area. (District III)

NOW THEREFORE BE IT RESOLVED that the private improvements have been
COMPLETED as of November 14,2006 thereby establishing the six-month terminal period for the
filing of liens in case of action under said Subdivision Agreement:

BE IT FURTHER RESOLVED the payment(labor and materials)surety for$1,102,450.00,
Bond No. 2084788 issued by the above surety be RETAINED for the six month lien-guarantee
period until May 14, 2007, at which time the Clerk of the Board is AUTHORIZED to release the
surety less the amount of any claims on file.
BE IT FURTHER RESOLVED that the private improvements have been accepted as
COMPLETED and are NOT ACCEPTED NOR DECLARED to be County Roads, at this time.
The private improvements will be maintained by the Homeowners Association.
BE IT FURTHER RESOLVED that there is no warranty period required, and the Public
Works Director is AUTHORIZED to refund the $22,050.00 cash security for performance
(Auditor's Deposit Permit No.411278,dated September 4,2003)plus interest in accordance with
Government Code Section 53079,if appropriate,to Fairfield San Ramon South,LLC,pursuant to
the requirements of the Ordinance Code; and the Subdivision Agreement and surety bond, Bond
No. 2084788, dated August 27, 2003 are exonerated.
All deposit permits are on file with the Public Works Department.
